About this file

This Single Source Justification document from the Department of State's Office of the Procurement Executive details a procurement for Mercury Marine boat parts for the US Embassy in Panama. The requirement is to acquire 58 distinct boat parts totaling 199 units, valued at USD$100,000, to support the installation of five Mercury engines previously donated in 2023 for interceptor boats used by the Bureau of International Narcotics and Law Enforcement's Joint Maritime Force (JMF). The procurement is a Firm-Fixed-Price (FFP) contract with limited competition, justified by the need for brand-name parts to ensure compatibility, functionality, and proper integration of maritime patrol vessels critical for identifying and investigating transnational criminal networks.

The document specifies parts across five categories: Steering and Control (17 parts), Electrical and Wiring (24 parts), Propulsion and Drive (10 parts), Hydraulic & High-Pressure Systems (4 parts), and Communication & Boat Systems (4 parts). Market research identified four authorized vendors authorized to supply genuine Mercury parts: West Marine Products, Ocean West Marine & Industrial Supply, Brunswick Corp, and Central Florida Yamaha. The procurement action will be posted on SAM.gov and the Embassy website for 15 days to solicit offers, with the justification for limiting competition to Mercury Marine included as required by federal acquisition regulations.

SINGLE SOURCE JUSTIFICATION NOT EXCEEDING THE SIMPLIFIED ACQUISTION

THRESHOLD

SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Department of State Contracting Activity

Office of Acquisitions Management Foreign Service Institute Office of Foreign Missions U.S. Mission to the United Nations

Overseas Post US Embassy Panama Requiring Activity Bureau of International Narcotics and Law Enforcement (INL)

SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

Approval is requested to limit the number of sources for soliciting and awarding Purchase Order under a Federal Supply Schedule contract for the supplies and/or services described in Section 3 on behalf of the Requiring Activity.

This is a new award for a Firm-Fixed-Price (FFP) contract to request limited competition to companies able to provide boat parts manufactured by the brand name Mercury Marine.

SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

The requirement is to provide boat parts to install five (5) Mercury engines onto Interceptor boats at the US Embassy Panama. The estimated value for the entire contract is USD$100,000.

The supplies required from the brand-name manufacturer, Mercury Marine, consist of a total of fifty-eight (58) distinct boat parts to support the installation and proper functioning of the Mercury engines donated in 2023.

These parts are intended for use on interceptor boats, including components for steering and control, electrical and wiring, propulsion and drive, hydraulic and high-pressure systems, as well as communication and boat systems

This will allow the office of Bureau of International Narcotics and Law Enforcement Affairs’ Maritime Security Program—specifically its Joint Maritime Force (JMF) to accomplish enhanced maritime operational readiness through missions focused on maritime law enforcement, search and rescue operations, and border security

Category # of Distinct Parts Total Quantity (All Units) Steering and Control 17 36 Electrical and Wiring 24 76 Propulsion and Drive 10 29 Hydraulic & High-Pressure Systems 4 6 Communication & Boat Systems 4 8 TOTAL # 59 parts 199 units

Donated in 2023 under Purchase Order 19PM0721P0480, the Mercury engines—totaling USD $116,319— require installation on interceptor vessels in order to be placed into operational use. These specific parts are essential to ensure full compatibility, functionality, and proper integration into maritime patrol vessels, enabling their effective deployment.

The JMF’s interceptor boats are critical for identifying, investigating, and prosecuting transnational criminal networks, thereby strengthening the capacities of both the Government of Panama and the United States.

SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:

Urgency Exclusive licensing agreements Brand-name Industrial mobilization Other

SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY

CITED

It is in the best interest of the U.S. Government to procure from the original equipment manufacturer (OEM) to ensure compatibility with existing purchases. As Mercury 300HP engines are already in existing inventory, the requested parts are required for their installation and must maintain form, fit, and function to ensure proper integration and performance. Procuring these parts from the authorized Mercury Marine dealer guarantees authenticity and proper integration, minimizing the risk of malfunction and ensuring operational effectiveness.

If procured from another company, the parts may not meet the exact specifications required for form, fit, and function, potentially causing compatibility issues with the existing engines. This could lead to malfunctions, reduced performance, increased maintenance costs, and safety risks, ultimately compromising the operational readiness of the maritime vessels.

Market research was conducted to determine the availability of authorized brand-name Mercury Marine parts and identified a limited number of vendors authorized to supply genuine Mercury parts, which are necessary to maintain performance, reliability, and warranty compliance.

By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.

This procurement action will be posted on sam.gov and the Embassy website for fifteen (15) days to ensure that offers are solicited from as many potential sources as is practicable. A sam.gov notice will be published as required by FAR 5.202 and the Justification to limit competition to Mercury Marine will be included as required.
