Criteria for WBI Energy easements:

1. No fencing, trees or shrubs shall be allowed within 25 feet of our pipeline facilities.

2. No utility or other parallel encroachments are allowed within 25 feet of our pipeline facilities.

3. Any proposed equipment crossings must have WBI Energy prior approval.

4. No structures, either permanent or temporary are allowed within 25 feet of our pipeline facilities.

5. Any proposed grading or ground disturbance within 25 feet of our pipeline facilities must have prior approval of WBI Energy.

6. Any proposed water drainage reroute or retention ponds over or within 25 feet of WBI Energy facilities must have prior approval of WBI Energy.

Criteria for WBI Energy pipeline crossings:

1. You will assume full responsibility for any and all damages caused by the construction, operation and maintenance of your facilities.

2. For utility crossings WBI Energy requires a minimum of 12" separation between the new facility and our pipeline for trenching.

3. Excavation within 24"of our pipeline shall be performed by hand digging only.

4. When crossing is done by horizontal drilling, a separation of 12" greater than the size of the largest reamer will be maintained. The pipeline will be exposed 24" on both sides of the proposed bore path, excavating to a depth of 12" below our line throughout the drilling process to ensure the pipeline is not damaged.

5. When crossing stay as close to perpendicular as possible.

6. Your facilities will cross beneath our pipeline if at all possible.

7. Notify us of your crossing through the one call system. A WBI Energy representative will mark our pipeline and must be present to witness all crossings prior to backfi ll.

8. Do not expose more than 12' length of pipe without prior engineering approval.

9. No vibratory compaction within 25' of pipeline.

10. No heavy equipment is permitted to drive over the pipeline until approved engineering is done by WBI Energy to determine loading and vibration over the high pressure pipel ine.

11. WBI Energy will be notified 24 hours prior to any excavation or drill that is planned to take place.
