SUMMARY OF CHANGES

SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been modified:

INSTRUCTIONS AND EVAL FACTORS

A. BASIS FOR AWARD

The award will be made based on the best overall (i.e., best value-tradeoff) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the three (3) evaluation factors: Technical, Price, and Past Performance.

All subfactors of Factor I, Technical, are equal in importance to each other. Factor I, Technical, is more important than Factor II, Past Performance. When combined, the non-price factors (Factors I and II) are approximately equal in importance to Factor III, Price. As proposals become more equal in their technical (non-price) merit, the evaluated price becomes more important in determining the best value proposal.

B. FACTORS AND SUB-FACTORS TO BE EVALUATED

The following evaluation factors and sub-factors will be used to evaluate each proposal. Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and sub-factors described below.

1. FACTOR I Technical - The technical evaluation will be comprised of two (2) Sub-Factors.

Risk assesses the degree to which the offeror’s proposed technical approach for the requirements of the solicitation may cause disruption of schedule, increased price, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance. Risk will be evaluated as one aspect of the technical evaluation, inherent in the technical evaluation factor or subfactor ratings.

Subfactor A: Electrical and Controls Construction Experience Subfactor B: Mechanical Construction Experience

The two (2) subfactors are of equal importance.

Evaluation of the offeror’s proposal shall address each subfactor as it applies to the scope of work. A detailed explanation of the criteria for the evaluation is set forth in the Evaluation Approach, Paragraph C of this section. During evaluations of each proposal, the Government will assign each subfactor an adjectival rating and write a narrative evaluation reflecting the identified findings.

2. FACTOR II Past Performance - Each offeror’s current and past performance will be reviewed to determine relevancy and confidence.

3. FACTOR III Price - The resulting award will be a firm-fixed price contract. Price reasonableness will be utilized in the evaluation of the proposal.

C. EVALUATION APPROACH

All proposals will be evaluated by the Source Selection Evaluation Board (SSEB).

1. The overarching evaluation approach for all factors and subfactors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP. Marginal levels of overall detail could indicate a lack of understanding concerning the requirements and may result in the entire factor receiving an unfavorable rating and/or being eliminated from the competitive range.

2. Factor I Technical - This factor is comprised of the following subfactors:

a. Subfactor A: Electrical and Controls Construction Experience

Offerors shall submit the following for Subfactor A:

Proposals will be evaluated to determine electrical and control construction experience for relevant projects of the scope and complexity required in this solicitation. Offerors must demonstrate relevant electrical and controls construction experience of at least three (3) projects within the last five (5) years that include the installation, replacement, or upgrade of power and control features for hoisting systems. Each reference project used to demonstrate electrical and controls construction experience must include relevant scope of work, but is not required to involve all of the fully relevant elements defined in this subfactor. Proposals will be determined to be acceptable if three (3) reference projects combined demonstrate fully relevant experience, as defined in this subfactor. Proposals that demonstrate fully relevant experience across more than three (3) projects will be considered more favorable.

Offerors must demonstrate that the proposed manufacturer of the control and equipment panels is a UL-certified panel shop with a minimum of five (5) years experience in the manufacture of products similar to the type and complexity required by this solicitation.

Use Attachment “Offeror Experience Form” to describe the projects in which the Offeror has relevant electrical and controls construction experience. Provide a description of relevant projects to include the title and location of the project, contract amount, the start and completion dates (or anticipated completion date) of the construction phase of the project, a brief description of the work, the offeror’s specific role on the project, and a point of contact for the project customer/client that includes the person’s name, title, and current phone number. Project descriptions shall include adequate detail to demonstrate the relevancy of the scope of work for comparison to that required in this solicitation.

If the prime contractor proposes self-performing the electrical and controls construction, ensure the proposal is clear that the Offeror will be performing this function. If the prime contractor proposes to use a subcontractor for electrical and controls construction experience, the offeror must submit a Letter of Commitment from the subcontractor with the proposal.

If a subcontractor is proposed, the proposal will be considered more favorable if the proposal contains evidence of the prime and subcontractor working successfully together previously on relevant projects, than an offer with a prime and subcontractor with no prior experience working together on relevant projects.

If a joint venture is proposed, the proposal will be considered more favorable if the proposal contains evidence of the joint venture entity working successfully together previously on relevant projects, than an offer with a joint venture with no prior experience working together on relevant projects.

Fully Relevant Technical Experience for this sub-factor is defined as projects including all of the following:

i. At least 50% physically complete at the time of proposal submission or was completed within the last five (5) years.

ii. Electrical and controls construction which required the installation, replacement, or upgrade of power and control systems for hoisting gates, bridges, or similar structures weighing a minimum of 75 100-tons.

iii. Controls installation, replacement, or upgrade involving: 480V Variable Frequency Drives (VFD) rated 40-200 HP, Programmable Logic Controllers (PLC), Human Machine Interfaces (HMI), synchronization of hoist drive equipment, position indication equipment, and system controls software.

b. Subfactor B: Mechanical Construction Experience

Offerors shall submit the following for Subfactor B:

Proposals will be evaluated to determine mechanical construction experience for relevant projects of the scope and complexity required in this solicitation. Offerors must demonstrate relevant mechanical construction experience of at least three (3) projects within the last ten (10) years. Each reference project used to demonstrate mechanical construction experience must include relevant scope of work, but is not required to involve all of the fully relevant elements defined in this subfactor. Proposals will be determined to be acceptable if three (3) reference projects combined demonstrate fully relevant experience, as define in this subfactor. Proposals that demonstrate fully relevant experience across more than three (3) projects will be considered more favorable.

