TREE MANAGEMENT AND SIDEWALK SYSTEM
REPAIR, PROJECT NO. 542-14-104
Provide all administration, labor, and material associatedwith renovating and repairing all annotated areas within the drawings throughout the CVAMC Campus. Work for the Tree Management and Sidewalk System includes, but is not limited to the following:
Tree Management: Remove, prune, and/or fertilize existing trees for the Oval #1 area. Tree removal includes removing th stumps. Landscape Improvements: Provide and plant trees, shrubs, perennial, and ground cover. Sidewalk Improvement Replace most of the existing concrete sidewalks within the Oval #1 courtyard. To meet current VA accessibility requirements, some of the sidewalk system replacement requires the install ation of new ramps. Basketball Half Court:
Provide pavement markings and adjustable basketball goal. New Smoking Shelter: Remove existing and provide new smoking Drainage Improvements: Grade select areas of the Oval #1 courtyard and modify existing and provide new drainage system components. Storm Management: Complete confirmation infiltration testing. Provide raingardens and infiltration trenches Complete soil amendment restoration. Erosion and Sediment Control: Provide and maintain erosion and sediment control measures for the project. Site Restoration: Restoring existing surfaces, structures, and items disturbed by construction work required for the project. NPDES General Permit: Obtain coverage under the NPDES General Permit as a co-permittee and provide all work to comply with permit requirements. Other Work: Provide other work specified and shown on the drawings. Additional Work: Remove and recycle 1250 cubic yards of masonry, concrete, and asphalt debris and remove and rec ycle an additional 80 cubic yards of tree debris co-located at the T21 laydown yard of the CVAMC campus.
Prior to commencement of work, general contractor shall provide proof that an OSHA c ertified "competent person' (CP) will maintain a presence at the work site whenever the general or subcontractors are present.
This project is 100% set-aside for Service-Disabled Veteran-Owned Small Business Concerns. Bidders must be verified as SDVOSB per the Center for Veterans Enterprises (CVE) www.vetbiz.gov website.
The magnitude of construction is between $ 1,000,000.00 and $2,000,000.00
The small business size standard is $36.5 million. North American Industry Classification (NAICS) Code is 236220.
Contractor Personnel Security Requirements: All contractor personnel may be subject to fingerprinting and background security checks. Background security checks may be required prior to start of this project.

STATEMENT OF WORK

Work for the Tree Management and Sidewalk System includes, but is not limited to, the following items.

PLACE OF PERFORMANCE:
The Coatesville VA Medical Center (CVAMC) - 1400 Blackhorse Hill Road, Coatesville, PA 19320.
BACKGROUND:
The Coatesville VA Medical Center (CVAMC) (Engineering) has a requirement to repair badly flooding areas through storm water management, remove dangerously unhealthy trees, repair poor grading and landscaping, replace excessively cracked sidewalk and patio areas, and install a VHA Directive compliant smoking shelter.
SCOPE:
Through attachments provided herein consisting of AE Drawings, Specification Book, Soil Erosion and Sediment Control Report, Post Construction Storm Management Report and any applicable VHA Design Guides, the contractor will perform all works as entailed in the documents. This Statement of Work is NOT all-inclusive.
The storm water management improvements include grading, a new drainage system, and rain gardens. Additional storm water BMP’s shall be added to comply with NPDES permits. Grading of the entire courtyard will slope away from buildings and towards inlets and rain gardens. New drainage pipe, manholes, and catch-basins will be installed per the drawings and existing rain gutters will be connected and properly secured to the new drainage system where applicable.
Approximately 204 trees were assessed at the initial AE survey in 2013 inside and outside of Oval One. Over the course of the years, the initial assessment has been modified by nature. Some trees have been removed already, some need additional pruning or fertilizing. For bidding purposes, we will consider all the assessed trees per the specifications and drawings with regards to fertilization, pruning, removal, etc. If a previously assessed tree has already been addressed/repaired, then the contractor will apply a credit for that tree and the VA will utilize that credit at their discretion, possibly the same designated work on another tree. Per the drawings, a variety of new canopy and sub-canopy trees are being proposed to take over the gaps from tree removal. Not covered in the drawings there will be an additional ten (10) trees to be removed and an additional ten (10) trees to be pruned/fertilized. These will be chosen by the COR as recommended by the arborist. For each one of the ten trees removed, there shall be two (2) trees replanted per the COR’s decision recommended by the arborist. These trees may be of canopy, sub-canopy, flowering, etc.
Most of the sidewalk within Oval One Courtyard will be replaced. Sidewalk and concrete improvements will only occur within Oval One since there was a modification to the cost prohibitive original plan. All sidewalks will comply with ABAAS and VA accessibility criteria at a minimum. Soil spoils from the concrete works will be reused to properly pitch grading throughout all locations within Oval One to include building foundations. Concrete for a new basketball court will be installed in the present location including a new adjustable backboard and line painting as per the drawings.
