About this opportunity

The State of West Virginia is soliciting proposals for X-ray machines, with proposals due September 11, 2026. The source materials include a Terms and Conditions document, an Award Summary Form indicating a final award has been made, a vendor quote from Viken dated August 16, 2026, and federal funding allocation documents, suggesting this procurement may already be in or past the award phase; however, the current solicitation status and whether this is an active open competition or a post-award notice remain unclear from the provided materials.

Vendors must complete and notarize a Purchasing Affidavit affirming they are not in default on monetary obligations to the state or its political subdivisions (payroll taxes, property taxes, sales and use taxes, fire service fees) and that vendors and related parties do not owe aggregate debts exceeding one thousand dollars. Related parties include entities connected through ownership or contract arrangements where the party receives or controls five percent or more of contract benefits or profits. Exceptions apply to contested taxes or fees pending resolution and to vendors in compliance with approved payment plans or repayment agreements. Employers must maintain workers' compensation coverage or comply with approved repayment agreements with the Insurance Commissioner.

All contracts are governed by West Virginia law with disputes resolved through the West Virginia Legislative Claims Commission or state courts. The state retains complete ownership of all data provided to or collected by the vendor and prohibits vendor use of data for artificial intelligence, machine learning, or any purpose beyond service delivery. Payment is contingent upon receipt of goods and invoice processing; no advance payments are permitted except for software and software support services authorized by the State Auditor. The state retains the right to terminate for convenience with thirty days' written notice. Funding is contingent upon legislative appropriation, with non-appropriation not constituting an event of default. Contract renewals, modifications, and assignments require written change orders signed by both parties and approved by the West Virginia Attorney General.
