CONTRACTOR QUESTIONS

See attached questions with Government responses.

1. Form SF1442, Section 11 states a mandatory performance period of 365 calendar days after receiving Notice to Proceed while Section 00 10 00, Part L states that the Government intends to award a Form Fixed Price Construction contract for a period of performance of approximately 250 days from date of award. As these two dates may not coincide based on the stated evaluation period of 60 days, please confirm which performance period will control the Contractor's proposed schedule.

Response: Period of Performance has been updated per Amendment 003. The period of performance has been updated to 575 Days. The SF1442 Section 11 and Section 00 10 00 will be updated accordingly.

2. Please clarify the frequency at which the downstream miter gates can be operated during the closure period in support of regular construction activities including transport of construction materials, equipment, and demolition debris to and from the lock chamber/overlook work area.

Response: The paragraph discussing the operation of the downstream miter gate in Specification 00 08 00 has been updated to the following, “The main lock upstream lift gate leaves are to be completely submerged and sitting on the bottom of the lock chamber with the hoisting wire ropes slightly slacked for the duration of the closure. The main lock downstream miter gate is to be closed for the duration of the closure with the emptying valves in the open position but may be operated at the request of the Contractor. The Contractor shall notify the Contracting Officer’s Representative and Lockmaster a minimum of three hours prior to the need for movement of the downstream miter gate. Movement of the downstream miter gate will only be performed in daylight hours.

The Contractor shall be responsible for providing temporary power for the operating the downstream miter gate.”

This Specification has been updated in Amendment 003.

3. Please clarify if access from the boat ramp located downstream of the Jerry F. Costello National Great Rivers Research and Education Center Confluence Field Station on the Illinois side of the lock and dam will be permitted for launching of floating plant and transport of construction materials and debris for disposal.

Response: The boat ramp indicated in the question is not available for use.

4. Please clarify if access from the boat ramp located downstream of the lock and dam on the Missouri side via Riverlands Dr will be permitted for launching of floating plant and transport of construction materials and debris for disposal.

Response: The boat ramp indicated in the question is available for use.

5. We request a secondary site visit for key subcontractors on July 13th or at the earliest date convenient for

USACE.

Response: Via Amendment 0002, the second opportunity to see the site will occur on Friday, 16 July 2021 starting at 0900. Meeting place will be parking lot in front of the National Great Rivers Museum.

6. Due to the complexity of the project and the level of effort required to fulfill the Small Business participation requirements, we respectfully request that the bid date of July 23, 2021 be extended 14 calendar days for a revised date of August 6th, 2021.

Response: The bid due date is 26 July 2021 by 1000. The date to ask additional questions will not be extended.

7. Given the relatively lengthy reach-back period (10 years) for Factor 2 – Past Performance, will the Government allow for submittal of completed CPAR or CCASS evaluations in lieu of Past Performance Questionnaires (PPQs)? Completed PPQs may be difficult to obtain from references of older projects that may no longer be at the district/agency.

Response: The Government will not accept CPAR or CCASS evaluations in lieu of PPQs.

8. Appendix F, Responsibility Determination Form is provided on page 40 of the solicitation but it is not listed in Section L as a required proposal submittal document. Please confirm that this document is to be completed and submitted with offerors’ proposals and specify which volume it is to be included with.

Response: Volume III

9. On page 22 under the section TAB C: SAM Representations & Certifications, it reads, “Additionally, the offeror must also complete and return the ‘Representations, Certifications, and Other Statements of Offerors’ included in the solicitation” but this section does not appear to be included in the solicitation. Can you provide this section with a forthcoming amendment or amend the solicitation to eliminate this additional requirement?

Response: This statement has been removed from the Solicitation in Amendment 0003.

10. For the following reasons, we request USACE extend the bid due date by at least 2-weeks:

• Under Amendment 1, the Government changed the lock closure period from April 18, 2022 thru July 1, 2022 to January 1, 2023 thru March 16, 2023. This change has significant impacts to the work planning, such as developing methods for placing concrete during cold weather conditions.

• Inquiries related to the solicitation must be submitted no later than July 13, 2021. This is a very short period of time for the Government to review and respond to questions and for the Contractors to incorporate Government responses into their proposals by the July 23, 2021 proposal closing date.

• Extensive market research and subcontractor outreach required to develop a small business participation plan meeting the solicitation requirements.

Please provide a response to this question as soon as is feasible for the Government so that Contractors can plan the development of their proposals accordingly.

Response: The bid due date is 26 July 2021 by 1000.

11. Please provide the date on which the Government expects to award the contract. This is not specified in the solicitation and is necessary for work planning the preconstruction activities leading up to the lock closure.

Response: 30 September 2021

12. Re: FAR 252.204-7012 included by reference. Whenever DoD provides information to contractors, it must identify whether any of the information is Controlled Unclassified Information (CUI) via the contracting vehicle, in whole or part, and mark such documents, material, or media in accordance with this issuance. We do not see any information in the solicitation marked CUI, nor does the solicitation or the associated scope of work or specification indicate that any information to be provided by the government to the contractor and/or to be developed by the contractor will contain CUI. Please confirm that neither this solicitation nor the resultant contract will require the handling of CUI to include Covered Defense Information as defined in DFARS 252.204-7012.

