About this file
This is a Byrd Anti-Lobbying Certification form required for a Mechanical Engineering Design Services contract opportunity with the City of North Carolina. The certification applies to as-needed mechanical engineering design services for maintenance and minor renovation projects across the city's portfolio of 200+ municipal facilities. Services encompass HVAC system design and installation, including air- or water-cooled chillers, split and unitary systems, heat pumps, and geothermal solutions; plumbing design for hot water and chilled water distribution; and smaller renovation projects such as sink and water fountain installations. The consultant may also be required to perform investigation and scoping studies related to mechanical systems, comfort assessments, and operations evaluations, with potential emergency services on short notice. Energy-efficient design solutions are emphasized in accordance with the City Sustainable Facilities Policy.
The certification mandates that no federal appropriated funds will be used to pay any person for lobbying activities related to the contract award, and if any non-federal funds are used for lobbying contacts, the contractor must complete and submit Standard Form-LLL disclosing such activities. The contractor must also require this certification language be included in all subaward documents at all tiers and ensure all subrecipients certify and disclose accordingly. Failure to file the required certification subjects the contractor to civil penalties ranging from $10,000 to $100,000 for each failure. The certification is a material representation of fact and a prerequisite for entering into the transaction under 31 U.S.C. § 1352, with provisions of 31 U.S.C. § 3801 et seq. applying to the certification and any required disclosures.
