About this file
This file is a GRAMA Business Confidentiality Claim form from the Utah State Archives, Office of the Government Records Ombudsman, designed for use by vendors and contractors submitting proposals to the State of Utah Division of Purchasing in connection with the MK26-33 Clinical Quality Improvement Technical Assistance Provider contract opportunity with the Department of Health and Human Services. The contract seeks a Clinical Quality Improvement Technical Assistance Provider to support the Million Hearts Coalition's cardiovascular disease reduction initiative in Utah by attending coalition meetings, co-chairing the clinical sub-group as a quality improvement expert, and providing technical assistance to clinics in hypertension, diabetes, and tobacco cessation management. The contract term is five years, and the procurement is conducted under Utah Procurement Code 63G-6a Part 15 for Design Professional Service Providers and Consultants, with the highest-ranked vendor selected for contract negotiations at fair and reasonable compensation.
The form requires claimants to submit both redacted and non-redacted versions of their proposals, with the entire proposal prohibited from redaction. Claimants must provide a concise statement of reasons supporting confidentiality claims for trade secrets under Utah Code 63G-2-305(1) or commercial financial information under Utah Code 63G-2-305(2), demonstrating how disclosure could result in unfair competitive injury. The form requires detailed claimant information including company name, address, representative contact details, and specific identification of pages and paragraphs subject to the confidentiality claim. Notably, submission of a confidentiality claim does not guarantee protected classification if the government receives a records request. Vendors are explicitly instructed not to include pricing in their statements of qualifications.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
