About this file
This is an Iran Free Procurement Certification Form issued by the Pennsylvania Department of General Services (DGS) in compliance with Pennsylvania's Procurement Code Sections 3501-3506. The form applies to vendors seeking contract awards with Commonwealth entities for goods or services valued at $1,000,000 or more. Vendors must complete one of two options: either certify they are not on the current DGS list of persons engaged in investment activities in Iran and are eligible to contract with the Commonwealth, or demonstrate they have received a written exemption from the certification requirement on a case-by-case basis. The form requires authorization by a duly authorized official representing the vendor or financial institution, including signature, printed name, title, and date of execution.
Pennsylvania law establishes significant penalties for false certifications, including civil penalties equal to the greater of $250,000 or twice the contract amount, contract termination, and three-year ineligibility to bid on future contracts. The certification requirement applies to the Johnstown OVR Enhanced Driving and Ancillary Services procurement, a supplement solicitation for non-emergency transport services in Cambria County only. This procurement is reserved for DGS Small Businesses, and bidders must attach their Small Business Certificate to be deemed eligible. Vendors must complete and submit the appropriate certification option with their bid submission to comply with Commonwealth procurement requirements.
