Statement of Work

Cape Fear Lock and Dam Security Fence

Bladen County, NC 28456

I. General Information

A. The USACE Wilmington District seeks a Contractor to remove and replace chain link security fence encompassing William O’ Huske Lock and Dam esplanade in Bladen County, North Carolina.

a. William O’ Huske Lock and Dam (Cape Fear Lock and Dam 3), 1248 Bill Hall Road, Fayetteville, North Carolina 28306.

B. Background

a. The work includes, but is not limited to, the following:

1) Calculate and provide all labor, equipment, material, and hardware necessary to install 8’ commercial grade galvanized chain link security fence with angled 3-strand galvanized barb wire and double drive vehicle gate with typical closure mechanisms.

Lock 3 approximately 373’ minimum 9-gauge wire chain link fence.

2) Provide and install removable 6’x10’ chain link fence panels and posts flush with the outside of the lock esplanade walls at Lock and Dam 3.

Lock 3 approximately 200’ removable minimum 12-gage wire fence panels.

3) Salvage, Reuse and Recycle:

Identify anticipated materials and waste for salvage, reuse, and recycling. To the extent practicable, all scrap metal must be sent for reuse or recycling and shall not be disposed of in a landfill.

4) Disposal:

Control accumulation of waste materials and trash. Recycle or dispose of collected materials off-site by the end of each day and in compliance with waste management procedures.

5) Restore all areas disturbed by construction operations to prework conditions.

C. Pre-Bid Site Visit

The Government will conduct a site visit on 3 April 2024 at 10:00 a.m. EST at Cape Fear Lock & Dam 3, 1248 Bill Hall Road, Fayetteville, NC 28306. Contractors interested in attending must RSVP by 2 April

2024 by 2:00 p.m. EST to terri.m.adams@usace.army.mil and Jenifer.m.garland@usace.army.mil.

Although not mandatory, a Pre-Bid Site Visit is highly recommended to prevent underbidding due to the onsite conditions and special requirements of the Lock Masters.

D. Pre-Work Conference

Once awarded, the Contractor shall attend a pre-work conference at William O’ Huske Lock and Dam office prior to commencing work. The Contractor shall provide a copy of their Activity Hazard Analysis

(AHA), employee E-verify information, and proof of insurance.

a. The Contractor shall be fully responsible for the quality control, administration, Contractor health, and the comprehensive safety requirements of the Wilmington Safety Office.

II. Period of Performance and Performance Requirements

A. The Contract Performance Period shall be completion 90 days after Contract Award.

B. The Contractor shall submit prior to commencement an Activity Hazard Analysis (AHA) for each task necessary to complete the work associated with the Contract.

C. The Contractor shall commence work under this Contract within thirty (30) calendar days after the award date.

a. Contractor employees are required to be visibly identifiable as a Federal Contractor while onsite. (i.e., uniform, badge, vest, etc.)

b. Subcontractors: If the primary Contractor plans to use subcontractors the subcontractor shall be lined up and ready to work on the start date above to avoid commencing the Contract in default.

c. Primary Contractor: The primary Contractor is responsible for the onsite supervision of their subcontractors and shall be onsite for daily safety meetings, safety enforcement, and quality control of the Contract.

D. The work shall be performed to the satisfaction of the Contracting Officer during normal working hours

Monday through Thursday 6:00 am to 3:00 pm, unless otherwise specified, or as specifically approved in advance by the onsite Lock Master or Contracting Officer’s Representative (COR). All federal holidays shall be observed by the Contractor and no work on site other than specified shall be permitted without specific approval by the onsite Lock Master or COR.

III. Quality Control/Quality Assurance

A. Quality Control (QC)

a. The Contractor (Primary Contractor) is responsible for maintaining adequate quality control to be sure the specifications of this Contract are met (by the subcontractor).

b. Failure to Quality Control will result in a Notification of Contract Discrepancy Report to the Primary

Contractor when functional areas of this Contract are not met. This may require the Contractor to return to the site for correction and/or result in a delayed or reduced payment.

B. Quality Assurance (QA)

a. The Government will monitor the Contractor's performance in each functional area under this Contract and reserves the right to use additional surveillance procedures.

IV. Scope of Work

A. Contractor Responsibilities:

a. All work shall comply with existing local, state, and national codes, including guidelines and specifications included in the Americans with Disabilities Act. All work shall be accomplished in a professional manner.

b. Contractor is responsible for inspecting the site and for determining the exact dimensions, equipment, material, and hardware necessary for the project as specified in the Statement of Work (SOW) and

Contract documents. The Contractor shall obtain all permits, licenses, and inspections required by all local, state, and federal authorities.

c. The Contractor shall be financially responsible for replacing any property damaged at the site during the construction process.

B. Technical Requirements for 8’ fixed position security fence at Lock 3:

a. The Contractor shall remove all old fence materials for salvage, reuse, and recycling whenever possible.

b. The Contractor shall install the fence in the specified location below:

1) The Contractor shall install the fence at Lock 3 in the newly marked position on top of the hill approximately 20-feet to the west to encompass the light/power poles.

c. The Contractor shall secure the posts in the ground with concrete.

d. The Contractor shall supply galvanized commercial grade with 9-gage, chain link 2” wire mesh fences with angled, 3-strand galvanized barb wire top.

e. The Contractor shall supply at a minimum of 3” SF40 Premium Commercial Grade Galvanized Chain

Link Terminal Posts and Gate Posts. The remaining line posts can be lower grade.

f. The Contractor shall install line posts no more than ten feet (10’) apart.

g. The Contractor shall supply a minimum grade of 15/8” SF20 Premium Commercial Grade Galvanized

Top Rail.

h. The Contractor shall install the same size double swing drive gates with welded 2" HF40 premium grade tube galvanized gate with 9-ga. galvanized fabric, the corners shall be notched and welded (or similar heavy-duty construction) with commercial pad lockable drop rods. The Contractor shall replace the southern side double swing drive gates on the driveway to the esplanade with two 8-ft swing drive gates.

i. The Contractor shall remove the unused double swing gates on the western side and replace with fence and 3-strand galvanized barb wire.

