The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.
U.S. ARMY CORPS OF ENGINEERS (USACE)
EP 1110-1-8 (2014) Construction Equipment Ownership and Operating Expense Schedule
ER 415-1-15 (1989) Construction Time Extensions for Weather
1.2 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52.211-10)
The Contractor shall be required to (a) commence work under this Contract within ten calendar days after the date the Contractor receives the Notice to Proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than three hundred sixty five (365) calendar days after date of receipt by Contractor of Notice to Proceed. The time stated for completion shall include final cleanup of the premises.
1.3 LIQUIDATED DAMAGES - CONSTRUCTION (FAR 52.211-12)
a. If the Contractor fails to complete the work within the time specified in the Contract, the Contractor shall pay liquidated damages to the Government in the amount of $456.59 for each calendar day of delay until the work is completed or accepted.
b. If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause of the CONTRACT CLAUSES.
1.4 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER
This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the CONTRACT CLAUSE entitled "Default (Fixed Price Construction)". In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:
a. The weather experienced at the project site during the Contract period must be found to be unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.
b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and
DOCUMENT 00 73 00 Page 2 without the fault or negligence of the Contractor.
Per ER 415-1-15, the following schedule of monthly anticipated adverse weather delays is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.
JOINT BASE LEWIS-MCCHORD MONTHLY ANTICIPATED ADVERSE WEATHER DELAY
WORK DAYS BASED ON (5) DAY WORK WEEK
|JAN FEB MAR APR MAY JUN JUL AUG SEP OCT NOV DEC |
| 9 8 8 4 2 3 1 2 4 7 10 10 |
Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the Contract, the Contractor shall record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractors' scheduled work day.
The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated, as mentioned above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Contract clause entitled "Default (Fixed Price Construction)".
1.5 INSURANCE - WORK ON A GOVERNMENT INSTALLATION (FAR 52.228-5)
a. The Contractor shall, at its own expense, provide and maintain during the entire performance period of this Contract, at least the kinds and minimum amounts of insurance required in the Insurance Liability Schedule or elsewhere in the Contract.
b. Before commencing work under this Contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective:
1. For such period as the laws of the State in which this Contract is to be performed prescribe; or
2. Until 30 days after the insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer.
c. The Contractor shall insert the substance of this clause, including this paragraph, in subcontracts under this Contract that require work on a Government installation and shall require subcontractors to provide and maintain the insurance required in the Schedule or elsewhere in the Contract. The Contractor shall maintain a copy of all subcontractors' proofs of required insurance, and shall make copies available to the Contracting Officer upon request.
DOCUMENT 00 73 00 Page 3
1.5.1 REQUIRED INSURANCE IN ACCORDANCE WITH FAR 28.307-2
a. Workers' compensation and employer's liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when Contract operations are so commingled with a Contractor's commercial operation that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in states with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
b. General Liability:
1. The Contracting Officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.
2. Property damage liability insurance shall be required only in special circumstances as determined by the agency.
c. Automobile liability: The Contracting Officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the Contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
d. Aircraft public and passenger liability: When aircraft are used in connection with performing the Contract, the Contracting Officer shall require aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
e. Vessel liability: When Contract performance involves use of vessels, the Contracting Officer shall require, as determined by the agency, vessel collision liability and protection and indemnity liability insurance.
1.5.2 Environmental Liability
If this Contract includes the transport, treatment, storage, or disposal of hazardous material waste the following coverage is required.
The Contractor shall ensure the transporter and disposal facility have liability insurance in effect for claims arising out of the death or bodily injury and property damage from hazardous material/waste transport, treatment, storage and disposal, including vehicle liability and legal defense costs in the amount of $1,000,000.00 as evidenced by a certificate of insurance for General, Automobile, and Environmental Liability Coverage. Proof of this insurance shall be provided to the Contracting

Officer.
1.6 PERFORMANCE OF WORK BY THE CONTRACTOR (FAR 52.236-1)
The Contractor shall perform on the site, and with its own organization, work equivalent to at least fifteen percent (15%) of the total amount of work to be performed under the Contract. The percentage may be reduced by a supplemental agreement to this Contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.
1.7 PERSONNEL, SUBCONTRACTORS AND OUTSIDE ASSOCIATES OR CONSULTANTS (MAY
2006) (UAI 52.236-5001)
In connection with this Contract, any in-house personnel, subcontractors, and outside associates or consultants will be limited to individuals or firms that were specifically identified in the Contractor's accepted proposal. The Contractor shall obtain the Contracting Officer's written consent before making any substitution for these designated in-house personnel, subcontractors, associates, or consultants. If the Contractor proposes a substitution, it shall submit the same type of information that was submitted in the accepted proposal to the Contracting Officer for evaluation and approval. The level of qualifications and experience submitted in the accepted proposal or that required by the Solicitation, whichever is greater, is the minimum standard for any substitution.
1.8 PHYSICAL DATA (FAR 52.236-4)
Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.
a. Physical Conditions: The indications of physical conditions on the drawings and in the specifications are the result of site investigations by test pits shown on the drawings.
b. Weather Conditions: Each bidder shall be satisfied before submitting his bid as to the hazards likely to arise from weather conditions.