Response: FAR 252.204-7012 Safeguarding Covered Defense Information and Cyber Incident Report applies to the project.

13. Weather depending, can the two (2) Tainter gates between the locks be controlled during the closure, to allow better access for the Contractor?

Response: Specification 00 08 00 Paragraph 20 has been updated to include the following in Amendment 0003, “Adjustment of the Tainter gates between the main lock chamber and the auxiliary lock chamber will be attempted by the Government to minimize turbulence for floating plants outside of the main lock chamber.

River conditions may make adjusting and/or closing of both gates difficult. All requests by the Contractor, with respect to the Tainter gate settings shall be coordinated with the Lockmaster. The Lockmaster is responsible for maintaining safety and operability of the lock and will only concur and direct gate change settings as determined safe by the lockmaster.”

14. Where is the designated contractor load-out area and laydown yard?

Response: See G-004.1 and G-005.1 for details regarding the construction staging and laydown yard.

15. Contract drawing AR-104 calls to remove and re-install existing kitchen appliances, whereas contract drawing AR-204 calls to provide new kitchen appliances. Please clarify.

Response: Existing appliances are to be re-installed. Notes on AR-204.1 have been updated.

16. Where is the concrete truck wash-out area located?

Response: The Contractor may use a portion of the construction staging and laydown yard as the concrete truck wash-out area. See G-004.1 and G-005.1 for details regarding the construction staging and laydown yard.

17. Can the access bridge and associated elevator be used for personnel and small tools/equipment access?

Response: The Contractor may use the access bridge and associated elevator for personnel and small tools and equipment.

18. Within the RFP, there is conflicting information on the contract duration. Page 1 states the contract duration is 365 days, whereas page 12 states the contract duration is 250 days. Please clarify.

Response: Updated Period of Performance will be 575 Days.

19. Can the lift gate cables be relaxed during the lock closure?

Response: The wire ropes from the lift gate leaves to the hoisting machinery will be slightly slacked when the lift gate leaves are submerged and placed on the lock chamber floor. The Government is unable to slack the wire ropes from the lift gate leaves to the counterweight; these are the wire ropes that go over the breezeway on both sides of the lock chamber.

20. Can the Contractor use the boat ramp located directly downstream of the dam on the Missouri side of the river, strictly for concrete load out? See sketch below.

Response: Response: See G-004.1 and G-005.1 for details regarding the construction staging and laydown yard.

21. Can the USACE bulkhead barges be moved from the dock that is for Contractor loadout?

Response: The bulkhead barge may be transferred over to the Contractor to relocate at the Project and maintain during the duration of the contract. The relocated position of the bulkhead barges is subject to Government approval.

22. Is it possible for Contractors to receive an additional site visit?

Response: Via Amendment 0002, the second opportunity to see the site will occur on Friday, 16 July 2021 starting at 0900. Meeting place will be parking lot in front of the National Great Rivers Museum.

23. Can USACE provide a load rating for the grating spanning the TV pits?

Response: The grating above the culvert valve bulkhead slots and above the culvert valve pit was designed for a maximum wheel load with impact of 5118 pounds, a maximum outrigger loading with impact of 9055 pounds, and a live load of 85 psf. Per Specification 00 08 00 Paragraph 20, the Contractor is required to submit sealed calculations and drawings for any crane out-rigger loads on top of the lockwall, which includes the grating on top of lockwall. Reference drawings showing the grating has been included in R-140.1 through R-146.1

24. Please identify all lock areas that are off limits for Contractor use.

Response: The administration building, visitor center, maintenance shed, and crows nest are off limits to the Contractor.

25. What is the expected/historical barge traffic for the contract lock closure period?

Response: The expected average number of daily tows through the auxiliary lock chamber during the contract closure period is 8 to 12 tows.

26. What should Contractors expect for ice build-up?

Response: The amount of ice downstream of the dam and inside the lock chamber is completely dependent on weather conditions in the area and upstream. Specification 00 08 00 Paragraph 20 has been updated to include the following in Amendment 0003, “The Contractor is advised there is a potential for unexpected movement of pool ice during the months of December through March. The Contractor should further be aware that the pool ice can become so thick that work may not be able to be performed upstream of the lock and dam. Any equipment and especially vessels that are captured by the ice will be subjected to severe damage or destruction.

The lockmaster will attempt to provide advance notice of ice movement as a courtesy to the Contractor. The failure of the Government to issue such a notice will not entitle the Contractor to seek damages against the Government. Considerable amounts of ice may be encountered while moving equipment on the river and in the locks. Durations of the winter closure period will not be extended due to weather or river conditions.”

