SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

BLOCK 14.

1. The purpose of this amendment is to provide offerors an updated PWS, questions and answers to this RFP, and a revised pricing sheet.

2. The Government within the revised PWS has removed the requirement for offerors to provide maintenance services of air traffic control systems. This is noted within section B of the RP as "ATEM services." Offerors shall not provide pricing or information for these services. The line items have been change to 9001-9005 due to a limitation within our contract writing system.

Offerors shall disregard these line items.

3. The questions and answers are hereby incorporated into this RFP.

4. A new pricing spreadsheet has been provided. Offerors shall use this new pricing sheet to provide pricing information.

5. The RFP closing date remains unchanged. All offers are required to be delivered per the instructions in section L of this RFP.

6. All other terms and conditions remains unchanged.

QUESTIONS AND ANSWERS

Question #1: RFP, Section C, PWS, Paragraph 5.4.1. This paragraph requires that “The contractor provide a minimum of two qualified ATC maintenance personnel in the immediate area at all times when performing maintenance from a height where the possibility of falling exists, and while performing high voltage electrical work where the risk of electric shock or electrocution exists.” In reviewing the workload factors in Technical Exhibit 5, it appears that staffing two full-time maintenance personnel at each location would not be necessary, as the average number of man hours involved in the monthly inspections throughout the sites is 25.

Would the Government consider allow the vendor to bring in an off-duty ATC controller to act as a spotter during these maintenance operations, to save contract costs? In this way, the offeror will only need to price one full-time maintenance technician to handle all inspections, preventative maintenance and repair operations at each of the sites.

Answer #1: The Government has removed the requirement for ATC equipment maintenance services from the PWS.

Question #2: USA Jobs NCHT185423915634. The Government placed vacancy notices on 25 January for two Electronic III Technicians at eight AAFs, to include the seven locations covered under this contract. Are these positions in addition to those required to be filled by the contractor?

Answer #2: The Government has removed the requirement for ATC equipment maintenance services from the PWS.

Question #3: PWS Para. 1.4.2 Minimum Staffing Level: Will the Government please clarify if the EML’s shown by site in section 1.4.2 are associated with qualified Controllers only (as per AR 95-2) or if the EML’s shown in 1.4.2 are inclusive of Maintenance personnel as well?

Answer #3: Minimum staffing level in para 1.4.2 applies to air traffic controllers only. The Government has removed the requirement for ATC equipment maintenance services from the

PWS.

Question #4: PWS Para. Ref. 1.4.2. Are all of the locations currently operating with Contractor provided tower operators and maintenance technicians?

Answer #4: Yes, for 7 of 8 locations. The Government does not currently have a contract for services at Picacho, AZ.

Question #5: Are there any existing Collective Bargaining Agreements at any of the performance locations? If so, please provide a copy of the current CBA's in place.

Answer #5: No, there are no known CBA’s currently in place.

Question #6: Does the Government anticipate that the Contractor will have access to proprietary information while performing this Contract? If so, could you please provide a situational example?

Answer #6: The Government is unaware of “proprietary information” required for this contract.

Question #7: Does the Government anticipate that the Contractor will have access to source selection information (e.g. cost or pricing information, budget information or analyses, specifications or work statements, etc.) while performing this Contract? If so, could you please provide a situational example?

Answer #7: No. The Government does not release source selection information to contractor personnel.

Question #8: Does the Government anticipate that the Contractor will prepare specifications or work statements for systems or services under the anticipated contract? If so, could you please provide a situational example?

Answer #8: No. The Government requires the contract awardee to perform the services within the PWS.

Question #9: Does the Government anticipate that the contractor will provide system engineering and technical guidance for systems and programs under the contract? If so, could you please provide a situational example?

Answer #9: The Government requires the contract awardee to perform the services within the

PWS.

Question #10: Can the Price Model be modified to incorporate variable burdening practices of Fringe, Labor and G&A not consistent with what has been created in the workbook? To allow the ability to modify workbook to be compliant with accounting practices.

Answer #10: The Price Model may be modified so long as the information provides the information required. This is Firm Fixed Price requirement and the Government will not negotiate Profit, G&A, and Overhead rates after contract award.

Question #11: Could the (I) Final Pricing Tab and the (II) Pricing Detail Tab be linked to the (III) FFP Burdened Rate Buildup tab?

Answer #11: Yes, the Offeror may link the tabs if they wish.

Question #12: A CLIN has been provided for travel on the Final Pricing Tab but there is not area to provide detail of those estimated costs or applicable burdening practices as required by the Section M (Evaluation Criteria). Is the intent that Travel should be priced under Other Direct Costs on the (II) Pricing Detail Tab? If so should a (IIII) (CR) Burdened Other Direct Cost Tab be created to apply any applicable Indirect Rates (exclusive of Fee) to the travel costs?

