About this file
The file "53000-5-1-2025+Question+3+Added.docx" appears to be a supplemental document related to the North Dakota Department of Corrections and Rehabilitation's (ND DOCR) Milk 2025 procurement. The solicitation seeks bids for milk and dairy products to be delivered to multiple correctional facilities, including North Dakota State Penitentiary, James River Correctional Center, Missouri River Correctional Center, and Youth Correctional Center. The contract covers specific dairy items such as 1% milk pints, chocolate skim milk pints, 2% milk pints, 1-gallon milk jugs, heavy whipping cream, buttermilk, and lite sour cream. The bid was released on March 20, 2025, with a bid question submission deadline of April 3, 2025, and a bid response deadline of April 10, 2025. The contract period is set from May 1, 2025, to April 30, 2027, with options to renew for up to three additional 12-month periods.
Pricing for the contract will be structured using a "floor price" controlled by the North Dakota Milk Marketing Board, to which vendors can add their markup. Bidders must be authorized to sell milk products by the North Dakota Milk Marketing Board and will be subject to potential pricing adjustments through fuel surcharges and changes in the board's pricing methodology. The solicitation does not specify set-aside designations for disadvantaged enterprises. While specific budget ranges are not detailed, the procurement covers multiple correctional facilities with varying weekly usage quantities, suggesting a potentially substantial contract value. The flexible pricing mechanisms and multi-year contract structure indicate the state's intention to establish a stable, long-term dairy product supply arrangement for its correctional system.

53000-5-1-2025 Question 1 Can 1% chocolate ½ pints be bid in place of skim chocolate ½ pints?
Answer 1 No however the intent of this bid was to competitively buy milk for the ND DOCR. The specification for item 3 was skim chocolate ½ pints because that is product we are currently buying for a reduced fat ½ pint chocolate milk. This specification was not written to limit competition, therefore an amendment will be added to the bid with an updated bid response form referencing line 3a (skim chocolate ½ pint) and 3b (1% chocolate ½ pint). Only one of the two products are required on the bid however if now a vendor bids both options only the lowest price will be factored on the award. Note the reduced fat chocolate half pint cartons (items 3a or 3b) need to meet the requirements for the USDA school lunch program.
Question 2 Can Lactose Free Sour cream be bid in place of the “lite” sour cream on item #8.
Answer #2 No lactose free sour cream will not be accepted, however Section B on the response form (items #6-9) are optional therefor should NOT be required to bid.
Question 3 Is the pricing locked for a period of time with the option to change at renewals or will it change with the commodity pricing?
Answer 3 The pricing will constantly fluctuate with the commodity pricing. Basically, vendors are bidding on the mark-up added the 'floor price" that is set by the ND Milk Marketing Board. This mark-up will be set for the term of the contract and will act as an escalator clause following the fluctuation of the "floor price". Bidder with the lowest mark-up will be awarded the bid.
