BIDDING SCHEDULE NOTES

1. All quantities shown on the BIDDING SCHEDULE are estimated quantities except when the unit is shown as job "JB".

2. When bids are solicited on a unit price basis, bidders shall insert in the spaces provided therefor in the SCHEDULE both the "unit price" and the "estimated amount" resulting from applying the said unit price to the estimated quantity shown. In event the bidder quotes only a total price ("estimated amount") in its bid and fails to quote the unit price, the Government will determine such unit price by dividing the total price quoted by the quantity of the item set out in the SCHEDULE. The bidder agrees that the unit price so determined shall be used for the purpose of bid evaluation, award and all payments to the Contractor including final payment.

3. All extensions of the unit prices shown will be subject to verification by the Government. In case of variation between the unit price and the extension, the unit price will be considered to be the bid and the extension will be corrected accordingly.

4. If a modification to a bid based on unit prices is submitted, which provides for a lump sum adjustment to the total estimated cost, the application of the lump sum adjustment to each unit price in the bid schedule must be stated. If it is not stated, the bidder agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the bid schedule.

5. Bidders are required to bid on all items listed on the Bidding Schedule in addition to inserting a total quoted bid in the appropriate space provided. Failure to do so will be considered good cause to disqualify the bid.

RATING DEFINITION NOTE

(E) Exceptional

(VG) Very Good

Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the feature or sub-factor being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the feature or sub-factor being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

A Very Good rating is appropriate when the Contractor successfully performed a Significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the feature or sub- factor contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems or major problems that the contractor recovered from without impact to the contract.

There should have been NO significant weaknesses identified.

Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the feature or sub- factor being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the feature or sub-factor contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

No information or did not apply to your contract

Rating will be neither positive nor negative.

• Joint Venture Agreements

For the purpose of this evaluation, past performance means an offeror’s reputation for satisfying its customers by delivering (i) quality work (ii) in a timely manner (iii) at a reasonable cost (iv) in a safe working environment, as well as its reputation for (v) reasonable and cooperative conduct, and (vi) overall commitment to customer satisfaction. To determine confidence and relevancy ratings on the past performance, each project submitted must include an Experience Information Form (Experience on Relevant Projects), with the corresponding Past Performance Questionnaire (PPQ).

Past performance is a measure of the degree to which an Offeror, as an organization, has, during the past ten (10) years: (1) satisfied its customers, and (2) complied with federal, state, and local laws and regulations.

Offeror(s) shall submit the following information as a part of their proposal:

Projects submitted may include those entered into by other departments and agencies of the Federal Government; projects with state and local governments; and projects with commercial customers. While the Government will consider past performance and experience information on relevant projects performed for state and local Governments, as well as in commercial sector, past performance and experience conducted with Federal Agencies will receive greater consideration when assigning a past performance confidence assessment rating than those for work performed for organizations other than Federal Agencies.

For each project submitted along with an Experience Form ensure the following information is also provided in a tabulated format:

• Name of contracting activity;

• Points of contact (2 – names, current phone numbers);

Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Angie Grimes via email at Angie.L.Grimes@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations. This does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offeror may also include performance recognition documents received within the last ten (10) years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition. These performance recognition documents, if submitted, are included in the Past Performance page count.

The required PPQ form is provided in Section L, Appendix A. PPQs will not be included in the page count.

NOTE: For purposes of evaluating past performance, the Prime Contractor is defined as the contractor identified in Block 14 of the Standard Form 1442. Projects performed by contractors other than the offeror, including, but not limited to, teaming partners, subcontractors, sister or parent companies, and affiliates will not be evaluated for past performance, unless those other contractors are part of a joint venture or teaming arrangement offeror as demonstrated by a signed joint venture/teaming arrangement agreement. If more than one contractor is listed in Block 14, then a signed joint venture/teaming arrangement agreement must be submitted with the proposal and the joint venture shall be registered as such in the System for Award Management (SAM). SAM registration shall be finalized prior to award. However, each party of the Joint Venture (JV) must submit their own Unique Entity Identifier Number (formerly known as DUNS) with the JV Proposal.
