About this file

This is a Procurement Division specifications and bid documents package from the City of Orem for a Phosphorus Control System (PCS) to be installed at the Orem Water Reclamation Facility. The project involves the design, manufacture, and delivery of a complete phosphorus control system capable of precipitating ortho-phosphate to form particulate struvite from digested sludge for incorporation into dewatered biosolids. Electronic proposals must be submitted via the State of Utah's BonFire procurement portal by 4:00 p.m. on October 15, 2026. Questions regarding the contract documents must be submitted online by October 1, 2026. The equipment must be delivered to the facility at 1797 West 1000 South, Orem, Utah 84058 within six months after approval of final submittals, with shop drawings required within sixty days of the Notice of Award. The contract will be assigned to a General Construction Contractor anticipated in the fourth quarter of 2026, at which point the successful bidder will function as a subcontractor. Liquidated damages are assessed at $1,000 per day for delivery delays beyond the specified timeframe.

Bidders must submit a lump sum cost for one complete PCS system along with guaranteed performance values, and the bid price includes shop drawing preparation, manufacture, packaging, testing, freight, inspection, field support, start-up and testing assistance, and operation and maintenance manual preparation. The evaluation will be based on proposed equipment quality, materials of construction, equipment performance, life cycle costs, manufacturer experience, and equipment references. Progress payments consist of twenty percent upon shop drawing approval and assignment, sixty percent upon delivery in acceptable condition, and the remainder upon incorporation into the project, testing, and completion of special services. The project is funded through an EPA grant, making all parties subject to Build America, Buy America Act compliance requirements and EPA 40 CFR Part 33 regulations, including non-discrimination and Byrd Anti-Lobbying Amendment requirements for bids exceeding $100,000. The bidder warrants all goods and services for one year after final completion and bears the risk of loss until delivery and acceptance by the General Construction Contractor.
