Approval by the Contracting Officer may be granted after appropriate coordination by St. Louis District with the U.S. Fish and Wildlife Service has been conducted, and it is determined that clearing can be performed without impacting trees suitable for Indiana bat habitat. In the event bats or habitat could be impacted, the time fixed for completion of the contract will be extended for the period of the time delay for Government mitigation of the presence of bats or habitat.
(3) Bald Eagle Roosts. There are no known Bald Eagle nests in close proximity to the project area. Should bald eagle nesting activity be observed, the Contractor shall contact the Contracting Officer immediately to determine if any buffer zones or access restrictions will be required for construction operations. The time fixed for completion of the contract will be extended for the period of the time delay for work impacted by any restrictions. Should nesting activity be found in the vicinity of work, the following restrictions will be required:
(i) The contractor shall inform the contracting officer of any potential nesting activity within the construction footprint, or if a nest appears to no longer be active or is not occupied by April 15th;
the contracting officer shall provide written determination of any additional nesting trees or any reduction to current limitations.
(ii) If any new roosting trees are found within the construction limits, avoid damaging the critical root zone of the bald eagle nest tree as defined by the circle around the ground corresponding to the drip line of the bald eagle nest tree, or out to a distance of 1.5 feet per inch of diameter at breast height (DBH), whichever is greater. Where possible, leave mature roosting trees intact.
DOCUMENT 00 08 00 Page 9
(iii) No construction equipment shall be staged within 330 feet of the bald eagle nest tree. Sequence project activities in a manner where work within the 330 foot buffer of the bald eagle nest can be completed as quickly as possible.
(iv) Where possible, equipment will drive past the bald eagle nest tree without stopping and at a constant speed.
(v) Plastic netting shall not be used for any activities -including erosion control - to prevent bald eagle entanglement.
(vi) During bald eagle breeding season (November 15 through August 31), project work within the 330 foot buffer around the bald eagle nest will not start until 1 hour after sunrise and will end 1 hour before sunset to reduce ambient temperatures effect on bald eaglets if their parents flush. This measure is no longer necessary if high temperature for the day reaches 50 degrees F for two days in a row or the bald eagle nest is confirmed not active any given year (as evidenced by an absence of bald eagles from their nests for ten consecutive days during the bald eagle breeding season).
(g) Final Survey. The contractor shall provide surveys of completed features prior to final acceptance. Such surveys will be used to document the as-built condition and ensure features are within design tolerances.
