About this file

This is Addendum No. 2 to a state contract issued by the Rhode Island Department of Administration, Division of Purchases, for the Rhode Island Department of Transportation's Statewide Stormwater Improvements PROTECT Grant project. The addendum addresses vendor questions and answers regarding project scope clarifications and extends key deadlines. The project involves constructing 89 stormwater treatment units across 10 watersheds in 5 cities (Cranston, East Providence, Pawtucket, Providence, and Woonsocket) and 11 towns throughout Rhode Island. Work includes installation of erosion controls, handling and management of contaminated soil, storm drainage, utility adjustments, traffic control, signage, mobilization, and field office support. The original questions deadline of September 16, 2026 has been extended to September 30, 2026 at 12:00 PM EDT, and the bid opening date has been extended from September 25, 2026 to October 9, 2026 at 1:00 PM EDT. The extension was granted to allow bidders adequate time to conduct site visits and review the numerous individual project locations with differing existing conditions and constraints.

Key clarifications provided in this addendum address environmental protections, soil characterization and disposal requirements, pavement replacement specifications, and unit of measure corrections. The Migratory Bird Treaty Act and bat protection provisions restrict clearing, grubbing, and tree removal activities to specified seasonal windows, with clarification that such tree removal does not trigger the start of the STU Construction Duration; construction duration commences only when soil-disturbing activities begin. Contractors must perform soil testing in accordance with receiving facility requirements for off-site disposal, though existing state pre-characterization data may be acceptable if the disposal facility approves. Item No. 9 for Load, Haul and Disposal of Contaminated Soil, Type 5 has been revised from a unit of measurement of TON to EACH, reflecting a more appropriate pricing structure. Pavement replacement specifications require either 6 inches of Class 19.0 HMA to match existing asphalt base or 3 inches of Class 9.5 HMA for miscellaneous work, depending on location requirements outlined in the contract documents.

NOTICE TO PROSPECTIVE BIDDERS

ADDENDUM NO. 2 Prospective bidders and all concerned are hereby notified of the following changes in the Plans, Specifications, Proposal and Distribution of Quantities for this contract. These changes shall be incorporated in the Plans, Specifications, Proposal and Distribution of Quantities, and shall become an integral part of the Contract Documents.

A. Vendor Questions & Answers

Question 5. Protection Under the Migratory Bird Treaty Act requires Clearing & Grubbing, Tree Removal, and Land Disturbing Activities to take place during the non-breeding season (September 1 through February 28). If the Contractor performs tree cutting and removal during this allowable period at sites requiring clearing, but does not perform any soil-disturbing activities (including stumping), please confirm that the STU Construction Duration will not commence with the tree removal activities and will begin only when soil-disturbing activities commence..

Answer:

Tree cutting and removal does not start the STU Construction duration. The STU Construction Duration starts when the Contractor commences soil disturbing activities including clearing and grubbing and stump removal.

Question 6. Northern Long-eared bat and Tricolored bat Protection - Tree removal shall be completed between November 1 and April 14th. If the Contractor performs tree cutting and removal during this allowable period at sites requiring clearing, but does not perform any soil-disturbing activities (including stumping), please confirm that the STU Construction Duration will not commence with the tree removal activities and will begin only when soil-disturbing activities commence.

Answer:

Tree cutting and removal does not start the STU Construction duration. The STU Construction Duration starts when the Contractor commences soil disturbing activities including clearing and grubbing and stump removal.

Question 7. CS Section 42 states that the Project Team performed soil pre-characterization sampling at each STU, but that additional sampling will be required to facilitate off-site disposal. Please confirm whether all excess soils generated from the STU sites and requiring off-site disposal must undergo additional Contractor-performed characterization testing, including soils from STU locations where the State’s pre-characterization sampling did not identify exceedances of RIDEM criteria.

Answer:

The Contractor shall perform testing on soil to be disposed of off-site in accordance with the receiving facilities requirements.

Question 8. Item Code 202.0951 – Load, Haul and Disposal of Contaminated Soil, Type 5 is listed with a Fixed Bid Price of $1.00 and a unit of measurement of TON. Please confirm whether the intended unit of measurement should be EACH rather than TON. If the intended unit is TON, the fixed bid price of $1.00 per ton would not cover the anticipated cost associated with Type 5 soil disposal.

Answer:

Unit of measure will be revised to EACH.

Question 9. The Contract requires additional soil characterization for off-site disposal. If the Contractor performs test pits & soil sampling at an STU in advance of construction for the purpose of pre-characterizing the soils for the applicable disposal type, will this activity be considered soil disturbance that triggers the start of the Construction Duration for that STU?

If the Contractor has to wait until construction commences at an STU to perform the required soil characterization, the time required for soil sampling, lab testing, prep/submission of the characterization documents & RIRRC review/acceptance could significantly impact the Construction Durations established in the JS pages, including the removal of soil stockpiles within the specified durations.

Please confirm that advance test pits and soil sampling performed solely for soil characterization may be completed prior to the start of the applicable STU Construction Duration without triggering the Construction Duration clock..

