Award will be made to the lowest-priced responsive and responsible bidder, and all unit prices must be inclusive of overhead, profit, California sales tax at 9.75%, tariffs, customs duties, import fees, insurance, freight, and all other performance-related expenses.
No specific Small Business Enterprise or Disabled Veteran Business Enterprise subcontracting goals were established for this procurement; however, contractors are expected to provide maximum opportunities to certified SBE/DVBE firms when subcontracting opportunities arise. Bidders must submit completed SBE/DVBE affirmation forms, ethics declarations, general certifications, noncollusion affidavits, certificates of compliance with 49 CFR Part 655 regarding alcohol and drug prevention, business data sheets, SBE/DVBE dealer-distributor affirmations, and lists of current contracts and backlog information demonstrating adequate capacity. All bids must include a bid bond or certified check equal to at least 10 percent of total bid price, and pre-qualification is required for all firms not exempted from the process if their bid exceeds $500,000 for non-construction contracts. The contract is subject to LACMTA Administrative Code, prevailing wage requirements where applicable, federal and state civil rights regulations, and compliance with environmental and safety standards; insurance requirements mandate minimum limits of $1,000,000 per occurrence for general liability and $1,000,000 per accident for automobile liability, with a 10% retention on progress payments reduced to 5% after 50% completion if work is satisfactory. The contract is funded with state and local funds subject to fiscal year funding availability, and no current incumbent or specific budget range was disclosed in the solicitation materials.