General landscaping improvements will occur per the drawings to include planted areas with shrubs and rain gardens. All excavation will be completed with a proper grade of the buildings and work area with top soil as per the drawings, seeded with seed commensurate with the soil and sunlight, and decomposing mesh infused with straw for seed growth.
A new smoking shelter will be built near building 2 inside Oval One. This shelter will comply with the drawings, specifications, and VHA Directive 1085. An ABA compliant walkway and repaired portion of the existing canopy will also be installed.
All work is to be in accordance with the drawings and specifications. The Requirements section is not an all-encompassing list of works.
PERFORMANCE REQUIREMENTS:
The contractor shall comply with all performance requirements listed herein, and all work shall be performed in accordance with the attached Drawings, the Master Construction Specifications, and the VHA Directive 7715 Safety and Health During Construction.
A. Construction Barrier: The contractor shall provide a safety barrier around the construction site / work area, comprised of a plastic barrier and caution tape only when a 6’ chain link fence cannot be used
B. Materials: All materials must be submitted as manufacturers specifications (cut sheets) to the COR and AE and gain approval prior to starting any work. The contractor shall only supply items that are compliant with the Buy American Act. All materials or items to be supplied by the contractor that are not listed in an attachment must first be submitted to the Contracting Officer Representative (COR) and the Contracting Officer (CO) for approval prior to installation.

Testing and Acceptance: At the completion of all performance requirements, the contractor shall demonstrate for the COR that all newly installed items under this contract are functioning properly prior to the Government’s final acceptance. A full one-year warranty for all materials, installation, and workmanship shall be given by the contractor upon final acceptance of the contract.
SPECIAL CONTRACTOR PROVISIONS:
A. Contractor Responsibilities:
1) The contractor is responsible for verifying all site conditions prior to performing any work under this contract.
2) The contractor is responsible for protecting adjacent structures, equipment, vehicles, pedestrians, and vegetation while performing under this contract. Large dust dispersal may require the contractor to wet down the material.
3) The contractor shall be responsible for the actions of all individuals provided to work under this contract. If in the event damages arise from work provided by contractor personnel, the contractor shall be responsible for all resources necessary to remedy the incident (including damages to landscaping) at no additional cost to the Government.
4) The contractor shall adhere to all Occupational Safety and Health Administration (OSHA) regulations, as well as the safety regulations of the CVAMC while performing under this contract with reference to VA Directive 7715 - Safety and Health During Construction.
5) The contractor shall be responsible for ensuring that all individuals provided to work under this contract are properly licensed to operate a motor vehicle, if operating a motor vehicle on VA property is required.
B. Security Requirements:
1) Prior to the commencement of any work under this contract, upon arrival to the CVAMC, contractor personnel shall first check-in with the VA Police (Building 1) to obtain a VA visitor badge.
2) The contractor employee shall be responsible for safeguarding the badge and immediately report if the badge has been lost, stolen, or destroyed to the VA Police.
3) Contractor personnel shall properly display their employee identification badge and VA visitor badge at all times while on VA property so that their name, photo, and the company they work for can easily be seen.
4) All contractor personnel shall properly sign out with the VA Police upon the completion of all daily work activities.
5) All durational contractor personnel shall have a formal VA identification card which requires finger-printing and background check.
C. Required Contractor Notifications:
1) Contractor personnel shall inform the COR of the need to gain access to secured areas. If access is required to secured areas, prearranged scheduling will be coordinated between the contractor and the COR.
2) The contractor shall coordinate all equipment shutdowns with the COR.
3) If work is required beyond the terms of this contract, the contractor shall provide the Contracting Officer (CO) and the COR with a written cost estimate for any additional work or materials at no cost to the Government. The contractor shall not perform any work or make any purchases beyond the terms of this contract without approval from the Contracting Officer. The Contracting Officer representative is not authorized to make financial authorizations or determinations.
D. Warranty: All services provided by the contractor, as well as parts replaced shall come with a one (1) year warranty (minimum) from date of government acceptance. All labor, tools, supplies, transportation, and equipment associated with the replacement of warranty items shall be provided by the contractor at no additional cost to the Government.
E. Interference in Performance Requirements: The following provisions shall be adhered to by contractor personnel throughout the duration of this contract:
1) The contractor may be required to interrupt their work at any time so as not to interfere with the normal functioning of the facility; e.g. utility services, emergency responses, the passage of facility patients/personnel, etc.
2) In the event of an emergency, contractor services may be stopped and rescheduled at no additional cost to the Government.
F. Contractor Required Reporting:
1) Prior to the completion of all weekly work activities, the contractor shall exclusively supply the COR, with his/her company’s work-documentation (daily logs) and certified payrolls per the Construction Wage Rate Requirements (formerly Davis Bacon Act).