Recomendation to provide an estimated value for all bidders to incorporate as travel costs and remove Section M Evaluation criteria for Travel.

Answer #12: The Government has provided a revised Price Model with the amount of travel expected each year. Offerors are not required to price out the travel.

Question #13: The Places of Performance are Government Facilities/Installations as noted in the SOW. Section L.6.4.3 of the Volume IV- Price Proposal instructions state that "Contractor site rates shall also include Contractor-provided facilities, furniture, equipment, supplies, tool kits, employee training and overhead amounts required for work at Contractor site rates." Should this language be removed based on this being a Government Site Contract?

Answer #13: The Government provides this in the event that the offeror’s technical solution includes offsite performance of duties for this requirement.

Question #14: The draft solicitation included SCA Wage Determinations for all locations but was not included with the final solicitation. Is this contract still covered by the SCA and if so, will the prevailing Wage Determination schedules be provided?

Answer #14: The labor category “Air Traffic Controller” is an SCA Wage category. The Government has provided the wage determinations for these locations. Wage Determinations can also be found at www.dol.gov.

Question #15: The draft solicitation included a Wage Determination schedule for Arizona but the site was not listed as a place of performance. If the Arizona Wage Determination schedule still applies to the final solicitation, will the place of performance be added to include the Minimum Staffing Levels and Maintenance Requirements?

Answer #15: The Government has updated the PWS to include services at Picacho, AZ.

Question #16: PWS paragraph 1.9.7 Threat Awareness Reporting Program states “For all contractors with security clearances, per AR 381-12 Threat Awareness and Reporting Program (TARP), contractor employees must receive annual TARP training.” Section H.8. Security Requirements states “(a) Security clearances are not anticipated for this requirement. If this requirement changes in the future the Government will address the change via modification.”

Question: Request confirmation that Security Clearances are not required for performance of this contract?

Answer #16: The PWS has been updated. The TARP training is required annually for contractors. The contractor personnel do not require a security clearance for services required under this contract.

Question #17: PWS paragraph 5.1.6 states “The contractor shall provide current personnel training records on the GKO training tracker, through coordination with the COR. The contractor shall update training completion dates and upload training certificates IAW timelines established in paragraph 1.8. Question: Paragraph 1.8 refers to CAC Requirements. Should this be paragraph 1.9 Training Requirements?

Answer #17: Yes. The PWS has been updated to reflect correct paragraph number.

Question #18: RFP paragraph B.3.1.2, Cost Reimbursement / Travel Pricing, states “Only actual costs will be reimbursed. Per Diem is not authorized for this action.” Is this to imply that employees will be required to submit receipts for all meals and incidental expenses in lieu of covering these costs via the standard per diem rates?

Answer #18: The Government has updated this paragraph. The contractor shall refer to the Joint Travel Regulation prior to submitting an invoice for cost reimbursable travel services.

Question #19: Section C, PWS, paragraph 1.4.5, Holidays, states facilities will be closed for the normal ten Federal holidays listed. However, two of the DoL Wage Determinations (Attachment 0003 - WD 15-5681 for Alaska and WD 15-4873 for Michigan) require eleven paid holidays, adding Good Friday to the list. Do the holidays prescribed in the Wage Determinations take precedence over RFP section 1.4.5?

Answer #19: Yes. The Wage Determination takes precedence over RFP section 1.4.5.

Question #20: RFP Technical Exhibit 4, first paragraph, refers to Section H-12 for additional insurance requirements. Should this reference be H.7?

Answer #20: Yes, this should reference H.7. This has been updated.

Question #21: Attachment 0001, Price Model; Tab I, Final Pricing; Note 2 states “ Offerors shall complete the estimated travel cost worksheet and transfer the price to this worksheet.” There does not appear to be a travel cost worksheet as referenced. In addition, there does not appear to be sufficient information to allow any sort of travel estimate (number and frequency of trips, locations, durations, personnel required, etc.). Will the Government be providing a) the referenced travel cost worksheet, or b) travel estimates, or c) further guidance/details on travel pricing?

Answer #21: See Answer #12.

Question #22: Attachment 0001, Price Model; Tab I, Final Pricing; Note 2 states “ Offerors shall complete the estimated travel cost worksheet and transfer the price to this worksheet.” There does not appear to be a travel cost worksheet as referenced.

Answer #22: See Answer #12.

Question #23: Is there a contractor currently performing these services? If so, can the Government provide the contractor(s) name and contract number(s)?

