SOLICITATION RFI RESPONSES

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

Interested Vendor Question (Fully Quoted Text) Final Government Response

At the same time we would clarify that, if an ongoing project, will be accepted as experience in an Amendment, for that project it will not be necessary to submit the certification of the “Banco di Prova Armi da Fuoco Portatili” and “Agibilità” from Stato Maggiore dell’Esercito due to the fact that the work cannot receive them before it will be finished.

No. The requirement for the certification will not change for this solicitation. However, please refer to the amendment for this RFI.

AMENDMENT NOTICE: The solicitation has been amended in Sections L and M to request only one completed project for past experience and past performance.

[W]e request the validity to use, as second relevant and recent project, an ongoing project.

No. Ongoing projects will not be considered "relevant and recent" for this acquisition.

However, please refer to the amendment for this RFI.

AMENDMENT NOTICE: The solicitation has been amended in Sections L and M to request only one completed project for past experience and past performance.

AR500 steel 500 Br ,depth minimum 10 mm , requested in the SOW is material not available in Italy. AR steel 500 Br means Abrasion Resistant steel with hardness of 500 Brinnell and is normally used for armor plate.

Should not be confused with other steel likeHardox, Dillidur, Xar and others types. AR500 steel requires authorization from Italy Ministry of Defense before delivered to end user.

This procedure takes around 3 months. After the authorization there is a 10 months delivery time because AR500 steel should came from Thyssen Group Germany.

For above mentioned reasons it should be not possible to respect delivery and end of work if the time allowed are only 270 days.

The period of performance will not be revised for this solicitation.

INSTRUCTION TO OFFERORS

A. PROPOSAL SUBMISSION GENERAL GUIDELINES

1. Offerors should be registered in the System for Award Management (http://www.sam.gov) upon submission of proposal. The System for Award Management (SAM) is a Federal Government owned and operated free web site that consolidates the capabilities in the Central Contractor Registration (CCR) FedReg, ORCA, and EPLS.

2. Joint Ventures or A.T.I. (Associazione Temporanea d'Imprese, Temporary Association of Firms) are not allowed.

B. GENERAL INSTRUCTIONS

1. Offerors shall strictly adhere to the requirements in this Section when preparing the proposal to be submitted in response to this Request for Proposal (RFP). All proposals shall be in English. The Government will not reimburse any Offeror any cost incurred in response to this RFP. Proposals that fail to comply with the proposal submittal requirements addressed in this section of the solicitation may be determined unacceptable. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein.

2. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) at or before the exact date and time specified. There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement may result in a proposal being ineligible for award.

3. All RFP documents will be posted to the Federal Business Opportunities (FedBizOpps) website (https://www.fbo.gov) and made available for viewing. All amendments will be posted to FedBizOpps and made available for viewing. It shall be the Offeror’s responsibility to check the website for any amendments and updates to the solicitation.

4. The Government will award one contract to the responsible offeror whose proposal represents the best value to the Government. Awards will be based on the best value – utilizing the Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose offer is evaluated as “acceptable” for all technical factors and whose proposal has the lowest price.

5. Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with FAR 15.208.

C. PROPOSAL SUBMISSION INSTRUCTIONS:

1. Proposals may be submitted by firms formally organized as design-build entities, or by construction contractors and designers/design firms that have associated specifically for this contract. For the purpose of this solicitation, no distinction is made between formally organized design-build entities and contract-specific design-build associations.

Both are referred to as the design-build offeror (or simply “Offeror”), or the design/build contractor, (or simply, “Contractor”), after award of the contract.

2. General Requirements: The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience, and will base its evaluation only on the information presented in the Offeror’s proposal.

3. Offeror(s) shall provide proposals in English in accordance with the instructions below. Proposal pages should be standard letter size (8-1/2” x 11” letter size); however, if drawings or other graphics are submitted, Offerors should reduce them only to the extent that legibility is not lost. The total pages submitted shall not exceed 60 pages excluding the SF1442. Pages that exceed this limit will not be evaluated. Font size Arial 12 is preferred. All pages should be numbered. Any pages over the prescribed limit will not be considered for evaluation.

4. Proposals shall consist of two (2) electronic copies (documents PDF format) with the bid guarantee provided as an original. The electronic copy (PDF format on a CD or DVD) will be delivered to the following address: Attn.: Ms.

Elisa Marchetti or Mr. Shaun McAfee, 414th CSB, Regional Contracting Officer (RCO), Caserma Ederle, Building 3, Room 104, Viale della Pace 193, 36100 Vicenza in an envelope clearly marked with the solicitation number.

Government personnel may not be available to pick up proposals at the gate. It is the contractor's responsibility to ensure delivery to the location specified.

5. The submittals shall be formatted as follows, each tab confined under a Volume:

Volume Factor / Documents

Factor I: TECHNICAL - Past Experience / Enclosure 1 Construction Project Information Sheet.”

