Justification and Approval
For Other than Full and Open Competition – BRAND NAME
Communications Cables – Supply & Installation
John H. Kerr Powerhouse
1. CONTRACTING ACTIVITY:
U.S. Army Corps of Engineers, Wilmington District, 69 Darlington Avenue, Wilmington, NC 28403.
2. DESCRIPTION OF ACTION:
Approval is being requested for a firm-fixed price contract for the purchase and installation of copper and fiber optic cables at John H. Kerr Powerhouse. The cable shall be manufactured by AFL, Inc., type Mini-Span 424, model number AE0129C520AA4.
3. DESCRIPTION OF SUPPLIES/SERVICES AND ESTIMATED VALUE:
Supply and install a Fiber Optic Cable, Approximately 2,000’, 12 stranded, manufactured by AFL, Inc., type Mini-Span 424, and Model number AE0129C520AA4, as shown on the drawing. The cable will be installed in buried conduits and hung on wooden poles, depending on the location. It will connect from the Visitor Assistance Center to the Maintenance area.
This cable must match the existing cable to avoid losses in the entire length of the cable run. This cable will greatly improve communications between the Powerhouse, Visitor Assistance Center, and the Maintenance area.
4. AUTHORITY CITED:
The statutory authority permitting acquisition of the requirement by other than full and open competition is Only One Brand and No Other Brand Will Satisfy Agency Requirements – FAR 13.106- 1(b)(1)(i) Brand Name Only, 10 U.S.C. 2304(c)(1).
5. REASON FOR AUTHORITY CITED:
There is already approximately 6,000’ of this cable installed and the Government requires consistency with the cables to ensure minimal loss in the data signal. Installing another brand cable could result in not only loss of data but weaken the integrity of communication transfer and would have a major cost impact if the entire line needed to be replaced because of this. The data is critical in communicating between facilities on the John H. Kerr Project to ensure operational security and functionality.

6. EFFORTS TO OBTAIN/ INCREASE COMPETITION:
IAW FAR 13.105 (c), the solicitation will be synopsized and posted to the Government Point of Entry (GPE), the Federal Business Opportunity (FBO) website open to all vendors who can provide the brand name cable.
7. MARKET RESEARCH / INTERESTED SOURCES:
A Dynamic Small Business Search (DSBS), restricted to the state of Virginia under NAICS Code 237130, revealed 307 small businesses with the capability of suppling and installing the copper and fiber optic cables. Therefore, IAW FAR 19.502-2(a), this requirement shall be set-aside for small business concerns, as there is reasonable expectation of obtaining offers from two or more responsible small business concerns.

11. APPROVAL
Based on the foregoing justification, I hereby approve the procurement of AFL, Inc., type Mini-Span 424, model number AE0129C520AA4 on an other than full and open competition basis pursuant to the authority of 10 U.S.C. 2304(c)(1), subject to availability of funds, and provided that the property herein described have otherwise been authorized for acquisition.