2) The contractor shall supply the COR with any product literature and maintenance requirements for all items installed under this contract.
G. Cleanup and Disposal:
1) Housekeeping:
a. The contractor shall maintain a clean and orderly work environment, ensuring the area is free from debris during construction and after the completion of all services provided under this contract.
b. If the COR finds the area where services were provided to be unacceptable, the contractor at his/her own cost shall re-clean the area until acceptance is gained. It is critical in a hospital environment to maintain the highest level of aesthetics as can be afforded during construction.
2) Disposal of Trash and Hazardous Waste:
a. The contractor shall be responsible for the removal of all trash and debris from VA property throughout the project and will not be allowed to stage waste on the VA property. For all waste, the VA will be provided a receipt of recycling with weight.
b. The contractor shall comply with the Occupational Safety and Health Administration (OSHA), the United States Environmental Protection Agency (EPA), the Department of Transportation (DOT), State, and all other applicable regulations governing the proper handling, disposal, and removal of waste. All supervisors shall have available at all times a completion record of the 30-hour OSHA course and all employees shall have the 10-hour OSHA course certificates available on the job site.
PERFORMANCE SCHEDULE:
A. Performance Start:
The contractor shall begin performance within 30 days of receipt of the Notice to Proceed.
B. Period of Performance:
The contractor shall complete all performance requirements within 180 days of the Notice to Proceed.
C. Working Hours:
1) The activity of this project shall be performed Monday through Friday (except Federal Holidays), 7:00 AM (EST) – 4:30 PM (EST).
INSTRUCTIONS, CONDITIONS AND OTHER STATEMENTS TO BIDDERS/OFFERORS
A. TRAINING:
Effective July 31, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course. Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. Failure to present the proper training documentation will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
It is the responsibility of the Contractor to provide TB training annually and a PPD test annually for any employees providing services at the VA Medical Center, Coatesville, PA. The government reserves the right to review the contractor’s records. Failure to present the proper training documentation upon the Contracting Officer’s request will result in the individual being removed from the job; the individual may only return after the proper documentation has been provided. There shall be no exceptions to this requirement.
B. PRIVACY AND CONFIDENTIALITY:
Contractors to the Department of Veterans Affairs may be unintentionally exposed to sensitive information. Information maybe overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as, but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized in accordance with the contracted services. Failure to comply with applicable statutes and regulation can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breaches of the privacy and confidential should be reported immediately to the Contracting Officer, COR or the Facility Privacy Officer.
C. KEYS:
All keys provided the Contractor or any subcontractor for use during the project shall be returned to the COR at completion of the work or upon request. No keys shall be reproduced by the Contractor or any subcontractor. There shall be a charge for each key that is lost or not returned to the COR.
D. CONTRACTOR NORMAL WORK HOURS:
The contractor work hours are from 7:00AM to 4:30PM, Monday through Friday, excluding federal holidays. Federal holidays that fall on a non-work day –Saturday or Sunday—the holiday usually is observed on Monday if the holiday is on Sunday or on Friday if the holiday is on Saturday. The contractor may request authorization from the Contracting Officer to work an alternative schedule or on holidays. However, the Contracting Officer reserves the right to deny or authorize the contractor’s request at his or her discretion considering the best interests of the Government. All federal holidays are observed as non work days. Federal holidays can be found on the following web site: http://www.opm.gov/policy-data-oversight/snow-dismissal-procedures/federal-holidays. These days will be identified during the pre-construction meeting. This contract may require work to be performed off-hours, and any increased costs related to this work will be the responsibility of the contractor.
E. SAFETY OR ENVIRONMENTAL VIOLATIONS AND EXPERIENCE MODIFICATION RATE
All offerors shall submit information pertaining to their past safety and environmental record. The information shall contain, at a minimum, a certification that the offeror has no more than three (3) serious, or one (1) repeat or one (1) willful OSHA or any Environmental Protection Agency (EPA) violation(s) in the past three years. All offerors shall submit information regarding their current Experience Modification Rate (EMR) equal to or less than 1.0. This information shall be obtained from the offeror’s insurance company and be furnished on the insurance carrier’s letterhead.
Self-insured contractors or other contractors that cannot provide their EMR rating on insurance letterhead must obtain a rating from the National Council on Compensation Insurance, Inc. (NCCI) by completing/submitting form ERM-6 and providing the rating on letterhead from NCCI. Self-insured contractors or other contractors that cannot provide EMR rating on insurance letterhead from the states or territories of CA, DE, MI, NJ, ND, OH, PA, WA, WY, and PR shall obtain their EMR rating from their state run worker’s compensation insurance rating bureau.