27. Does the substation located near the Contractor and client trailer locations belong to USACE or Ameren?

Response: The site substation is defined in the O&M Manual as the “Utility Substation” and the “Main Substation”. The Utility Substation includes a utility-owned transformer and the Main Substation includes USACE-owned 5kV switchgear providing metering and main circuit breaker for the entire facility.

28. Will the Contractor be eligible for priority locking during the project duration?

Response: The Contractor will not be given priority over other waterway users for lockages. The Contractor shall adhere to normal queuing procedures as required unless otherwise permitted by the Lockmaster.

29. Due to the new lock closure dates falling in the winter, is USACE willing to extend the lock chamber closure from 75 days to a longer closure period (100 days or greater) to account for reduced productivity and potential weather days lost during cold weather months?

Response: The contract lock closure period has been extended to 31 March 2023.

30. Would the Government consider changing the lock closure back to the initial period of April 18, 2022 thru July 1, 2022 to avoid potential adverse production, cost and schedule impacts associated with the challenges of working during the winter months?

Response: The contract lock closure period is as specified in Amendment 0003.

31. We request the Government consider including an escalation clause in the contract, as of the bid due date, due to the extreme volatility of pricing currently being experienced with lumber and steel and to ensure consistency in the overall pricing of proposals submitted by the Offerors.

Response: Clause will be added to the Solicitation.

32. In the contract drawings, sheet ED-107 sheet key notes 2-6 list the features that need to be provided temporary power. Which of these need to be powered full time, and which can be powered on under an as needed basis? Furthermore, if any of these need to be powered full time, what features of each MCC/PDP need to be powered full time?

Response: Equipment listed in sheet keynotes 2-6 on sheet ED-107 need to have the required rated temp power, as indicated, available full time. Critical loads that need to be powered full time are listed in general sheet note 3 on sheet ED-107. Power and control for the dam shall be available full time, except for temporary outages not exceeding 4 hours as stated in Section 00 08 00 para 1.20 (B)(5).

33. Re: Tab B, Factor 2, Past Performance. Can CPARs be used instead of a PPQ for USACE projects?

Response: The Government will not accept CPAR or CCASS evaluations in lieu of PPQs.

34. Re: e-mail submittal of the proposal. What is the USACE size limit on e-mails?

Response: The email size limit is approximately 15MB.

35. Can the Gantt chart schedule required as part of the Work Plan be submitted on an 11 x 17 page? Is the schedule counted in the page limit?

Response: Section L of the solicitation indicates that schedules are not considered in the page limits and indicates not to use 11”x17”.

36. Per ED-601 facility distribution system is backed-up by 900 kW diesel engine/generator. Per temporary electric notes on ED-107 emergency generation source is not detailed. Will a back-up emergency generation source be required for the temporary electric distribution system?

Response: Back-up emergency power source to the required temporary power system is not required. However, the contractor shall maintain and monitor the temp power system to ensure downtime is limited to 8 hours for select items as indicated in Section 00 08 00 para 1.20 (A)(20) and outages to the Dam power and control are limited to 4 hours as stated in Section 00 08 00 para 1.20 (B)(5).

37. Section 10 14 00, Part 2.1 states that existing signage is to be removed and reused and Part 3.1 states that items showing visual evidence of biological growth should not be reinstalled. Please clarify the anticipated number of signs that will need to be completely replaced due to biological growth or clarify how costs for replacement signage will be addressed.

Response: It is not anticipated that biological growth will be on signage. Contractor shall store signage to protect them from damage, including dirt, mold, etc. Signs shall be cleaned prior to reinstallation. See updated Section 10 14 00.20-3.1.

38. Section 01 22 00, Part 1.1 states that project mobilization should be priced for all operations as degined in Section 00 70 00 Contract Clause Payment for Mobilization and Demobilization. Section 00 70 00 has not been included in the project specifications, please provide.

Response: See clause 252.236-7004 PAYMENT FOR MOBILIZATION AND DEMOBILIZATION (DEC 1991) on page 66 of 87 in the solicitation.

39. Re: Tab B, Factor 2, Past Performance. Please confirm that substantially complete (90%+) projects are acceptable as past performance examples.

Response: Substantially complete projects are acceptable as past performance examples.

40. Is City water readily available to the Contractor at the Melvin Price Project? If City water is readily available on-site, where is it located and what is the source? If City water is not readily available, is there an on-site source the Contractor can utilize, such as a fire hydrant? Alternatively, would the Government consider allowing the Contractor to utilize the Government’s on-site water source under an agreement where the

Contractor reimburses the Government based on the Contractor’s usage. Response: The Government will not provide access to a water source.

41. Please consider extending the 45-day preparatory work period, prior to the schedule lock closure, to allow the Contractor additional time to complete tasks that do not require the lock closure. Considering the preparatory work period will occur during the 2022 winter holidays, please consider extending the preparatory work period from 45-days to 75-90 days or greater if feasible.

Response: Specification 00 08 00 Paragraph 20 has been updated in Amendment 0003 changing the preparatory work period from 45 days to 90 days.
