About this opportunity
The Utah Department of Health and Human Services, Division of Services for People with Disabilities (DHHS/DSPD) has issued an RFI on proposed amendments to procurement DHHS91172, with feedback due September 2, 2026 at 5:00 PM Mountain Time.
This is a pre-implementation consultation with currently contracted providers on operational and fiscal impacts of proposed replacement language to Section 1.33(1) of the Scope of Work for Services for DHHS Clients including People with Intellectual/Developmental Disabilities and/or Acquired Brain Injury. The RFI is explicitly not a pre-bid conference, and DHHS/DSPD does not guarantee that comments received will be incorporated into final contract language.
The proposed amendments shift from a requirement to deliver staffing hours as outlined in the DSPD worksheet to a revised standard requiring contractors to ensure persons receive necessary services to maintain safety and meet Personal Care Service Plan (PCSP) goals. Key operational requirements include maintaining daily staff presence during supervision periods, daily tracking and documentation of direct support hours, and delivery of at least 92 percent of authorized monthly hours per DSPD Worksheet Grouping. When monthly delivery falls below 92 percent, contractors must recalculate billable daily rates using a Division-provided rate calculation tool and provide adjusted rates to Support Coordinators prior to billing. Failure to adjust rates exposes contractors to DHHS recoupment of overpaid funds and referral to the Office of Service Review. Continued underdelivery beyond 60 days requires contractors either to initiate permanent PCSP and worksheet adjustments or to notify affected Support Coordinators of inability to meet needs and request service discharge.
Feedback should be submitted via email to dspdcontracts@utah.gov with the subject line "RFI Feedback." DHHS/DSPD may pursue follow-up discussions with respondents to clarify submitted comments.
Opportunity text
The purpose of this proposed amendment is to provide contracted providers with greater operational and service delivery flexibility, while ensuring services remain responsive to individual needs and fiscal accountability standards. DHHS/DSPD is seeking feedback from contracted providers regarding the potential operational impacts, feasibility, and clarity of the proposed replacement language prior to formal implementation.