A determination of responsibility will be accomplished for the apparent awardee prior to processing the award. The above information, along with other information obtained from Government systems, such as the System for Award Management (SAM.gov), Vendor Information Pages (VETBIZ), Experian Credit Risk Score and Financial Stability Risk Score (Experian) and/or DUN and Bradstreet, Federal Awardee Performance and Integrity Information System (FAPIIS) accessed through the Past Performance Information Retrieval System (PPIRS), Small Business Administration (SBA), Office of Inspector General-Health and Human Services (OIG-HHS), OSHA, Veterans’ Employment & Training Services (VETS 4214) reporting database, and EPA online inspection history databases will be used to make the Determination of Responsibility. Any information received by the Government that would cause for a negative Determination of Responsibility may make the offeror ineligible for award. This requirement is applicable to all subcontracting tiers, and prospective prime contractors are responsible for determining the responsibility of their prospective subcontractors.
As required by the statutory requirement pertaining to the Veterans Benefits Act of 2003 (15 U.S.C. 657f) and in accordance with FAR 6.206, this procurement will be set-aside for Veteran Owned Small Business (VOSB) concerns. Only VOSB concerns who are verified in the Vendor Information Page (VETBIZ) and registered in System for Award Management (SAM.gov) will be eligible to submit proposals.
F. LOCATION OF UNDERGROUND UTILITIES:
Contractor cannot rely on available VA as-built drawings to identify all existing underground utilities. Prior to any excavating, contractor shall be required to make sure that the location of all underground utilities in excavation sites is accurately designated. Contractor shall be responsible for all costs related to identification of underground utilities. Contractor shall provide a comprehensive report on all underground utilities, which must include survey ground marks laid out and an illustration of job-site showing underground utilities. The Utility Location & Coordination Uniform Color Code shall be used for the ground marks and illustrations. Damage to underground utilities as a result of contractor’s excavation activity shall be repaired at contractor’s expense.
It may be necessary for contractor to employ the services of a Subsurface Utility Engineering firm to conduct surveys to locate all underground utilities in areas to be excavated. Such surveys might utilize geophysical prospecting techniques and electromagnetics. In some circumstances these conventional methods do not precisely locate the utilities, in which case the following additional means may be utilized: TV video pipe inspection, ground penetrating radar (for non-metallics), and vacuum excavation.
G. CONTRACTING OFFICER’S REPRESENTATIVE (COR):
(In accordance with VAAR 1.604 and 1.602-2) the COR assists in the technical monitoring or administration of a contract. Limited authority is given in writing by the Contracting Officer’s letter of designation describing the COR’s duties and responsibilities. The COR has no authority to make any commitments or changes that affect price, quality, quantity, delivery, or other terms and conditions of the contract (or provisions of the solicitation). The COR’s authority is limited to contract administration functions delegated in writing by the Contracting Officer. In this solicitation and in the specifications, COR may be used interchangeably with Contracting Officer’s Technical Representative (COTR), Resident Engineer, Project Engineer and Engineer/Engineering.
H. POINT OF CONTACT:
All questions are to be directed to the Contracting Officer at the Coatesville VA Medical Center. Do not contact any A/E firm that may be identified herein. The A/E firm does not have the authority to share information with others or bind the government.
I. WAGE AND HOUR LAWS:
The Contractor shall be responsible for the correct title classification of workers and compliance with all applicable wage and hour laws.
INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE AND BONDS
(a) Bid materials consisting of drawings, specifications and contract forms may be obtained by qualified General (Prime) Contractors interested in submitting bid directly to the Department of Veterans Affairs through download from FBO.gov.
(b) A Bid Guarantee is required in an amount not less than 20 percent of the proposal price. Failure to furnish the required Bid Guarantee in the proper form and amount, by the time and date proposals are due, will require rejection of the proposal in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then. (Refer to FAR 52.228-1)
(c) The offeror to whom award is made will be required to furnish a Payment Bond, SF 25A, and a Performance Bond, SF 25, each in the penal sum as noted in the General Conditions.
(d) In accordance with FAR 52.228-5, Insurance, Work on Government Installation, proof of liability insurance is required within ten (10) days after award of the contract for this project in the form of a certificate.
(e) Organized Site Visit Information, See FAR 52.236-27.
(f) Contractor questions must be submitted electronically, including project title and solicitation number to the Contracting Officer by 04/04/2019, 4:00 PM, EST.
(g) VA response to Contractor questions will be uploaded to FBO.gov through amendment on /or about 04/11/2019.
SOLICITATION PROVISIONS
1.1 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (OCT 2018)
(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 236220.
(2) The small business size standard is $36.5 Million.
(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

1.2 52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (OCT 2018)
(a) Definitions. As used in this provision— "Administrative proceeding" means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.
"Federal contracts and grants with total value greater than $10,000,000" means—