Offerors must demonstrate relevant experience of at least five (5) years for the proposed designer and manufacturer of pinion gears and shafts. Proposals shall include relevant experience with design and fabrication of gears in accordance with American Gear Manufacturers Association (AGMA) standards. Offerors shall demonstrate relevant experience with laser alignment of equipment shafts and open gear alignment to verify gear tooth contact at working loads.

Offerors must demonstrate relevant experience of at least five (5) years for the proposed source to perform hoist cable tensioning and load balancing with vibrating wire load cells.

Use Attachment “Offeror Experience Form” to describe the projects in which the offeror, subcontractors, and suppliers have relevant mechanical construction experience. Provide a description of relevant projects to include the title and location of the project, contract amount, the start and completion dates (or anticipated completion date) of the construction phase of the project, a brief description of the work, the firm’s specific role on the project, and a point of contact for the project customer/client that includes the person’s name, title, and current phone number. Project descriptions shall include adequate detail to demonstrate the relevancy of the scope of work for comparison to that required in this solicitation.

If the prime contractor proposes self-performing the mechanical construction, ensure the proposal is clear that the offeror will be performing this function. If the prime contractor proposes to use a subcontractor for mechanical construction experience, the offeror must submit a Letter of Commitment from the subcontractor with the proposal.

Fully Relevant Technical Experience for this sub-factor is defined as projects including all of the following:

i. At least 50% physically complete at the time of proposal submission or was completed within the last ten (10) years.

ii. Mechanical construction which required the installation, replacement, or upgrade of hoist machinery for gates, bridges, or similar structures weighing a minimum of 75 100-tons.

iii. Design and fabrication of gears larger than 8 inches in diameter in accordance with American Gear Manufacturers Association (AGMA) standards.

iv. Design and fabrication of shafts larger than 4 inches in diameter.

v. Hoist machinery installation, replacement, or upgrade involving: two-point lift configuration, skew control, tensioning and load balancing for multiple hoist cables, laser alignment of equipment shafts, and gear alignment for open gear sets measuring a minimum of 5 ft center to center.

The Technical Factor Ratings, excerpted below focus on the strengths, deficiencies, weaknesses, risks and uncertainties of the offeror’s proposal. The rating depicts how well the offeror’s proposal meets the Technical subfactor requirements.

Rating Description Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.

Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance.

Risk of unsuccessful performance is no worse than moderate.

Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is not awardable.

3. Factor II - Past Performance - The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the scope of work.

a. Evaluation of past performance shall be in accordance with this solicitation plan utilizing the attached forms and questionnaires set forth in Appendix D.

b. The Government will focus its inquiries on the offeror’s (major subcontractors’ and fabricators’) record of performance as it relates to all solicitation requirements, including price, schedule, performance and management of subcontractors. Major subcontractors are defined as members of an offeror’s overall team who are expected to perform ten (10) percent or more of the proposed effort. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most current and relevant past efforts (within the past six years) in their proposal. Absent any current and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned an “unknown confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the North American Industry Classification System NAICS 237990, Other Heavy and Civil Engineering Construction. Data used in conducting performance risk assessments shall not extend past six years prior to the issue date of the RFP, but may include performance data generated during the past six years without regard to the contract award date.

c. Offerors shall submit all Government and/or commercial contract numbers and descriptions for the prime offeror and each major subcontractor in performance or awarded during the past six years, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources, but is not compelled to rely on all of the information available.

d. The past performance factor considers each offeror’s demonstrated current and relevant past record of performance in supplying products and services that meet the contract requirements.

There are two aspects to the past performance evaluation: relevancy and performance confidence assessment.

(i) RELEVANCY: The Government will conduct a performance assessment based on the relevancy of the Offeror's current and past performance, as well as that of its major subcontractors and fabricators, as it relates to the probability of successful accomplishment of the required effort. These efforts include all aspects of schedule, performance and customer support, including the Offeror’s submitted subcontracting plan for this project and the Offeror’s record of: 1) Conforming to specifications and standards of good workmanship; 2) Maintaining program execution within price; 3) Adherence to contract schedules, including the administrative aspects of performance; 4) Ability to resolve technical and manufacturing problems quickly and effectively; 5) Businesslike concern for the interest of its customers; 6) Establishing and maintaining adequate management of subcontractors; and 7) Compliance with subcontracting plans submitted on previous projects.

Past Performance Relevancy Ratings Rating Definition

Very Relevant Current/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Current/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Current/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Current/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

(i) PERFORMANCE CONFIDENCE ASSESSMENT: The final step is for the team to arrive at a single consensus performance confidence assessment for the offeror, selecting the most appropriate rating from the chart below. This rating considers the assessed quality of the relevant/current efforts gathered (documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment).

Ensure the rationale for the conclusions reached are included.

Performance Confidence Assessments

Rating Definition

Substantial Confidence Based on the offeror’s relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Unknown Confidence (Neutral)

No relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

4. Factor III - Price - The contract will be a Firm Fixed-Price Contract. The Government will evaluate offers for award purposes by evaluating the prices proposed in the Bid Schedule. The Offeror must provide a price proposal by completing the Bid Schedule as instructed in Section 00100.

Firm Fixed Price Requirements

a. The RFP requires firm-fixed-price contract line items. A price reasonableness approach will be utilized by the Government to determine that the proposed prices offered are fair and reasonable and that a “buy-in” or unbalanced pricing between CLINs is not occurring.

b. The Government will examine price proposals for artificially low unit prices. Offers found to be unreasonably high, unrealistically low (an indication of “buy – in”), or unbalanced, may be considered unacceptable and may be rejected on that basis.

D. PROPOSAL SUBMISSION

1. Introduction. The offeror’s proposal shall be submitted in hard copy, with accompanying digital copies, as set forth below. The RFP shall provide the Government address and receipt date for proposal submittal.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner.

There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory

Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable

Rating will be neither positive nor negative.
