BASIS FOR AWARD
Award will be made to the proposal that is evaluated as Lowest Price Technically Acceptable.
See FAR 52.212-2 Evaluation - Commercial Items.
52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
The Government will use the results of Lowest Price Technically Acceptable as the evaluation process of its award decision. The selection process will determine the overall merits of each proposal in terms of its potential to best satisfy the needs of the Government. A rating of no less than “Acceptable” must be achieved to be considered for award in the Technical and Price proposal being reasonable, complete and balanced. Option periods pricing will also be included in the evaluation.
The Government reserves the right to award a contract without discussion.
Cost/price evaluation will include an analysis of the total price to perform the required work. The total cost/price supplied by the offeror shall be provided in accordance with the Provision at 52.212-1, Instructions to Offerors—Commercial Items, and shall constitute the total firm fixed-price for the services described by the Statement of Work (SOW).
Proposals that are unrealistic in terms of technical commitment or unreasonably low or high in cost/price will be deemed reflective of an inherent lack of technical competence or indicative of failure to comprehend the complexity and risk involved in the contract requirements and may be grounds for rejection of the proposal.
1 Evaluation Criteria Contractor selection will be based on evaluation of proposals in accordance with the responses received to the criteria outlined in SOW. Award will be made to the proposal that is evaluated:
- Technical Evaluation: Rated as “Acceptable”
- Past Performance Evaluation: Rated as “Acceptable”
- Price Evaluation
The Government reserves the right to reject any or all proposals received and/or request clarification of proposals. The Government also reserves the right to determine a competitive range for negotiation based upon the technical and cost/price acceptability of proposals. In addition, the Government reserves the right to award a contract without discussion.
Cost/price evaluation will include an analysis of the total cost/price to perform the required work.
The total cost/price supplied by the offeror shall constitute the total firm fixed-price for the services described by the SOW.
Proposals that are unrealistic in terms of technical commitment or unreasonably low or high in cost/price will be deemed reflective of an inherent lack of technical competence or indicative of failure to comprehend the complexity and risk involved in the contract requirements and may be grounds for rejection of the proposal.
2 Evaluation Factors
2.1 Technical Evaluation
Technical proposals will be initially evaluated with respect to three (3) sub-factors identified below. Each Technical Proposal shall be assigned an adjectival rating of “Acceptable” or “Unacceptable” as illustrated in Table 1 (below). In order to attain an “Acceptable” Technical Rating, each of the sub-factors below must have been evaluated as “Acceptable”.
1. Sub-Factor 1: Qualifications of proposed personnel are adequate for accomplishing all requirements of the SOW.
2. Sub-Factor 2: Operations support plan clearly demonstrates the offeror’s overall technical approach and proposed methodology to adequately support the Government’s mission. The Operations Support Plan shall clearly demonstrate the offeror’s understanding of the scope of work and the requirement.
3. Sub-Factor 3: Quality Control Plan.
Those offerors whose proposals are determined to be “Unacceptable” will be excluded from further consideration.
Table 1, Technical Proposal Ratings Adjectival
Rating Description
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
2.2 Price Evaluation
Proposals rated as “Acceptable” will be evaluated to determine the reasonableness of the proposed price. Unrealistic offers cannot be selected for award.
Each proposal’s pricing proposal shall be evaluated on a “Realistic” or “Unrealistic” basis.
Those offerors whose proposals are determined to be “Unrealistic” will be excluded from further consideration.
2.3 Past Performance Evaluation
In evaluating Past Performance, the Government will evaluate the quality, timeliness, and safety of the offeror’s past performance considering currency, relevancy, sources, context, and trends on recent (within the past five years). Also, evaluations available through the Past Performance Information Retrieval System (PPIRS) may be used. An adjectival rating of “Acceptable” or “Unacceptable” will be assigned to each offeror’s past performance as illustrated in Table 2 (below). In order to attain an “Acceptable” past performance rating, the offeror’s past performance should indicate that their efforts under present or previous requirements were acceptable.
In the context of an acceptability/unacceptability, an offeror without a record of relevant past performance, or for whom information on past performance is not available or is so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be rated favorably or unfavorably. In such circumstances, the offeror shall be determined to have unknown (or “neutral”) past performance and shall be considered “Acceptable”.
Table 2, Past Performance Evaluation Ratings Adjectival Rating Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
