About this file
This is a GRAMA Business Confidentiality Claim form from the Utah State Archives for use by vendors responding to state and local contract opportunities in Utah. The form is designed to allow companies submitting proposals to the State of Utah Division of Purchasing to claim confidential treatment for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors responding to the BB27-1 Trauma Focused Cognitive Behavioral Treatment Training Services procurement must complete this form if they wish to protect sensitive business information from public disclosure. The form requires claimants to provide company information, identify specific pages and paragraphs containing confidential material, and submit a concise written statement explaining the basis for the confidentiality claim. Critically, vendors must submit both a redacted and non-redacted version of their proposal; the state will not perform redactions on behalf of claimants who fail to provide a properly redacted copy.
Making a confidentiality claim does not guarantee that information will receive protected classification if the government receives a public records request, as final determinations rest with the governmental entity receiving the claim. The form applies specifically to proposals submitted to the State of Utah Division of Purchasing for the Department of Health and Human Services procurement seeking a trainer certified in Trauma Focused-Cognitive Behavioral Treatment to serve providers under a five-year contract. No pricing information should be included in qualifications submissions for this RFSQ, and the state reserves the right to negotiate with the highest-ranked vendor or proceed to the next-ranked vendor if fair and reasonable compensation cannot be agreed upon.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
