About this file
This is a New Mexico Resident Veteran's Preference Affidavit form used for state and local contract opportunities in New Mexico. The document is specifically designed for businesses seeking to claim resident veteran preference benefits on solicitations such as the Solid Waste Disposal Services contract. The affidavit requires businesses to certify their eligibility under New Mexico Statutes 13-1-21 or 13-1-22 by declaring under penalty of perjury that their prior year revenue does not exceed $3 million, which qualifies them for a 10 percent preference discount on the solicitation. The form mandates that an authorized business representative sign and date the certification, and it clearly states that false or misleading information constitutes a crime.
The document establishes specific conditions and obligations for resident veteran businesses claiming the preference. Businesses may not benefit from the preference for more than ten consecutive years, and individuals cannot claim preference based on more than one business concurrently. Award recipients must submit annual reports to the State Purchasing Division of the General Services Department declaring the calendar year revenue and the contract award amount, categorized as either a purchase from a public body or a public works contract. Failure to provide accurate information on these reports also constitutes a crime. The representations made through the affidavit are considered material and subject to protest, with potential consequences including denial of award or unaward of the procurement if statements are proven incorrect.