Answer #23: W9133L-12-C-0042 with Beacon Management Group LLC and W9133L-15-C- 0011 Clancy JG.

Question #24: Reference SF 33 and Section L: What is the correct due date and time? The SF 33 states 4 pm EST on February 20, 2018 and Section L states 5 pm EST on that same date.

Answer #24: The time is 5:00 P.M. EST. The SF33 has been updated.

Question #25: Reference SF 33 and Section L: How many original, copies, and electronic copies are required to be submitted as the documents conflict?

Answer #25: The Government has not found the conflicting information. The Government requires 3 hard copies and 1 electronic copy of each volume.

Question #26: Section L.4.1 states electronic signatures are acceptable but Section L.6.1.1 states signed originals are required in Volume 1. Please clarify.

Answer #26: The Government requires offerors to provide signed copies of documents.

Offeror’s may sign using an electronic signature or hand written signature. Both are acceptable.

Question #27: The offeror is instructed to “comply with the requirements of the Service Contract Act for those labor categories not determined to be “Professional Services” (i.e. Subject Matter Expert.) However, the Government did not include DOL SCA wage determination information for each location supported in this solicitation. The Wage Determinations (WDs) provided in the Draft Solicitation have been superseded. Would the Government please provide the current WDs, so that the offeror can determine SCA wages for the labor categories required to support each site?

Answer #27: See Answer #19.

Question #28: The Government advised that “Key personnel are not required for this contract and are not necessary for submission with the proposal. Offeror shall, however, identify the minimum requirements of each proposed position and verify that proposed personnel meet these requirements.” This paragraph indicates that all personnel to be employed under this contract shall be identified in advance. FAR 52.222-17 and FAR 52.222-41 require offerors to retain the existing workforce. Please provide a list of names and qualifications of exiting workforce so that we can comply with this requirement.

Answer #28: FAR 22.1204 does not require the Government provide offerors with a list of the names and information of current personnel. Offerors are required to ensure their minimum wages proposed in their proposed technical solution meets or exceeds the wage determination rates attached to this RFP.

Question #29: The Government states that “The offeror’s past performance must be assessed to determine the relevancy of an effort accomplished by the offeror to the effort to be acquired through the source selection with regard to price, recency and similarity of scope. Relevancy is not separately rated; however, the following criteria will be used to establish what is relevant which shall include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming: Very Relevant: Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant: Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires. To meet the criteria “to obtain a Very Relevant or Relevant rating, it appears that an offeror must have multiple ATC operations under a single contract to demonstrate that their past performance is “similar in scope” to include meeting the “complexity,” and “dollar value” of this effort. As contracted ATC services are not very abundant in the CONUS, particularly combined services to support multiple locations, this requirement appears to limit the competition to companies currently providing ATC services for the Army National Guard. Would the Government please address this concern?

Answer #29: The Government understands this aspect of this acquisition. The Government placed the technical aspect of this requirement as more important than the past performance aspect of this requirement. The Government expects companies to propose their best technical solution to meet this requirement.

Question #30: The solicitation is silent on whether a completed Section B should be included with the contractor submission. Can the Government clarify if Section B should be completed and included, and if so, in which volume shall it be incorporated?

Answer #30: Offeror’s shall submit a copy of section B within Tab B of their proposal. Section L has been updated. A conform copy of this amendment has also been provided.

PEFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

FOR

Air Traffic Control Services

As of 5FEB18

1.0 General. The Army National Guard (ARNG) has a requirement to provide Air Traffic Control (ATC) Services at ARNG airfields (AAF) listed in paragraph 1.4.2.

1.1 Scope. The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in paragraph 3.0 as Government Furnished, to perform ATC services as defined in this PWS.

1.1.1 All requirements and provision in the PWS will comply with applicable regulations and publications. Compliance with Army Regulation (AR) 95-2 and Training Circular (TC) 3-04.81 is required specifically for Air Traffic Controllers. For disparity between this PWS and applicable publication, the most restrictive approach is required. Requests for clarification of ATC regulatory policy, processes, or procedures will be submitted to the Contracting Officer’s Representative (COR).

1.2 Background. Based on continuing requirements to provide safety of flight and traffic separation and sequencing at numerous ARNG controlled airfields, ARNG-AV requires certified air traffic controllers to provide these services.

1.3 Period of Performance (PoP). The Period of Performance shall be one base year plus four option years. The initial period of performance shall be 12 months from date of award.

Dates may be reasonably adjusted to accommodate contract award dates.

1.4 Place and Performance of Services.

1.4.1 Except on recognized US holidays, or when the Government facility/installation is closed due to local or national emergencies, administrative closings, or similar Government-directed facility/installation closings, the contractor shall provide ATC services at each location during the operating hours specified below (times are Local).

