IMPORTANT NOTICE REGARDING TECHNICAL DATA:
The JPACE, LJPACE, and Repair Kits are items that require consistently high standards of manufacturing quality. These items are Critical Safety Items subject to International Traffic in Arms Regulations (ITAR). In order to be eligible to receive the technical data, firms are required to have a JCP certification and sign a Non-Disclosure Agreement.
Any prospective offeror shall provide a completed DD Form 2345 (MAY 2019) with JCP certification number in block 7b and the Non-Disclosure Agreement in order to receive a copy of the technical data, associated patterns, and any other necessary documentation for the manufacture of the JPACE & LJPACE.
This item contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq) or the Export Administration Act of 1979 (Title 50, U.S.C. APP2401 et seq) as amended. Violations of these export laws are subject to severe criminal penalties. Dissemination is in accordance with provisions of DoD Directive 5230.24 and 5230.25. Distribution of technical data is authorized to the Department of Defense and U.S. DoD contractors only. Critical determination was made 12 February 2009.
The dissemination of the technical data for the JPACE & LJPACE falls under the Joint Certification Program (JCP). The JCP was established in 1985 to allow United States (U.S.)/Canadian contractors to apply for access to Department of Defense/Department of National Defence (DOD/DND) unclassified export controlled technical data/critical technology on an equally favorable basis in accordance with DODI 5320.25 “Withholding of Unclassified Technical Data and Technology from Public Disclosure”, and Canadian Technical Data Control Regulations. NOTES:
1. Contractors residing outside of the US and Canada will need to contact your state department on policies and procedures on becoming certified.
2. Certification is a lengthy process!! If interested, it is highly recommended to initiate this process immediately.
What this means for you: Distribution of the JPACE & LJPACE technical data is only authorized after the interested offeror completes a Non-Disclosure Agreement and all requirements for obtaining JCP certification – a DD Form 2345 (MAY 2019) Militarily Critical Technical Data Agreement (with certification). The DD Form 2345, detailed instructions on how to fill out the form, and additional requirements for submission are attached to this Pre-Solicitation Notice.
ACQUISITION INFORMATION:
The solicitation will be issued with two separate and independent lots: Lot 0001 and Lot 0002. Solicitation will be issued as Unrestricted using Best Value Trade Off Source Selection Procedures. The evaluation factors are: 1) PDMs, 2) Past Performance Confidence Assessment, and 3) Small Business Participation. Solicitation will be issued with two separate and distinct lots:
· Lot 0001 for the Male & Female JPACE and Repair Kits with the intent to convert to LJPACE after the first delivery order of approximately 12,000-13,000 JPACE.
· Lot 0002 for the Male & Female LJPACE and Repair Kits. (NOTE: The Government reserves the right to add the Male & Female JPACE to this contract, if deemed necessary) Each of the two lots resulting in a Firm-Fixed Price, Indefinite Delivery, Indefinitely Quantity contract will consist of a two-year base term with tiered pricing whereby the offerors may offer separate prices for year one and year two.
The Government intends to make two awards to two different contractors based on an integrated assessment of technical factors (PDM, Past Performance Confidence Assessment, and Small Business Participation) and price resulting in the best value to the Government. However, the Government reserves the right to make awards of both lots to the same awardee if it is deemed in the Government’s best interests.
Quantities: The items and quantities for each lot are outlined below:

The unit price for LJPACE will not be used for evaluation.

Product Demonstration Models (PDMs), First Article Testing (FAT), and Production Lot Testing (PLT) will be required.
The samples required for PDMs, FAT, PLT, and JPM CBRN P will not be priced separately. All costs associated with the manufacture of the above-mentioned samples will be borne by the awardee. The awardee shall calculate all costs associated with the manufacturing of the PDMs, FAT, PLT, and JPM-P samples and include the associated costs in the offered unit price of the JPACE & LJPACE to be delivered to DLA Troop Support.
PDMs: Two (2) samples of JPACE for Lot 0001 and/or Two (2) samples of LJPACE for Lot 0002 are required. One (1) Male size 48-Long and one (1) Female size 34-Short. In addition, one (1) sample of each type of repair kits shall be submitted. PDMs will be examined for visual, dimensional, and manufacturing defects in accordance with the JPACE/LJPACE PD JPMP-PD-JPACE-01C. Samples shall be submitted to the Business Opportunities Office at DLA Troop Support as part of offeror’s proposal submission prior to solicitation close.
DLA Troop Support 700 Robbins Avenue Philadelphia, PA 19111 ATTN: Business Opportunities Office Bldg 45, Wing C, 1st Floor, Room 1046 FAT: Awardee(s) shall provide:
1. Fifty (50) OFERKs fabricated as specified by the JPACE/LJPACE PD JPMP-PD-JPACE-01C
2. Ten (10) LFERKs assembled and stored in protective individual storage bags as specified by the JPACE/LJPACE PD JPMP-PD-JPACE-01C
3. Forty-five (45) coveralls of JPACE for awardee of Lot 0001 and/or forty-five (45) coveralls of LJPACE for awardee of Lot 0002 in protective storage bags (unit pack barrier bag and overbag) shall be submitted for first article. Six (6) samples of the 45 coveralls submitted will be pulled for physical testing, chemical testing, FR testing, and laundering. The following sizes and quantities are required:

The FAT samples are required to be delivered 120 days after date of award. The FAT samples shall be submitted to the following address:

PLT: Surveillance verification testing will be done on every production lot of the JPACE and LJPACE coverall. After acceptance of the production lot, ten (10) coveralls will be randomly selected by the DCMA QAR and shall be sent by the contractor to the following address:

London, Ohio 43140 Government acceptance/approval of PLT via a notification letter shall not exceed 35 calendar days from the date test items are received at the test facility.
First delivery of JPACE to Peckham, Inc. is required 420 days after date of award.
First Delivery of LJPACE, OFERK, and LFERK to Peckham, Inc. is required 360 days after date of award.
The Government does NOT intend to use FAR Part 12. See reference numbered notes 1, 9, and 26.
