About this file

Summary

This is a Request for Information (RFI) issued by the Utah Department of Health and Human Services, Division of Services for People with Disabilities (DHHS/DSPD) regarding proposed amendments to procurement DHHS91172 for Services for DHHS Clients including People with Intellectual/Developmental Disabilities and/or Acquired Brain Injury. The RFI seeks feedback from currently contracted providers on potential operational impacts, feasibility, and clarity of proposed replacement language for Section 1.33(1) of the Scope of Work prior to formal implementation. The comment submission deadline is 5:00 PM Mountain Time on September 2, 2026. Feedback should be submitted via email to dspdcontracts@utah.gov with the subject line "RFI Feedback." The RFI is explicitly not a pre-bid conference, and comments received are not guaranteed to be incorporated into the final contract language. DHHS/DSPD may engage in follow-up discussions with respondents to clarify submitted feedback.

The proposed contract language replaces the existing requirement to "deliver the staffing hours as outlined in the person's DSPD worksheet" with revised provisions requiring contractors to ensure persons receive necessary services to maintain safety and meet Personal Care Service Plan (PCSP) goals. Key requirements include maintaining daily staff presence during times persons require supervision, tracking and documenting direct support hours daily, and maintaining delivery of at least 92 percent of authorized monthly hours per DSPD Worksheet Grouping. If monthly hours fall below 92 percent, contractors must recalculate billable daily rates using a Division-provided rate calculation tool and provide adjusted rates to Support Coordinators prior to billing. Failure to adjust rates may result in DHHS recouping overpaid funds and referral to the Office of Service Review. If underdelivery continues beyond 60 days, contractors must either initiate permanent PCSP and worksheet adjustments or notify affected Support Coordinators of inability to meet needs and request service discharge.
