About this opportunity

The Utah Division of Purchasing has published a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for an amendment to contract 266128 with Pinpoint Testing LLC, with a challenge period closing September 22, 2026.

The amendment adds $12,000 in funding for custom analytical Toxbox plates used by the State of Utah's Chemical Threat laboratory for drugs of abuse testing. The proposed contract total increases from $213,050 to $225,050. The Chemical Threat lab is transitioning from drug standards to these specialized analytical plates, forming the basis for the sole-source justification under Utah's Part 8 procurement authority. The Division of Purchasing is conducting market research to determine whether other qualified vendors exist before finalizing the award.

The Conducting Procurement Unit claims the procurement qualifies for non-competitive award under one of three circumstances: only one source exists for the item, transitional costs are a significant consideration, or standard procurement is impractical and not in the procurement unit's best interest. Interested and qualified vendors may challenge the sole-source determination during the published notice period by submitting documentation of alternative sources, comparable or superior products, cost comparisons related to transitional expenses, or equivalent proprietary items. If valid challenges are received, the Division will not award under sole-source justification, though awards based on transitional costs or impracticability may still proceed.

All prospective contractors must certify compliance with Utah Code 63G-27 et seq., confirming they are not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such activities during contract performance. The original solicitation was numbered BB26-7. No contract completion date or renewal options are specified in the amendment notice.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
