C21.1 This contract conveys the basic requirements, performance standards and assessment measures that will apply to the contract. The Contractor shall perform in accordance with the requirements of this PWS. The service requirements are summarized into performance objectives. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. The event summary request outlines more specific event needs.

C21.2. Government Remedies. The Contracting Officer shall follow the requirements of FAR 52.246-4, Inspection of Services - Fixed-Price (AUG 1996) for Contractor’s failure to correct non-conforming services. In the event that services fail to conform to contract requirements and cannot be remedied by re-performance, the Government reserves the right to reduce the contract price to reflect the reduced value of the non-conforming services. The Government will notify the Contractor of weaknesses or discrepancies as they become apparent. The first notification will be to attempt to obtain re-performance if possible. Deficiencies that exceed the SDS acceptable levels will be issued on a Contract Discrepancy Report.

C21.3. Evaluation of Contractor’s Performance. (Reference FAR 52.246-4, Inspection of Services – Fixed Price). The Contractor’s performance will be evaluated during and at the conclusion of the event. For those tasks listed in the Service Delivery Summary (SDS), the KO and/or the COR will follow the methods of surveillance specified in the Government’s Quality Assurance Surveillance Plan (QASP). Government personnel will record all surveillance observations. When an observation indicates defective performance, the COR will require the Contractor or Contractor’s appointed Manager to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only the acknowledgment that they have been made aware of the defective performance. Interim evaluations may be prepared at any time during contract performance when determined to be in the best interest of the Government.

C21.4. In the event the Contractor is unable to fulfill requirements in a timely manner, the Government reserves the right to obtain services from another source. A pattern of continued inability to fulfill requirements may constitute the basis for considering remedies under Termination clauses or for not exercising an option period. This is not a requirements contract and the Government reserves the right to obtain services from other sources.

C21.5. The awarded contractor will be required to comply with the Army's policy for Contractor Manpower Reporting. The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The contractor is allowed a onetime fee for the administrative cost associated with providing the information online. The contractor is required to completely fill in all the information in the format using the following web address: https://contractormanpower.army.pentagon.mil:

APPENDIX E: BH Reports and Risk Level

BH Requests for FMR Process & Reporting Improvement

Contractor Level

• Better identifiers/specifics from contractor printout (spreadsheet of psychosocial assessments conducted) on which cases need follow-ups so that CPT Wayne Marrs (Psychological Health Coordinator for TXARNG) can appropriately assign the cases (wayne.d.marrs.mil@mail.mil)

• Send spreadsheet at end of the event encrypted to MAJ Geoffrey Powell (Geoffrey.i.powell.mil@mail.mil ) o Provide a column indicating SM’s full name, last four digits of SS #, phone number, SM city of residence, current risk level, if red- what was done.

o If risk level is orange or red, create a profile template (will be reviewed and signed by a profiling officer). These need to be made a priority, with the psychosocial assessments uploaded into HRR same day as event for orange/red cases.

o Follow protocol in place for red soldiers, as a risk assessment is needed and hospitalization may result.

o All psychosocial assessments should be uploaded into HRR in timely fashion, with orange/red assessments uploaded by end of the day that SM was seen.
