About this file

This is a compliance guidance document issued by Harris County's Department of Economic Equity and Opportunity (DEEO) outlining the procedures and requirements for Minority/Women-Owned Business Enterprise (M/WBE) trucking companies to perform a Commercially Useful Function (CUF) and receive M/WBE credit on Harris County contracts. The document establishes that M/WBE trucking firms must be certified by Harris County, own and operate at least one truck with an employed driver, perform a minimum of 30 percent of subcontract work with their own forces, and maintain management and supervision of the entire trucking operation. The guidance specifies that M/WBE firms receive 100 percent credit toward participation goals for all transportation services using trucks they own, insure, and operate with their own employees. Vendors utilizing M/WBE trucking companies must submit supporting documentation with their M/WBE Utilization Plan, including the trucking company's W-9, current insurance documents, and proof of truck ownership or registration. DEEO offers courtesy utilization plan reviews with a deadline of five business days prior to solicitation closure, though the agency notes this review does not determine plan responsiveness and vendors should ensure all required documentation is submitted with their formal bid.

The document addresses multiple scenarios for M/WBE trucking credit, including situations where M/WBE firms subcontract to other M/WBE truck owners and operators, lease additional trucks from non-M/WBE firms while employing their own drivers, or lease trucks without drivers. For leased trucks exceeding the ratio of one leased truck per owned and operated truck, contractors receive credit only for fees and commissions rather than full expenditure value. The guidance emphasizes that M/WBE drivers must be employees rather than independent contractors to qualify for credit, and any leases must demonstrate exclusive use and control with the M/WBE's name and identification number displayed on the vehicle. Contact information for DEEO is provided at 1001 Preston, Suite 670, Houston, TX 77002, (713) 274-1400, or DEEO@eeo.hctx.net, with complete M/WBE program policy details available on the DEEO website.