1 Factor II: TECHNICAL / QUALIFICATION - SOA Certification

1 Factor III: PAST PERFORMANCE / Enclosure 2 “Past Performance Questionnaire”

Factor IV: Price / Completed SF1442 with all amendments (signed) and Attachment 2 “List of Work Features”

Documentation for Determination of Responsibility, Chamber of Commerce and Anti- Mafia Self-Certification (Enclosure 3), Bid Guarantee, and Letter of Intent

D. ADDITIONAL SUBMITTAL INSTRUCTIONS

1. FACTOR I – TECHNICAL / PAST EXPERIENCE (Volume 1). Offerors shall ensure correct phone numbers and email addresses are provided for the client point of contact for each sheet. Offerors shall utilize the Construction Project Information Sheet (Enclosure 1) included in this solicitation in order to submit information for this subfactor.

Offerors shall submit at least one relevant and recent projects but not more than five projects. One information sheet shall be submitted per project. Relevant and recent projects are projects that meet the following minimum criteria:

(a) Were construction projects “same or similar” in scope to the project in this solicitation.

“Same or similar” scope design projects are projects which include one or more of the following: construction of indoor ranges, renovation of indoor ranges, or replacement of bullet traps.

(b) Had a contract value which equals or exceeds €100,000.00

(c) Were completed within five (5) years from the date of this solicitation

(d) Were completed in Italy

(e) Were completed by the offeror as the prime contractor

(f) Obtained the certification from the “Banco Nazionale di Prova Armi da Fuoco Portatili” for the project

(g) Obtained the final acceptance (agibiliata) by the Stato Maggiore dell’Esercito – Dipartimento delle

Infrastrutture – Ufficio Studi e Normativa” in Rome

2. FACTOR II : TECHNICAL / QUALIFICATIONS – SOA CERTIFICATION (Volume 1). Offerors shall provide a current (as of the date of this solicitation) copy of the SOA OG1 classification I or higher and/or OG11 classification I or higher.

3. FACTOR III – PAST PERFORMANCE (Volume 1)

a. Completed Past Performance Questionnaires (PPQ) shall be submitted with your proposal for each project the offeror submits for evaluation under this Factor. The past performance information shall be recent and relevant to this requirement. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.

b. Offerors shall submit at least one, but not more than five relevant and recent projects for this evaluation factor utilizing the Past Performance Questionnaires (Enclosure 2). Offerors shall submit past performance questionnaire on the same relevant and recent projects submitted under Factor I, Past Experience. Recent past performance is defined as projects which have been completed within five (5) years from the date of this solicitation.

Since the projects that will be submitted in past performance will be the same as those projects submitted for Factor I Past Experience, the definition of relevant is the same.

c. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs.

However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

d. While the Government may elect to consider data from other sources, the burden of providing detailed current, accurate and complete past performance information rests with the Offeror.

4. FACTOR IV – PRICE, Solicitation Offer and Award Document, Standard Form 1442 (Volume 2)

a. Each offeror shall provide a total price in Euro and without IVA tax for each line item listed in Section B - SUPPLY OR SERVICES AND PRICES/COSTS of the request for proposal.

Failure to submit a price for each line item will cause the rejection of the proposal as not conforming to the requirement.

b. Each offeror shall return Attachment 2, List of Work Features, duly filled out.

c. Each offeror shall acknowledge all Amendments by signing and returning them with the proposal.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

A. BASIS OF AWARD

1. The Government plans to award one contract to the responsible offeror whose proposal represents the best value to the Government. Awards will be based on the best value – Lowest Price Technically Acceptable approach. This process permits no tradeoffs among cost or price and non-cost factors. Award will be made to the offeror whose proposal meets all “acceptable” technical factors and whose proposal has the lowest price.

2. Numerical scores and other point-scoring techniques will not be used in the evaluation process. Each factor will receive an acceptable or unacceptable rating. The Government will evaluate proposal in accordance with the evaluation factors described in this section.

3. The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range. Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the proposals received. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.

4. Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with FAR 15.208.

B. EVALUATION FACTORS AND RATINGS

1. Proposals will be evaluated using the evaluation factors listed below:

FACTOR I – Technical / Past Experience FACTOR II – Technical/Qualifications – SOA Certification FACTOR III – Past Performance FACTOR IV – Price

2. FACTOR I: TECHNICAL - PAST EXPERIENCE. The Government will evaluate the Offeror’s past experience on relevant and recent projects (as defined below) to assess the Offeror’s ability to complete construction and design services under this contract.

a. The Government will evaluate this factor utilizing only the Construction Experience Sheets provided with the solicitation. If the offeror submits more than five (5) Construction Experience Sheets with their proposal, the Government will only evaluate the first five (5) Construction Experience Sheets in an offeror’s proposal. Any additional projects submitted will not be evaluated.

b. The Government will evaluate the Offeror’s construction past experience on relevant and recent projects. For purposes of evaluation of this factor, relevant and recent projects are projects that meet the following minimum criteria as a standard of proof:

(1) Were construction projects “same or similar” in scope to the project in this solicitation.

