About this opportunity
The West Virginia State Police is soliciting offers for two Idemia LiveScan machines under Agency Sole Source Determination ASSD 0612 SP15270000011, with offers closing October 19, 2026 at 12:00 noon. This is a sole-source procurement — Idemia is the only vendor eligible to respond.
The scope comprises Idemia LiveScan 65 series equipment with fingerprint and palm capture capabilities, configured as specified in quote IDWV-L032526-02A. Equipment will be delivered to and invoiced to the West Virginia State Police at 4124 Kanawha Turnpike South, Charleston, West Virginia 25309.
The State of West Virginia has issued mandatory contractual terms (WV96 addendum) that supersede vendor-supplied standard forms. Key provisions include: no advanced payments except for authorized software/SaaS licenses and first-year subscriptions with State Auditor approval; payment only upon receipt of goods or services and completion of invoice processing; State right to terminate for convenience with thirty days' written notice or immediately if funding becomes unavailable through legislative appropriation with no penalties or termination fees owed; West Virginia law governance with disputes resolved through West Virginia courts or the Legislative Claims Commission rather than arbitration; State ownership of all data provided to or collected by the vendor, with vendor prohibited from selling, licensing, or using such data for machine learning or artificial intelligence model training; FOB destination delivery; and public records disclosure subject to West Virginia's Freedom of Information Act. All amendments or modifications must be executed as written change orders signed by both parties and approved by the Attorney General, with changes marked using bold, italics, or underline formatting.
Vendors must comply with the West Virginia Purchasing Affidavit, affirming under penalty of law that the vendor and related parties meet specified financial and employment obligations criteria and have no outstanding debts exceeding one thousand dollars in aggregate or default status on monetary obligations to the state or its political subdivisions.
