About this file
The document is an Amendment (Number Two) to a Request for Proposals (RFP) issued by the State Purchasing Division of the General Services Department and the New Mexico Environment Department for the River Stewardship Program (RFP# 50-66700-25-27764) for Fiscal Year 2026. The RFP was released on March 17, 2025, with proposals due by May 20, 2025. The amendment modifies sections of the original RFP, specifically addressing detailed scope of work, including changes to reimbursement guidelines, reporting requirements, payment processes, and project implementation standards.
The amendment outlines key programmatic requirements, including restrictions on reimbursable items such as salaries, government employee wages, and ongoing maintenance costs. Contractors will be required to submit semi-annual progress reports in January and July, with detailed documentation of project tasks, challenges, and outcomes. Payments will be made upon submission of detailed invoices and supporting documentation, with the understanding that final payments will be withheld until the final project report is accepted. The program includes provisions for federal fund leveraging, auditing, and specific requirements for projects involving private landowners, with a mandatory ten-year protection period for projects implemented on private lands.

11. Leveraging of Federal Funds: NMED intends to use River Stewardship Program funds to match grant funds under the federal Clean Water Act. NMED will complete this reporting internally, separate from this procurement. Contractors are not authorized to claim or report the funds as match for any federal program without prior authorization in writing from NMED. Contractors may specify a requested amount of funds to be used as match for a federal program in their Project budget (see paragraph 8, above).
12. Reports: Contractors under the River Stewardship Program shall prepare and submit progress reports to the NMED Project Officer on a semi-annual basis, in January and July. The reporting periods will be January 1 through June 30, due by July 31st, and July 1 through December 31, due January 31st of each year. Reports shall be submitted electronically by e-mail to the assigned NMED Project Officer in Windows Microsoft (MS) Word or Adobe portable document format (.pdf). The reports shall consist of a narrative of project progress including a discussion of each project task as outlined in the project work plan and photographs of project progress. The reports shall also include a discussion of any project challenges and work planned for the next six-month period. At the end of the project term, a final report shall be submitted which includes a complete description of all activities and deliverables completed, photographs, and written and graphical analysis of monitoring data and project outcomes. The final report shall be submitted before the contract expires and final payment is made.
13. Payments: Contractors will be reimbursed for costs incurred upon submittal of detailed invoices, (See Draft Agreements in APPENDIX C and APPENDIX D) proof of payment and other supporting documentation (e.g., subcontractor invoices, timesheets, receipts, etc.), and the Reimbursement Request Packet provided by the program. After NMED review, payment will be made upon satisfactory completion of work accepted by NMED and receipt of a complete invoice package. Payment may be withheld for failure to complete timely semi-annual reports or other project deliverables stated in the work plan attachment to the agreement or contract. Final project invoice payments will be withheld until the project’s Final Report is accepted by NMED.
14. Audits: NMED may at any time review and audit requests for payment and adjust for various reasons such as, math errors, items not built or purchased, unacceptable construction or performance, or lack of conformance with approved work plans and schedules. The contractor and all subcontractors shall retain all records relating to the project for a period of five (5) years from the date of agreement, or contract termination in accordance with the provisions of the Office of Management and Budget (OMB) Circular No. A-133, "Audits of States, Local Governments, and Non-Profit Organizations," published in the Federal Register on June 30, 1997, non-federal entities.
15. Anti-Donation: The Project may only benefit private entities in accordance with applicable law, including, but not limited to, Article IX, Section 14 of the Constitution of the State of New Mexico, the so-called “Anti-Donation Clause.”
16. Private Landowner Agreements: For any project that includes work on private land, each landowner must sign a separate Private Landowner Agreement, provided by the Agency (see APPENDIX G). At a minimum, the Private Landowner Agreement requires the landowner(s) to protect the project for a period of ten (10) years.
