Contract Section Existing text (cut and paste as appropriate) Recommended text, proposal or question Question Government Response

A-2 DAILY AVAILABILITY

AND DRY-FLIGHT RATE

Section A-2 states that in accordance with B-22, the Government may reimburse the Contractor for hangar rental, while B-2(d) states that the Contractor shall provide a hangar when Government facilities are not available.

The Government statements in A-2 and B-2(d), while not necessarily in direct conflict with one another, do leave room for interpretation. Can the Government provide the determining factor in deciding whether hangar rentals are the responsibility of the Government or the Contractor?

Contracted aircraft will be located where Government pilots reside throughout the nation. Some of these locations do not have a Government provided hangars. In these cases the contractor must pay for the hangaring of the aircraft in accordance with Section B-2(d).

When the aircraft is on an operational deployment (away from the assigned base) and a hangar is required to mitigate weather risk then the Government will reimburse the contractor for the direct cost of overnight hangar fees in accordance with Section B-22.

A-2 DAILY AVAILABILITY

AND DRY-FLIGHT RATE

Section A-2 states that aircraft storage costs (assumed to mean hangar rentals) should be included as part of the Hourly Dry- Flite Rate.

Hangar rentals are generally a fixed cost. Would it not be more appropriate to include aircraft storage costs in the Daily Availability Rate?

The following changes will be made to Section A-2: Daily Availability Rate: This rate shall cover the aircraft identified in the schedule of items and shall include the fully burdened cost for aircraft lease and maintenance support services provided under the contract (Support Staff, Wages, Employee Benefits, Job Aids, PPE, insurance, as well as aircraft storage costs associated with the aircraft when Government space is not available).

Hourly Dry-Flight Rate: A rate that covers scheduled maintenance costs, data plans and ancillary equipment)

B-1 BACKGROUND AND

SCOPE OF CONTRACT

"The Government plans to award one Firm Fixed Price contract."

"The intent is to award a single Firm-Fixed-Price (FFP) contract for 15 multi-engine turbine aircraft with 5 optional aircraft (not to exceed 20 items) to be rented on a dry lease basis, with contractor provided maintenance and insurance, available for the exclusive use by Government or Government Contract pilots supporting wildland fire missions and other administrative activities."

(1) Is there any possibility that the Government will make multiple contract awards?

(2) Will the Government accept a proposal from a Contractor for fewer than 15 multi-engine turbine aircraft?

(1) Is there any possibility that the Government will make multiple contract awards?

(2) Will the Government accept a proposal from a Contractor for fewer than 15 multi-engine turbine aircraft?

Based on approval from USDA the scope of work was created to ensure aircraft design (make/model/series), aircraft equipment configuration, aircraft maintenance scheduling, points of contact between the contractor and Government, and aircraft performance standards were met. Based on our department's approval, results from the RFI, which presented the solicitation scope, potential competition was identified.

Therefore, the scope will remain as 15 base items with 5 optional items.

B-3 AIRCRAFT MISSION

CONFIGURATION AND

FLIGHT PROFILES

Section B-3 states that the aft AITS/ATGS or LPIL Mission Instructor must be able to comfortably reach the unobstructed station avionics. Section B-7(4) identifies an Audio Control System for Instructor. Section B-7(b)(2)(ii)(A) more fully describes the Instructors access to the audio controller.

Can the Government confirm that the station avionics mentioned in B-3 is the Audio Control System for the Instructor mentioned in B-7(a)(4) and B-7(b)(2)(ii)(A) and that the Instructor mentioned in B-7 refers to the aft instructor position?

Yes, added "audio control panel" for clarification. These changes will be implemetned in amendment 1.

B-4 TECHNICAL

REQUIREMENTS AND

AIRCRAFT

SPECIFICATIONS

Section B-4 states that the aircraft shall be maintained in accordance with 14 CFR Part 135. The definition of Dry Lease in Section B-29 states that the lessee is required to put the aircraft on his/her own Aircraft Operator Certificate. E-3 Instructions to Offerors - Commercial Items, Part II Technical Proposal (1) (i) through (iii) asks for the offeror's Part 135 Operating Certificate, Operations Specifications, and Operations Manual.

As part of the technical proposal, Mandatory Documents required to be submitted by an Offeror are to include a copy of the Part 135 Certificate, the Part 135 Op Specs, and the Part 135 Operations Manual. Further, contractors are asked to list the offered aircraft in the Part 135 Operations Specifications.

