a. "Adverse weather" occurs when atmospheric conditions at a definite time and place that are unfavorable to construction activities and is based on climatological and meteorological observations and data sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA.

b. "Unusually severe weather" is weather that is more severe than the adverse weather anticipated by the Contractor for the season or location involved. Adverse weather delays are considered unusually severe weather if adverse weather delay days prevent work for 50 percent or more of the Contractor's scheduled work day.

1.3 WORK COVERED BY CONTRACT DOCUMENTS

1.3.1 Project Description

Contract work is split between a base and two options which consists of dredging beach compatible sand from the Sand Bypass Dredging Area (SBDA) and transporting the dredged material to a designated beach placement site south of the inlet. The placement of material will be uniform alongshore in accordance with the elevations and slopes indicated on the drawings.

Project work has been completed four times in the past using a pipeline cutter suction dredge approximately bypassing 3.4 million cubic yards. It is anticipated, work for this project will use the same type dredge and the pipeline trench will need to be excavated under the required depth of

SECTION 01 11 00 Page 2

Canaveral Harbor navigation channel. Material dredged to construct the pipeline trench shall be side-casted within Canaveral Harbor Channel.

Historically, maintenance dredging, shoal material above -47 feet MLLW, within Canaveral Harbor has been completed by a Clam Shell dredge and barged to the ODMDS site for disposal. Channel material below -47 feet MLLW is considered construction dredging is only permitted for in channel placement. The Contractor shall side cast all construction dredging material for the pipeline trench and barge the maintenance dredging material to the ODMDS. The maintenance dredging area within the channel will be 150 feet on either side of the selected pipeline excavation trench.

It is anticipated this work will be done by the same means where additional environmental restrictions will be needed when operating a clam shell dredge. At the beach placement site, incidental work includes beach tilling, turbidity monitoring, vibration control monitoring, bird monitoring, and environmental species monitoring. At the SBDA, there will be no vibration monitoring, and the 45th space wing will be conducting daily turtle and seabird monitoring and the Contractor is expected to coordinate with the 45th space wing on a daily basis during construction.

1.3.2 Location

The work is located north and south of the Canaveral Harbor Entrance Channel as shown on the drawings.

1.3.3 Measurement and Payment

The Government will pay the Contractor for the services performed by the Contractor, as set forth in SECTION 00010A LINE ITEMS AND PRICING SCHEDULE.

Section 01 22 00 MEASUREMENT AND PAYMENT describes how line items will be measured and paid for when making progress payments.

1.3.4 Project Administration

Section 01 30 00 ADMINISTRATIVE PROCEDURES provides guidance on how project administration is to be conducted on this project such as project coordination, partnering, and meetings. Project coordination work performed by others is also covered in this section.

1.3.5 Project Schedule

The Contractor shall prepare and submit to the Contracting Officer a practicable schedule showing the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the features of the work as indicated in the specifications and plans. Schedule provided shall also indicated adverse weather delays. Specific schedule details are provided in Section

01 32 01.10 PROJECT SCHEDULE.

1.3.6 Project Submittal Register

The Contractor is required to submit various submittals to the Government in accordance with the time frames as specified in these contract documents. Section 01 33 00 SUBMITTAL PROCEDURES provides contractual guidance to the Contractor on the various submittal types, procedures and guidelines. Government recognizes the large list of submittals throughout the contract, so a submittal register is appended at the end of Section

01 33 00 SUBMITTAL PROCEDURES.

SECTION 01 11 00 Page 3

1.3.7 Diving Safety Requirements

The Contractor will be required to submit a Dive Plan when work is performed on or over water. Please refer to Section 01 35 25 OWNER SAFETY

The Contractor is expected to outline their safety plan in Accident Prevention Plan (APP) specificall geared for the project work about to be commenced. For further details on submitting an APP and other safety requirements, please refer to Section 01 35 26 GOVERNMENT SAFETY REQUIREMENTS and EM 385-1-1.

1.3.9 Quality Control Requirements

The Contractor is responsible for quality control for the project and shall use Government-furnished "Quality Control System (QCS)" software. The QCS software is the means by which the Contractor assures the Contracting Officer the work performed by the Contractor complies with the requirements of the specifications, plans, and all project permits, with respect to the quality of placed sediment, materials, workmanship, construction, finish, and functional performance. Refer to Section 01 45 05 CONTRACTOR QUALITY CONTROL for further details on QCS system and implementation requirements.

1.3.10 Temporary Construction Facilities

The Contractor's use of premises during the course of contract work shall attempt to fully minimize the physical, visual and operational impact to the project area, vicinity, and surrounding public. To accomplish this, refer to Section 01 50 02 TEMPORARY CONSTRUCTION FACILITIES.

