Details of the lockwalls are given in the reference drawings. The Contractor shall submit calculations and the above sketches, sealed by a registered Structural Engineer in the State of Illinois, which clearly indicate that the structure can support any and all proposed construction loads for any crane proposed for the work. The Contractor shall have these calculations checked independently by a second registered Structural Engineer, of the same or of a different firm, prior to submittal to the Government. The sealed computations shall include seal and identification of the checking Engineer as well as the Engineer performing the computations and sketches. The sealed calculations and sketches shall be submitted as part of the Work Plan.

Duration of the closure period will not be extended due to weather or river conditions. The Contractor may be required to schedule work using multiple shifts, multiple crew operations, and work weekends in order to complete the work. During the period of this construction contract, work may be accomplished during the scheduled winter closure period using cold weather construction methods, such as providing building enclosures and heating work areas. The Contractor shall bid the job as specified, assuming river transport will be available.

The Contractor shall be responsible for monitoring river conditions. All impacts to navigation, including but not limited to, winter closure period and 24-hr closure periods shall be coordinated with the Lockmaster and Contracting Officer and shall be approved by the Contracting Officer. Also, any construction operations which impede lock operations outside the scheduled lock closures will not be allowed unless coordinated with the Lockmaster and Contracting Officer. Upon identification of any required impacts to navigation or changes in any previously scheduled impacts to navigation, the Contractor shall inform and coordinate with the Lockmaster and Contracting Officer as soon as possible, but no later than 7 days prior to the scheduled impact. The Contracting Officer shall be given sufficient time to review and approve any changes.

The Contractor shall perform and complete all work requiring a closure of the lock chamber during the 90 day period from January 1, 2023 to March 31, 2023. Each day the contractor requires the chamber to be closed in order to perform associated work after March 31, 2023 will be subject to liquidated damages as provided in Contract Clause 52.211-12 Liquidated Damages - Construction.

(2) The Contractor shall allow seven (7) days for Government personnel to perform operational function and control equipment tests prior to the end of the winter closure. 1.29 CONTRACTOR PERFORMANCE EVALUATIONS

In accordance with the provisions of Subpart 36.201(Evaluation of Contractor Performance) of the Federal Acquisition Regulation (FAR), construction contractor's performance shall be evaluated throughout the performance of the contract. The United States Army Corps of Engineers (USACE) follows the procedures outlined in Engineering Regulation 415-1-17 to fulfill this FAR requirement. For construction contracts awarded at or above $100,000.00, the USACE will evaluate contractor's performance and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), which is a web-based system. After an evaluation (interim or final) is written up by the USACE, the contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. Accessing and using CPARS requires specific software, called PKI certification, which is installed on the user's computer. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. The certification software could cost approximately $110 - $125 per certificate per year and is purchased from an External Certificate Authorities (ECA) vendor.

Current information about the PKI certification process and for contacting vendors can be found on the web site: http://www.cpars.navy.mil/. If the Contractor wishes to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.
