Comments/Questions: Pre-Solicitation notice, H92240-20-T-0009, CONUS Bareboat Charter Blanket Purchase Agreement.

C/Q1: Center console boats are not manufactured with climate-controlled sleeping quarters capable of accommodating the number of personnel specified, nor are they manufactured with heads equipped with shower facilities. Some manufacturers do outfit their center console boats with small lavatories (i.e., toilet and sink) within the center console itself, with some manufacturers also offering a small cuddy forward with optional air conditioning. I have included a link below to the type of center counsel vessel I am referring to. Can you please verify these requirements with your technical experts? Otherwise the concern is that this requirement will go unmet.

R1: Paragraphs 2.12 and 2.13 removed from Center Console requirement.

C/Q2: I have reviewed the pre-solicitation notice from your email below. The only recommendation I would have for the Trawler PWS is to add a requirement for a center console tender with a minimum 20 hp engine.

R2: See revised PWS, following requirement added: “Vessel shall be equipped with a seaworthy, power driven tender or rigid-hull inflatable vessel (RIB) capable of launch and recovery from the trawler davit or crane and capable of transporting a minimum of four people.” The Government recognizes the recommendation of the horse power requirements but declines to add the horse power requirement.

C /Q3: Primarily the allocation of the funds to the HUBZone community of just 1% is a little bit low allowing just roughly $40,000 over a five year period. I understand it is just a goal but in any event being a HUBZone small business concern I would like to see a larger allocation. I may be the only qualified and experienced HUBZone offering such services. I’ve yet to find anyone who actually does the work and owns the boats. I’ll only be offering one 25’ center console boat in Zones one, two and three. Would you be able to get the SBA to review this on our behalf and make a judgement?

R3: The local Small Business Procurement Center Representative has reviewed and approved a SBA2579 for this action. In regard to Small Business socio-economic goals, the goals listed in the draft solicitation are established at the agency level in coordination with the Small Business Administration and are provided to our offices for implementation. These goals are reviewed where a procurement action is conducted on an unrestricted (not set-aside for small business) basis, there is a need for submission of a small business subcontracting plan (for large businesses), or the activity has determined a need to review utilization of small business for a specific procurement action.

C/Q4: When the task order is issued will there be a provision for delivery above the daily rate?

Or should I put a worst case scenario in my daily rate? Offering a 25’ Center Console allows for towing the boat to any location. As long as we can be compensated for delivery I can offer a good daily rate. Please note I am based in South Florida with operating bases in Ft Lauderdale, Clearwater FL and Houston Texas.

R4: When a request for call is issued, the pricing submitted for your firm’s vessel that was established at the agreement level shall serve as a ceiling rate. When the solicitation is issued and when responding to the issued solicitation your firm shall price on an all-inclusive basis, including any costs associated with delivering the vessel for acceptance and rates established shall not be exceeded at the call level. As stated in the solicitation, there are 5 geographic zones.

Each call will establish the specific acceptance location; however, the vendor should at a minimum anticipate that the location could be any one of the areas identified for the respective zone. It is possible and the vendor should account for potential transportation costs from anywhere within the stated zone. While the agreement will establish ceiling rates, a vendor is encouraged to propose lower rates at the call level to be more competitive.

C/Q5: The center console PWS has some things in it which are not appropriate for the vessel, like berthing etc. I’m assuming that will be cleared up on the actual solicitation.

R5: See response to question 1.

C/Q6: Are we to provide a Captain/boat operator for these charters or are they bare boat?

R6: Solicitation is for bareboat charters, no crew is to be provided by the contractor.

C/Q7: Are we to provide on-site maintenance away from home base or will that be addressed in the task order?

R7: Maintenance responsibilities are defined in each of the vessel type performance work statements. Please review accordingly. The Government realizes vendor concern that maintenance may be performed at various areas within a geographic zone. The Government does not intend to be required to return to port when routine maintenance, such as oil changes, are required. To avoid this, the Government included language under PWS paragraph 5.5 permitting, with contractor approval, of Government personnel to perform routine maintenance. That said, if an emergent maintenance requirement, the Government would expect the vendor to conduct repairs, as required under the respective PWS, t the nearest available port.

C/Q8: How do I address the issue of Past Performance when my contracting officers do not participate in CPARS? I have current contracts with the USCG which are long standing and I have worked for NSW, SOCOM and DoD in the past but I’ve never been evaluated by them in the system. There have been times working for DoD i was a subcontractor. Please give me some guidance how to navigate the Past Performance requirements.

R8: As stated under the provision 52.212-1, Volume 3: Factor 2 – Past Performance, on page seven and eight ,if a contract reference is not in the CPARS system, your firm shall have the contract reference submit a Past Performance Questionnaire.

C/Q9: 1.At the time of BPA award, would the vessel need to meet 100% of the Performance Work Statement Specifications? What about at the time of the Request for Call Order?

R9: The draft solicitation language under FAR 52.212-1 indicates vessels must meet the requirements listed under each quote sheet to be considered for a BPA award, and if applicable, marine survey requirements. At the call level, the vessel must meet all requirements of each vessel performance work statement, and if applicable, marine survey requirements.

C/Q10: Regarding Addenda 01 – PWS for the Center Console – it’s uncommon for a Center Console to have Specification # 2.12 (Sleeping Quarters), 2.13 (More than one head or showers), or 2.14 (HVAC system).

a. Given the above, please consider removing 2.12 and 2.14 all together and editing

2.13 to remove showers/reduce heads quantity to one or more.

R10: See revised PWS, requirements removed.