1.3.11 Environmental Protection

The Contractor shall protect the environment during all phases of the project. See Section 01 57 20 ENVIRONMENTAL PROTECTION.

1.3.12 Water Quality

The Contractor shall exercise extreme care as not to degrade water quality at dredge and placement locations. All required provisions shall be provided to insure compliance with all water quality standards of the State of Florida and associated Agencies. Attention is called to Chapter 17-3, Florida Administrative Code, and in particular, the turbidity requirements specified in Section 01 57 25 TURBIDITY AND DISPOSAL MONITORING.

From the monuments, control data and elevations established by the Government, the Contractor shall complete the layout of the work and shall be responsible for all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.8.3 Survey

The Contractor shall furnish, at his own expense, such stakes, templates, SECTION 01 11 00 Page 6 platforms, equipment, tools and material, and all labor as may be required in laying out any part of the work from the monuments, control data and elevations established by the Government. It shall be the responsibility of the Contractor to maintain and preserve all stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks are destroyed by the Contractor or through his negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at his discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor. The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.9 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by adverse weather (i.e., severe thunderstorms, straight line winds, flood, earthquake, hurricane, or tornados), which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.10 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month as demonstrated in writing by the Contractor and approved by the Contracting Officer.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.10.1 Schedule of Monthly Anticipated Adverse Weather Delays

The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather

SECTION 01 11 00 Page 7 time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities.

See Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA to obtain MONTHLY

ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON 5-DAY WORK WEEK. A

reasonable number of anticipated weather delay work days is obtained from the average number of days per month with precipitation greater than that indicated in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA rounded to the nearest whole number.

1.10.2 Contractor Responsibility

The project area may be affected by stormy seas, windy and/or rainy weather, including thunderstorms, during any time of the year. The Contractor shall be responsible for obtaining information concerning rain, wind and wave conditions that could influence safety, dredging and placement operations prior to submitting a proposal or bid. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities. A list of potential sources providing climatological and meteorological observations and data for the project area is provided.

a. Contractor shall research the project site conditions and incorporate potential adverse weather delays into their schedule prior to submitting a proposal or bid. The Contractor shall develop a schedule of monthly anticipated adverse weather based on the equipment to be used to complete the project and determine the conditions that would cause them to cease operations using the sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities.

b. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report the occurrence of adverse weather and unusually severe weather with the purpose to note impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's schedule to be considered "unusually severe weather".

c. The number of actual adverse weather delay days shall include days impacted by actual adverse weather, be calculated chronologically from the first to the last day of each month, and be recorded as full days.

If the number of actual adverse weather delay days exceeds the number of days anticipated for adverse weather by the Contractor, the Contracting Officer may convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days that should have been anticipated for the conditions at the project location.

The term "area designated by the Contracting Officer" as used in the CONTINUITY OF WORK paragraph, is defined as "Acceptance Section".

c. Hydrographic (soundings) and topographic surveys for final payment purposes will be made by the Government. The Contracting Officer will select the type of survey to be performed (single-beam

vs. multi-beam) and the transducer frequency to be used. Once the survey method (type and transducer frequency) is selected, the government will strive to use the selected method throughout the contract period. However, the Contracting Officer reserves the right to change the survey method at any time according to his sole

SECTION 01 22 00 Page 5 discretion. All surveys will be performed in accordance with USACE EM 1110-2-1003. Survey frequencies will be the same as those shown in the drawings and will remain consistent throughout the contract.

1.5.1.2 Measurement

a. The maps and/or drawings already prepared (clause CONTRACT DRAWINGS, MAPS, AND SPECIFICATIONS of Section 00700 CONTRACT CLAUSES in Volume 1) are believed to represent accurately average existing conditions, but the depths shown thereon may be verified and corrected by soundings taken before dredging. Once quantities within a specified reach or section have been determined through the use of in-place measurement, they will not be reopened except on evidence of collusion, fraud, or obvious error.

b. The total amount of material removed from the SBDA excavation payment limits, and to be paid for under the contract, will be measured by the cubic yard in place and quantities determined by the average end area method. The volume computed shall be between the bottom surface shown by soundings taken within 72 hours before dredging and the bottom surface shown by the soundings taken within 72 hours after the work specified in each acceptance section has been completed. The Contractor shall give 72 hours advance notice, in writing, to the Contracting Officer's Representative of the need for a pre-dredging survey or after-dredging survey for final acceptance for each acceptance section. The quantity shall include the volume within the limits of the side slopes described in subparagraph "Side Slopes" of paragraph EXCAVATION of Section 35 20 23 DREDGING, less any deductions that may be required for misplaced material described in subparagraph "Misplaced Materials" of paragraph PLACEMENT of DREDGED MATERIAL of Section 35 20 23 DREDGING.