Answer:

Test pits are considered soil disturbance. The Construction Duration will start upon soil disturbance.

Please review the short term remedial action work plans included as part of Addendum No. 1.

Additional soil characterization will be required for soil to be disposed of off-site.

The Contractor can perform the work and stockpile excess soil on-site within the Construction Duration. The Contractor can sample and test the excess soil. Following the results of the testing, the Contractor will remove and dispose of the excess soil legally. After removing the excess soil, the Contractor will restore the stockpile area as part of the punchlist.

Question 10. Bid items shown on Drainage and Utility Plan 1 & 2 call for Contractors to Demo Flexible Pavement (DFP), there is no note requiring any replacement of this pavement, i.e. FDP or FDP-T. Please clarify what will be required after pavement is removed and curbing is installed.

ADDENDUM NO. 2 Page 3 of 4

In Volume 1, Drainage & Utility Plan Nos 1 & 2, the pavement structure to be replaced in indicated with callout 7.6.0M. 7.6.0M, Curb Setting Detail Modified, is on Sheet 51, Details No. 5. The pavement structure is concrete base (curb lock) and 1.5" Class 9.5 HMA for Miscellaneous Work. The Contractor shall use this pavement structure within the sawcut area around Structure # 001-1, Structure 650-2, and Structure 650-3.

Question 11. Please provide more information on Note FDP. On the note sheet, it states "3" class 9.5 HMA for miscellaneous work (placed in 2-1.5" lifts) and 6 " min. class 19.0 HMA for miscellaneous work (match existing). Is the intent to have 9" total of asphalt pavement at the locations on the drawing noted FDP or is this location dependent? If so, please identify areas requiring 3" vs 6" of FDP.

Answer:

For areas requiring FDP, the Contractor shall place a minimum of 6" of Class 19.0 HMA for Miscellaneous Work. If the existing asphalt base is greater than 6", the Contractor shall place Class 19.0 HMA for Miscellaneous Work to match the height of the existing asphalt base. The Contractor shall place 3" Class 9.5 HMA for Miscellaneous Work for areas requiring FDP.

Question 12. In Response to Q&A #7 below - RIDOT’s previous response states that the Contractor shall perform testing on soil to be disposed of off-site in accordance with the receiving facility’s requirements. Please clarify whether this requires the Contractor to collect & analyze new soil samples in all cases.

If the Contractor’s proposed receiving facility reviews the State/EOR pre-characterization analytical data included in the Contract Documents & confirms that the existing data is sufficient for acceptance of soil from STU's identified as non-jurisdictional, with no additional sampling required by that facility, will RIDOT/RIDEM allow the Contractor to dispose of that soil based upon the existing project analytical data without performing additional Contractor sampling?

If additional Contractor sampling is still required under that circumstance, please identify the required sampling frequency, analytical parameters, and the specification or RIDEM requirement establishing that requirement..

Licensed disposal and/or beneficial reuse landfill facilities require data to meet the analytical requirements they set (e.g., RIRRC’s Acceptance Limits for Alternative Cover Material), and fulfill other sampling requirements (frequency, volume, age of data, etc.) set by each facility.

If the contractor intends to dispose of material at a licensed facility, said material should be sampled in accordance with the intended receiving facilities requirements, for which some may accept data greater than 1-year old (at their discretion). Note that RIRRC typically requires data which is less than 1-year old for acceptance of Alternative Daily Cover.

Sampling requirements are further described in the ‘Excess Soil for Reuse or Disposal’ section of the Short-Term Response Action (STRA) Work Plan.

Clean soil (i.e., non-jurisdictional soil) intended for off-Site reuse should be sampled in accordance with the ‘Clean Fill Certification and Off-Site Reuse of Non-Jurisdictional Soil’ section in the STRA Work Plan.

All sampling shall be conducted in accordance with the STRA Work Plan as well as the STRA Approval Letter issued by RIDEM.

Question 13. RIDOT is clarifying the answer to Question #1.

In response to Question No. 1, it was noted that "Items in OSP are correct and will not be changed." and "Item No. 9 has a fixed bid price of $1/ton".

In response to Question No. 8, it was noted that "The unit of measure will be revised to

EACH".

To clarify the response to Question No. 1, OSP Item No. 9 will be changed. The unit of measure will be revised to EACH.

Question 14. Request for Bid Date Extension - Due to the significant number of individual project locations included under Contract 2026-CU-032 and the locations throughout the State, would RIDOT consider extending the bid date 2 weeks? The contract includes numerous separate STU locations, each with differing existing conditions, access constraints, traffic conditions, staging considerations, utilities, and proposed scopes of work. In order for bidders to adequately review the project sites and properly evaluate the conditions that may affect the work and associated pricing, a substantial amount of time is required to perform meaningful site visits in addition to completing the detailed review and pricing of the contract documents.

An extension of the bid date would provide bidders adequate opportunity to perform the necessary site reviews and develop more complete and competitive bids based upon the actual conditions at the various project locations.

RIDOT will extend the bid period and revise the appropriate dates in Addendum 2.
