C-001 - Statement of Work

STATEMENT OF WORK

ENGAGEMENT OF FOREIGN MARITIME AUTHORITIES TO SUPPORT THE IMPLEMENTATION OF UN

SECURITY COUNCIL RESOLUTIONS ON

THE DEMOCRATIC PEOPLE’S REPUBLIC OF KOREA

C.1. BACKGROUND

There are several U.S. sanctions authorities and other restrictions related to the DPRK, including the North Korea Sanctions and Policy Enhancement Act of 2016; the Iran, North Korea, and Syria Nonproliferation Act; the Countering America’s Adversaries Through Sanctions Act; and others. In addition, it is the subject of a range of different United Nations Security Council resolutions (UNSCRs) including UNSCRs 1718, 1874, 2087, 2094, 2270, 2321, 2356, 2371, 2375, and 2397. UN Member States are obligated to implement legally binding measures outlined in these UNSCRs.

The State Department works with partner governments on implementation of these sanctions-related measures. Other United States government agencies have complementary efforts. For example, the Department of the Treasury supports the Pressure campaign by designating entities involved in sanctionable activity. The Department of Justice takes action against those individuals and entities that it alleges have violated certain criminal provisions related to sanctions. The Department of Defense patrols key ship-to-ship transfer zones with U.S. partners to monitor for sanctions evasion activities.

C.2. GOALS AND OBJECTIVES

The objective of the Government is to establish a streamlined acquisition method that would enable the engagement of TBD foreign maritime stakeholders on their responsibility to comply with the relevant UN Security Council Resolutions. To fulfill this objective, the Government’s goal is to put in place an Indefinite Delivery/Indefinite Quantity (IDIQ) type contract against which Task Orders may be placed as the need arises to fulfill emerging requirements as the need arises.

C.3. SCOPE

Pursuant to the terms of the IDIQ, the Contractor will provide a broad array of services to support and assist the government in achieving the goals and fulfilling its needs in engaging with maritime stakeholders in countries selected by the Government.

C.3.1. Task 1: Open-Source Research relating to DPRK Maritime Activity

At the direction of the Government, the Contractor shall conduct open-source research relating to DPRK activity that implicates the foreign maritime sector. This research shall focus on global maritime stakeholders, including, but not limited to, customs authorities, port operators, flag registries, maritime insurers, commodity brokers, providers of bunkering services, financial sector entities that underwrite or fund maritime commerce, and others on sanctions risks associated with DPRK-related shipping. This includes commercial shipping activity that may support DPRK efforts to acquire or export WMD, their delivery systems, and related items, and conventional arms-related items, as well as the DPRK’s efforts to acquire commodities like refined petroleum and export DRPK-origin coal through sanctionable transactions, such as those outlined in the recent sanctions advisories by the U.S. Department of State, the U.S. Department of the Treasury’s Office of Foreign Assets Control, and the U.S. Coast Guard. The Government is particularly interested in DPRK activity in China. The Contractor shall deliver the results of its research to the COR and COR-designated representatives of the Government via e-mail. All research/analysis conducted under this IDIQ Contract shall be used by the Government and Contractor to support the engagement of targeted maritime stakeholders under Task 2.

C.3.2. Task 2: Trainings/Engagements of Maritime Stakeholders

At the direction of the Department of State, the Contractor shall engage global maritime stakeholders, including, but not limited to, customs authorities, port operators, flag registries, maritime insurers, commodity brokers, providers of bunkering services, financial sector entities that underwrite or fund maritime commerce, and others on sanctions risks associated with DPRK-related shipping.

In doing so, the Contractor shall be responsible for all logistical organization and costs involved in the engagements that are not explicitly exempted by the Government in writing in advance. This includes, but is not limited to, identification and procurement of a venue, travel, lodging, and per diem of course participants, and translation costs.

In addition to conducting engagements with maritime stakeholders, other tasks that may be included under this IDIQ may include:

- Conducting open source research on the ownership, management, and business links of entities that may be linked to DPRK entities or support DPRK sanctions evasion, wittingly or unwittingly with the purpose of supporting engagement of maritime stakeholders.

- Developing trainings and related material, table-top exercises, modules, speeches and other material for specific trainings and conferences.

- Developing engagements for different parts of the maritime sector such as financial entities that underwrite maritime commerce, the oil and gas sector, crewing companies, insurers and brokers, designated non-financial persons and business that might be involved in DPRK-linked money laundering.

- Organizing and participating in multilateral engagements on shipping, transportation, and customs issues, such as the World Customs Organization.

- Providing advisory services to the government.