“Same or similar” scope design projects are projects which include one or more of the following: construction of indoor ranges, renovation of indoor ranges, replacement of bullet traps.

(2) Had a contract value which equals or exceeds €100,000

(3) Were completed within five (5) years from the date of this solicitation

(4) Were completed in Italy

(5) Were completed by the Offeror as the prime contractor

(6) Obtained the certification from the “Banco Nazionale di Prova Armi da Fuoco Portatili” for the project

(7) Obtained the “agibilita’” (final acceptance) by the Stato Maggiore dell’Esercito – Dipartimento delle

Infrastrutture – Ufficio Studi e Normativa” in Rome.

EVALUATION. Factor I: Technical / Past Experience. All offerors will receive one of the following Adjectival Ratings for Factor I:

Adjectival Rating Description

Acceptable Proposal meets the requirements of the solicitation

Unacceptable Proposal does not meet the requirements of the solicitation

When evaluating Factor I, the Government evaluation team will review the project(s) submitted on the Construction Experience Sheet(s) and verify that each project, individually, meets the criteria as a standard of proof for a relevant and recent project. In consensus, if a project submitted for evaluation fails to meet one or more of the criteria for standard of proof, that project will not be considered relevant and recent.

To receive an “ACCEPTABLE” rating for Factor I, the Government will have determined that, at a minimum, one construction project is relevant and recent. The Government places no additional merit or value on offerors whose proposal contains more than one relevant and recent construction project.

3. FACTOR II – TECHNICAL / QUALIFICATIONS – SOA CERTIFICATION. The Government will evaluate the qualifications of the offeror. The Government will evaluate SOA certifications to determine if the offeror possesses the mandatory certification outlined in Section L which certifies that the company satisfies all requirements pursuant to Italian law.

EVALUATION. Factor II: Qualifications-SOA Certification. All offerors will receive one of the following Adjectival Ratings for Factor II:

Acceptable Proposal meets the requirements of the solicitation

Unacceptable Proposal does not meet the requirements of the solicitation

When evaluating Factor II, the Government evaluation team will review the offeror’s SOA category and classification to verify that the OG1 is current and classification I or higher, and/or that OG11 is current and classification I or higher.

To receive an “ACCEPTABLE” rating for Factor II, the offeror will submit a current copy of SOA OG1 classification I or higher, and/or SOA OG11 classification I or higher.

4. FACTOR III – PAST PERFORMANCE The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance provided in the offeror’s Past Performance Questionnaires outlined in Section L. The Government will evaluate the relative merits of each Offeror’s past performance on the same relevant projects submitted and evaluated under Factor I, Past Experience. Please note that “Past Experience” measures “what you have done” while “Past Performance” measures “how well you have done”.

a. The Government will evaluate each offeror’s past performance to determine how well it conforms to specifications and standards of good workmanship, adheres to contract schedules including administrative aspects of the performance, exhibits reasonable and cooperative behavior and a commitment to customer satisfaction and has a businesslike concern for the interests of the customer.

b. Recent past performance is defined as projects which have been completed within five (5) years from the date of this solicitation. Since the projects that will be submitted for past performance will be the same as those projects submitted for Factor I, Past Experience, the definition of relevant is the same.

c. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror shall be determined to have unknown (or neutral) past performance.

d. Evaluators may consider any data in the above in determining the performance rating in conjunction with the completed surveys provided by past customers. Government evaluators may contact your points of contact/references for the projects submitted to verify an Offeror’s past performance on these projects. In addition, the Government may use personal knowledge or information from other sources, such as agency performance databases and Government construction administration personnel, in its evaluation of an Offeror’s past performance. The Government may use data provided by the Offeror and data obtained from other sources.

e. In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to: past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.

f. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror

EVALUATION Factor III Past Performance. All offerors will receive one of the following Adjectival Ratings for Factor III:

Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. (See note below)

Unacceptable Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

To receive an “ACCEPTABLE” rating for Factor III, the Government must have a reasonable expectation that the offeror will successfully perform the required effort or the offeror's performance record is unknown. Offerors with unknown past performance will receive a neutral evaluation, resulting in an “ACCEPTABLE” rating.

5. FACTOR IV – PRICE. Only offerors whose proposals are evaluated to be technically acceptable on all factors will be evaluated for price. The lowest price technically acceptable offer will be awarded the contract for this solicitation. Only a responsible offer in accordance with FAR 9.1 will be eligible for award.

a. The price proposal will be evaluated separately from the non-price factors. An assessment of the reasonableness of each proposed price will be made. In the evaluation of the price, various techniques and procedures may be used to ensure a fair and reasonable price. However, if the Contracting Officer determines that information on competitive proposed prices or previous contract prices is not available or is insufficient to determine that the price is fair and reasonable, the Contracting Officer may use technique as appropriate to the circumstances applicable to this acquisition.

b. Unrealistic, unbalanced, or unreasonable pricing may cause a proposal to be determined unacceptable.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
