About this opportunity

The State of Utah Division of Purchasing is processing a non-competitive contract amendment (Contract 226122 Amendment 1) for laboratory operations and analysis services with Rousseau Labs. This procurement represents an extension of an existing agreement rather than a new competitive solicitation, with a due date of January 29, 2026. The amendment extends the original contract term—initially effective September 22, 2021—and increases the total contract funds to support expanded or continued laboratory services. The scope of work encompasses specialized laboratory operations, analysis services, and associated deliverables with defined performance standards and operational requirements. The non-competitive award has been justified under the Utah Procurement Code based on transitional costs being a significant consideration and circumstances that make standard procurement processes impractical and not in the best interest of the state. The State of Utah determined that awarding to the incumbent vendor preserves operational continuity while avoiding the costs and disruptions associated with vendor transition, particularly relevant given the specialized nature of laboratory services and the established performance history with Rousseau Labs. The conducting procurement unit submitted justification documentation demonstrating why competitive procurement was not feasible for this continuation.

All vendors submitting responses must certify compliance with Utah Code 63G-27 et seq., affirming they are not engaged in economic boycotts or boycotts of the State of Israel and agreeing not to engage in such boycotts during the contract term. This amendment does not establish a set-aside for disadvantaged enterprises, as it represents a non-competitive continuation with the incumbent vendor, Rousseau Labs. Vendors may submit business confidentiality claims under the Government Records Access and Management (GRAMA) Act to protect trade secrets and commercial financial information by submitting both redacted and non-redacted versions of documents. The contract maintains the existing infrastructure and established relationship with Rousseau Labs as the incumbent provider, eliminating the need for vendor transition and integration challenges. While specific contract values are contained within the amendment documentation, the increased funds support expanded or continued laboratory services under the terms specified in the original contract and this amendment extension, with funding sourced from the conducting procurement unit's budget allocation.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