1.4.2 Minimum staffing levels indicate the minimum number of qualified personnel needed in order to comply with AR 95-2, TC 3-04.81, Training Bulletin (TB) 002-11, 29 Code of Federal Regulation (CFR) 1910, Unified Facilities Criteria (UFC) 3–560–01, and National Fire Protection Association (NFPA) 70 policies on ATC emergency manning levels. These staffing levels are not to be interpreted as the shift or operational levels required during hours of operation. The contractor shall not operate at Emergency Staffing Levels (EML) unless absolutely unavoidable. The “Minimum Staffing Level” listed below describes the minimum qualified staff the Contractor shall maintain in order to provide services and meet the definition of EML listed within the above regulations.

1.8.5 The contractor shall ensure that all employees requiring an initial background investigation complete a Personnel Security Investigation Portal (PSIP) form at the earliest possible date and that this form is forwarded to the NGB Personnel Security manager who will initiate the investigation process via the PSIP. Contractor personnel will then receive two e-mail messages; the first will confirm that the request has been received by the Office of Personnel Management, and the second will provide instructions for the completion of the appropriate form via the Electronic Questionnaires for Investigations Processing (e-QIP) system.

1.8.6 Upon completion of the e-QIP questionnaire and submittal of all required documents, including fingerprint card to the security manager, the BI will be initiated. The contractor shall ensure all instructions regarding background investigation processing, including those provided verbally, by e-mail or via a Government system are complied with immediately. The contractor is cautioned that the entire process from submittal of the PSIP form to return of the FBI fingerprint check may routinely take from 2-6 weeks and shall factor this lead time into its hiring/placement process.

1.8.7 The contractor shall make all reasonable efforts to ensure that contractor employees meet CAC eligibility standards upon assignment to the contract and shall be held responsible for delays, failure to meet performance requirements or decreases in efficiency in accordance with the applicable inspection clause.

1.8.8 The contractor shall manage requests for new or renewal CAC cards in sufficient time to ensure that all contractor employees have them when needed to perform work under this contract. The norm is at least ten calendar days advance notice to the Trusted Agent (TA), unless there are extenuating circumstances approved by the COR or KO.

1.8.9 The contractor shall designate a "Corporate Facility Security Officer" (FSO) to serve as the firm's single point of contact for Background Investigation (BI), the TASS application process and other CAC and security related matters. If a FSO is not established, each contractor employee requiring a CAC will be required to process their own applications.

1.8.10 The contractor shall process CAC applications through the TASS. The contractor's FSO or contractor employee shall submit requests for a CAC via email to the designated TASS Trusted Agent (TA) before accessing the TASS website. The COR will provide the contractor with the current TASS TA contact information.

1.8.11 The government will establish a TASS application account for each CAC Request and will provide each contractor employee a USER ID and Password, via email, to the FSO. The FSO or contractor employee shall access the TASS account and complete the CAC application (entering/editing contractor information as applicable) at: https://www.dmdc.osd.mil/tass/.

1.8.12 The FSO or contractor employee shall submit completed applications in TASS and will follow up to ensure that the TA is processing the request.

1.8.13 The government will inform the contractor's applicant, via email, of one of the following:

Approved. Upon approval, the information is transferred to the Defense Enrollment Eligibility Reporting System (DEERS) database and an email notification is sent to the contractor with instructions on obtaining their CAC. The contractor proceeds to a Real-Time Automated Personnel Identification System (RAPIDS) station (RAPIDS Site Locator:

http://www.dmdc.osd.mil/rsl/).

Rejected. The Government, in separate correspondence, will provide reason(s) for rejection.

Returned. Additional information or correction to the application required by the contractor employee.

1.8.14 The contractor shall maintain records of all approved and rejected applications. At the RAPIDS station, the RAPIDS Verification Officer will verify the contractor by SSN and two forms of identification. Identity source Documents must come from the list of acceptable documents included in Form I-9, OMB No. 115-0136, "Employment Eligibility Verification."

Consistent with applicable law, at least one document from the Form I-9 list shall be a valid (unexpired) State or Federal Government-issued picture identification (ID). The Identity documents will be inspected for authenticity and scanned and stored in the DEERS upon issuance of an ID. The photo ID requirement cannot be waived, consistent with applicable statutory requirements. The Verification Officer will capture primary and alternate fingerprints, picture, and updates to DEERS and will then issue a CAC.

1.8.15 The contractor shall return issued CAC's to the DEERS office, COR or ATC Facility Chief within 1 day of departure or dismissal of each contractor employee,…
