About this file

This document is a regulatory guidance excerpt from the Centers for Medicare and Medicaid Services (CMS) State Operations Manual (SOM), Section 7213.6, dated June 12, 2014, establishing qualifications and approval requirements for Independent Informal Dispute Resolution (IDR) entities or persons. The guidance applies to state agencies and outside organizations contracted by state agencies to serve as independent dispute resolution entities in Medicare and Medicaid program matters. CMS establishes the regulatory framework and approval requirements that states must follow when selecting IDR vendors.

The document specifies that IDR entities or persons must demonstrate expertise and training in Medicare and Medicaid program requirements, including 42 CFR Parts 483 and 488, the State Operations Manual chapters and appendices, and applicable healthcare standards of practice and life safety codes relevant to disputed issues. IDR vendors must maintain impartiality and transparency and must be approved by CMS prior to contract award. The document identifies specific conflict of interest restrictions, including prohibitions against vendors who were employed by state survey agencies within the past year, have family members or current employment at involved facilities, hold ownership interests in involved organizations, or have served as legal counsel for facilities involved in disputes. Acceptable vendor options include separate components of state umbrella agencies or independent entities with specific Medicare and Medicaid expertise selected by the state and approved by CMS.