The FAA mandates that aircraft listed on a Part 135 Operating Certificate (listing aircraft in the ops specs) must be in the operational control of the certificate holder. Is there a requirement that the Offeror hold a Part 135 Certificate? If not, will the USFS remove the Part 135 documents requirement from E-3? If yes, will the USFS remove the requirement that the Offeror list the proposed aircraft in the Offeror's Part 135 Op Specs?

Is there a requirement that the Offeror hold a Part 135 Certificate?; If not, will the USFS remove the Part 135 documents requirement from E-3? If yes, will the USFS remove the requirement that the Offeror list the proposed aircraft in the Offeror's Part 135 Op Specs?

Part 135 certificate is no longer required and will be removed in amendment 1. With that said, Section B-4 remains unchanged:

"maintenance in accordance with the requirements of 14 CFR Part 135 remain "notwithstanding the aviation regulations of the States in which the aircraft may operator expect those requirements specifically waived by the CO." Company Operations plan addressing how the company operates to maintain standards of a 135 operating standard.

B-7 AVIONICS One ADS-B Out System approved for use in Class A airspace. Can the USFS provide the specifications for the ADS-B Out system that is required in Section B-7(a)(19)?

See 14 CFR 91.225 and 14 CFR 91.227. Aircraft systems that possess ADSB surveillance systems and equipped to comply with this reference meet contract requirements and specifications. ADSB out needs to be dual band 1090-ES and UAT.

B-8 AIRCRAFT

MAINTENANCE

Section B-8(j) states that phase inspections be conducted by FAA approved repair stations with a rating for the specific aircraft offered and have technicians who perform scheduled inspections with factory training for the offered aircraft.

If the OEM does not offer factory maintenance training;

however, third parties such as Flight Safety and CAE do offer this type of training. Will the USFS consider third-party maintenance training as a compliant substitute for OEM factory training?

The USFS will accept 3rd party training if it is accepted/approved by the OEM and or the FAA. Please refer to Section B-8. Training syllabus shall be submitted in accordance with Section E-3.

B-8 AIRCRAFT

MAINTENANCE

All phase inspections (inspection interval shall not exceed 200 flight hours) must be conducted by FAA approved repair stations with a rating for the specific aircraft offered and have technicians who perform scheduled inspections with factory training for the offered aircraft.

If third party maintenance training is allowable, can the USFS provide specific requirements as to what type of training is required and how much (many hours) is needed to satisfy this requirement?

The Government realizes OEM/FAA approved training syllabi and will accept that. The USDA, FS relies on the OEM/FAA to create maintenance standards. Our agency adopts these as our minimum standard.

How does this ASM-Leadplane solicitation relate to the NLFW MATOC opportunity that is currently in Source Selection? That solicitation also sought ASM platforms. Does this solicitation formally or informally "replace" the MATOC requirements for ASM-leadplane platforms, or are these aircraft "in addition to" those on that RFP?

The ASM_Leadplane solicitation and the NLFW MATOC may appear to have similar performance requirements and similar mission equipment. However, this solicitation is for the dry lease of aircraft that will be staffed with Government pilot/mission crewmembers.

The NLFW MATOC is soliciting the full spectrum of aircraft services to include pilots, maintenance and ancillary support. This solicitation does not "replace" the MATOC requirement nor is this "in addition to" those on the MATOC RFP.

May a vendor who has already proposed ASM-Leadplane platforms for the Forest Service's NLFW MATOC (currently in Source Selection) propose the same aircraft for this solicitation since both solicitations seem to have overlapping requirements?

These requirements are not associated with each other. This solicitation is for the dry lease of aircraft that will be staffed with Government pilot/mission crew 365 days per year. The NLFW MATOC is soliciting the full spectrum of aircraft services to include pilots, maintenance and ancillary support. Therefore, a vendor may not propose the same aircraft for this solicitation as these are two seperate solicitations, which will result in two seperate contracts.

C-11 FAR 52.211-8 Time of Delivery: Section C-11 requires that all aircraft be fully configured to all technical specifications and ready for inspection by the USFS 30 days prior to the Period of performance start date of 1/1/2024, or 12/2/2023. It further states that offerors who propose a delivery schedule that will not meet the above requirement will be considered nonresponsive and rejected. The proposed aircraft are currently on contract with the USFS. To satisfy the "Time of Delivery" requirement of C-11, will the USFS allow delivery of partially configured aircraft as of the delivery deadline along with a staggered modification of the aircraft after the period of performance start date?