C. Technical Requirements for 6’ removable fence panel at Lock 3:

FYI: Lock Masters need to be able to easily remove and replace these posts and panels for flood events and often work alone.

a. The Contractor shall install posts with a minimum size of 2”x8’ secure to the side of the esplanade concrete walls (see Appendix A Figure 1). The posts shall overlap the esplanade concrete walls a minimum of 24” secured with a minimum of 2 bolts.

b. The Contractor shall install the post brackets with all the top bolts at a uniform height, so all the removable posts are the same size and set at a uniform height.

1) Post Brackets shall be a larger section of galvanized pipe/fence post with an inside diameter (equal to the outside diameter of the fence post) sufficient to insert the removable fence posts (see

Appendix A Figure 1).

(1) More than one size Posts and Post Brackets shall be needed (Terminal & Gate Posts & Line

Posts).

c. The Contractor shall install several post brackets in the ground set in concrete. (See Appendix B Figure

2)

d. The Contractor shall fasten the fence panels together with panel clamps and then fasten the panels to the posts.

D. Post Work Activities:

a. The Contractor shall perform Disassemble/Demobilize any staging/lay-down area as required and shall restore that area to pre-work conditions or better for the completion of this task.

V. Contract Definitions.

A. Contracting Officer - A Government employee with authority to enter into, administer, and/or terminate

Contracts and make related determinations and findings.

B. Contracting Officer's Representative (COR) - An individual designated in writing by the Contracting

Officer to be responsible for the administration of the Contract.

C. Quality Control - The Contractor’s responsibility for maintaining adequate quality control to satisfactorily meet the specifications of this Contract.

D. Quality Assurance - The Government’s responsibility to monitor the Contractor's performance in each functional area under this Contract and reserves the right to use additional surveillance procedures.

VI. Government Safety Requirements:

A. All work shall be conducted in a safe manner and comply with OSHA standards and EM 385-1-1:

B. Activity Hazard Analysis (AHA)

An approved Activity Hazard Analysis (AHA) for all work associated with the Contract and accepted by the Wilmington Safety Office is required before commencing work. The Contracting Officer will provide electronic copies of the AHA form.

C. Site Safety and Health Officer

The Contractor shall have a designated Site Safety and Health Officer (SSHO). The SSHO shall be on the project site anytime work is underway. When the SSHO is off-site, an alternate, equally qualified SSHO shall be on site until the primary SSHO returns. The SSHO shall have 3-years of experience in managing safety and shall have completed the OSHA 10-hour General Industry Safety Course.

The Contractor shall submit by the fifth of each month hours worked for the previous month. See attachment “Contractor Monthly Exposure Report” form (provided by the COR) for submitting monthly exposure hours.

E. Daily Safety Meetings

The Contractor shall conduct daily safety meetings to discuss the activities for the day, including a review of the AHA for planned activities for the day, if necessary, updating the AHA, and a discussion about any unusual conditions. The meeting shall be documented (form provided by the COR) and given to the COR at the end of the work week.

F. Public Safety

The Contract work shall be taking place in public areas and government personnel may require access during the work period. Contractors shall take all necessary precautions to ensure the safety of the visiting public and government personnel.

G. Accident Notification Plan

In the event of an accident, notification to the Contracting Officer or designated representative shall occur as soon as possible, but not later than 4-hours after occurrence. Accident notifications shall be followed up with an ENG Form 3394, USACE Accident Investigation Report. ENG Form 3394 serves as the Initial

Accident Report (IAR), Final Accident Report (FAR), and Near Miss Report. The IAR shall be submitted to the COR within five (5) days of the accident and the FAR shall be submitted within fifteen (15) days of the accident. Near Miss Reports shall be submitted to the COR with fifteen (15) days of the near miss.

ENG Form 3394 will be supplied by the COR at the time of notification.

VII. Contract Management Information

A. Security:

General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated

Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense

(DoD) and Army security training requirements specified below, if applicable, are performance requirements;

all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with

Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as

“RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or

HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.

Antiterrorism (AT) Level I training: All contract personnel requiring routine access to Army installations, facilities, and controlled access areas, or requiring network access shall complete initial and annual refresher

AT Level I awareness training. Online AT Level I awareness training is available at https://jko.jten.mil/

(website subject to change).

Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the

National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and

Terrorist Screening Database (commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.

Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.

Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with

Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the

Contracting Officer to become part of the official contract file.

B. Inspections and Acceptance:

a. The COR, Lock Master, or representative will inspect services rendered.

b. Work not meeting acceptable standards or as specified in the SOW and Contract documents shall be remedied to the satisfaction of the inspector prior to final payment.

c. Failure or inability to perform specified services will result in reduction in payment as provided by

Section 37(d)(2) of General Provisions entitled Inspection of Services.

C. Payment:

a. The Contractor shall submit to the Government an invoice for work completed under this Contract.
