Construction Manager At Risk Agreement Summary

This is a Construction Manager At Risk (CMAR) Agreement document for the South County Drinking Water Facility Project (CIP No. C32012) between the Board of County Commissioners of Hillsborough County, Florida and the selected construction manager at risk (CMAR No. 26-00264). The project involves providing pre-construction services and construction management services to design and construct a new drinking water facility with an estimated project value of $145,000,000. The agreement establishes the framework for the CMAR's involvement during both the design phase and construction phase, with services to commence upon issuance of the Notice to Proceed with Pre-Construction Services. The contract time commences on the date indicated in the Notice to Proceed with Pre-Construction Services, which shall be issued within fourteen days of Hillsborough County Board of County Commissioners approval, provided the CMAR has delivered executed agreements and required insurance certificates. The project schedule, including milestones and detailed construction sequences, is to be submitted by the CMAR within thirty days of the Notice to Proceed with Pre-Construction Services for county review and approval. The agreement references multiple appendices including the RFP, preconstruction services scope of work, project-specific site and performance requirements, guaranteed maximum price proposal to be determined, performance and payment bonds, insurance requirements, and small business enterprise requirements.

The CMAR Fee is established at eight percent of the allowable cost of work during the construction phase and is included within the guaranteed maximum price (GMP), which will be finalized upon completion of design documents by the Architect/Engineer of Record (Jacobs Engineering Group, Inc.) and approved by the county and Board of County Commissioners through a contract modification. The agreement requires the CMAR to provide performance and payment bonds within ten days following GMP approval and insurance certificates meeting specified requirements prior to agreement approval. The CMAR assumes responsibility for all preconstruction services including constructability reviews, value engineering, permit coordination, schedule development, market assessment, and subcontractor coordination. The total maximum markup allowed, including the CMAR Fee and all subcontractor markups of all tiers, shall not exceed fifteen percent. The agreement establishes that the CMAR shall construct the project within the guaranteed maximum price and absorb costs for any work performed above and beyond requirements that cause total project costs to exceed the GMP. Additionally, the CMAR assumes financial risk for foreseeable concealed site conditions and all costs associated with normal weather conditions expected in Hillsborough County, Florida, which must be adequately anticipated in both the GMP and project schedule.