All proposals will be evaluated in accordance with Section E-4. Instructions to Offerors are provided in Section E-3. Not having aircraft equipped to meet the full requirements of the contract presents a risk. Offerors must provide the Government a clear understanding of how that risk will be mitigated (time to achieve the requirements, operational impacts, understanding of why the aircraft may not conform to the requirements and the solution being offered to comply.)

E-3 Technical Proposal, (4) Past Performance: The RFP states to "Submit one company file present as Attachment 5_ Past Performance. Offeror's Past Performance." Does the USFS only require ONE reference? If more than one reference is required, can the USFS please state how many? If more than ONE reference is required, the assumption is that there will more than one Attachment 5. And if there is more than ONE Attachment 5, does the USFS still only want ONE Company file, as requested in the requirements for Past Performance in Section E, Technical Proposal.

In accordance with Section E-3 the Government requests that all relevant attachment 5 forms are rolled into one sequential file. The file shall be named/saved as Vendor Name_PP within the technical proposal folder as a separate file. It is expected that the amount of past performance questionnaires will vary from contractor to contractor based on contracted experience held with other Federal or State Government agencies.

E-3 Technical Proposal, (4) Past Performance and Attachment 5: The RFP states to "Submit one company file present as Attachment 5_ Past Performance. Offeror's Past Performance."

The instructions at the top of Attachment 5 state "Please complete this questionnaire and email to:

amelia.velasco@usda.gov." Can the USFS clarify if the intent is for the Offeror to have their "client" complete the Past Performance Questionnaire - Attachment 5 and submit it back to the Offeror, or does the USFS intend to send Attachment 5 to the Offeror's client themselves?

Yes, the previous client(s) should fill out the form as requested and submit to the CO:

amelia.velasco@usda.gov. However, a change that is being applied through amendment 1 is to also include your client's questionnaire into the file named/saved as Vendor Name_PP.

A-6 PERIOD OF PERFORMANCE (POP)

It is anticipated that the contract, resulting from this solicitation, will be in effect on January 1, 2024, for one base year and four optional years, not to exceed five (5) years.

USDA Forest Service Washington Office

B-1 BACKGROUND AND SCOPE OF CONTRACT

The United States Forest Service (FS) is responsible for protecting National Forest lands from wildland fires and, by agreement with cooperating agencies, assists in protecting other jurisdictions.

The government has interagency and cooperative agreements with federal and state agencies and private landholders. Aircraft under contract may be dispatched under these agreements for such use.

This solicitation and resultant commercial, Firm Fixed Price (FFP) contract will be awarded for manufacturer built, dual-engine, turbine-powered aircraft. The contractor shall make the aircraft available for the year-round (365 days per year), exclusive use by federal government or government contracted pilots. Other types of work to a lesser degree will be resource management, passenger and cargo transportation, law enforcement, pilot training, pilot proficiency, and administrative activities.

The intent is to award a single Firm-Fixed-Price (FFP) contract for 15 multi-engine turbine aircraft with 5 optional aircraft (not to exceed 20 items) to be rented on a dry lease basis, with contractor provided maintenance and insurance, available for the exclusive use by Government or Government Contract pilots supporting wildland fire missions and other administrative activities. It is required the aircraft are available for the exclusive use by the Government or Government contracted pilots supporting wildland fire missions and other administrative activities. The daily rate is to accommodate payment flexibility for inconsistent days in a month or in a year. When an optional line item is activated, that item will be required for the duration of the contract to include optional periods.

The Government plans to award one Firm Fixed Price contract. The fixed-price rates will cover Daily Availability (365 Days per year) and Dry Flight Rate (Hourly). The number of flight hours is dependent upon the amount of wildland fire and other related activities each year. Estimating the total overall contract quantity of flight hours is difficult to predict. Many variables determine the severity and the length of fire seasons, including weather and local or regional long-term climate trends.

Historically, each aircraft has been flown for three to four hundred (300-400) flight hours annually.

Estimated/Historical flight hours ARE NOT A REPRESENTATION OR A GUARANTEE to an offeror or contractor that the flight hours will occur, or those conditions affecting requirements will be stable or normal. The Government requires that all aircraft are of the same make/model for this acquisition. The Government may consider alternate proposals for a mix of aircraft that are of the same make and different models.

All aircraft under the resultant contract shall be ready for delivery in accordance with the dates specified in C-10 to the US Forest Service. Delivery will occur at the Contractor's base of operations or other mutually agreed upon location.

The government plans to adopt emerging technology to meet current and future mission needs.

When technologies are identified by the vendor and approved by the CO these requirements and specifications will be added to one or more CLIN(s).

USDA Forest Service Washington Office