Complete weather records and reports may be obtained from any National Weather Service Office.
c. Transportation Facilities: Each bidder, before submitting his bid, shall make an investigation of the conditions of existing public and private roads and of clearances, restrictions, bridge load limits, and other limitations affecting transportation and ingress and egress at the jobsite. The unavailability of transportation facilities or limitations thereon shall not become a basis for claims for damages or extension of time for completion of the work.
d. Right-of-Way: The right-of-way for the work covered by these specifications will be furnished by the Government, except that the Contractor shall provide right-of-way for ingress and egress across private property where necessary to gain access to the jobsite. The Contractor may use such portions of the land within the right-of-way not otherwise occupied as may be designated by the Contracting Officer. The Contractor shall, without expense to the Government, and at any time during the progress of the work when space is needed within the right-of-way for any other purposes, promptly vacate and clean up
DOCUMENT 00 73 00 Page 5 any part of the grounds that have been allotted to, or have been in use by, him when directed to do so by the Contracting Officer. The Contractor shall keep the buildings and grounds in use by him at the site of the work in an orderly and sanitary condition. Should the Contractor require additional working space or lands for material yards, job offices, or other purposes, he shall obtain such additional lands or easements at his expense.
e. Condition of Area: The condition of the area when last surveyed is shown on the drawings. Topography is in feet and represents elevation with vertical reference as shown on the drawings.
f. Datum and Bench Marks: The plane of reference as used in these specifications is that determined by the benchmarks as shown on the drawings.
1.9 LAYOUT OF WORK (FAR 52.236-17)
The Contractor shall lay out its work from Government established base lines and benchmarks indicated on the drawings, and shall be responsible for all measurements in connection with the layout. The Contractor shall furnish, at its own expense, all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the work. The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer.
The Contractor shall also be responsible for maintaining and preserving all stakes and other marks established by the Contracting Officer until authorized to remove them. If such marks are destroyed by the Contractor or through its negligence before their removal is authorized, the Contracting Officer may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.
1.10 AIRFIELD SAFETY PRECAUTIONS
1.10.1 Definitions
Definitions: As used in this clause,
a. "Landing Areas" means:
1. The primary surfaces which are comprised of the surface of the runways, the runway shoulders, and the lateral safety zones (the length of each primary surface is the same as the runway length;
the width of each primary surface is 610 meters (2,000 feet), 305 meters (1,000 feet) on each side of the runway centerline.
2. The "clear zone" beyond the ends of each runway, i.e., the extension of the "primary surface" for a distance of 305 meters (1,000 feet) beyond each end of each runway;
3. All taxiways plus the lateral clearance zones along each side for the length of the taxiways (the outer edge of each lateral clearance zone is laterally 76 meters (250 feet) from the far or opposite edge of the taxiway, i.e., a 23-meters (75-foot) wide taxiway would have a combined width of taxiway and lateral clearance zones of 130 meters (425 feet); and
4. All aircraft parking aprons plus the area 38 meters (125 feet) in width extending beyond each edge all around the aprons.
DOCUMENT 00 73 00 Page 6
b. "Safety precaution areas" means those portions of approach-departure clearance zones and transitional zones where placement of objects incident to Contract performance might result in vertical projections at or above the approach-departure clearance surface or the transitional surface.
1. The "approach-departure clearance surface" is an extension of the primary surface and the clear zone at each end of each runway, for a distance of 15,240 meters (50,000 feet), first along an inclined (glide angle) and then along a horizontal plane, both flaring symmetrically about the runway centerline extended.
The inclined plane (glide angle) begins in the clear zone 61 meters (200 feet) past the end of the runway (and primary surface) at the same elevation as the end of the runway, and continues upward at a slope of 50:1 (0.3048 meter (one foot) vertically for each 15.24 meters (50 feet) horizontally) to an elevation of 152 meters (500 feet) above the established airfield elevation; at that point the plane becomes horizontal, continuing at that same uniform elevation to a point 15,240 meters (50,000 feet) longitudinally from the beginning of the inclined plane (glide angle) and ending there.
The width of the surface at the beginning of the inclined plane (glide angle) is the same as the width of the clear zone; thence it flares uniformly, reaching the maximum width of 4,877 meters (16,000 feet) at the end.
2. The "approach-departure clearance zone" is the ground area under the approach-departure clearance surface.
3. The "transitional surface" is a sideways extension of all primary surfaces, clear zones, and approach-departure clearance surfaces along inclined planes.
The inclined plane in each case begins at the edge of the surface.
The slope of the inclined plane is 1:7 (0.3048 meter (one foot) vertically for each 2.13 meters (7 feet) horizontally), and it continues to the point of intersection with the inner horizontal surface (which is the horizontal plane 46 meters (150 feet) above the established airfield elevation) or the outer horizontal surface (which is the horizontal plane 152 meters (500 feet) above the established airfield elevation), whichever is applicable.
4. The "transitional zone" is the ground area under the transitional surface. It adjoins the primary surface, clear zone, and approach-departure clearance zone.
1.10.2 General
The requirements of this clause are in addition to any other safety requirements of this Contract.
The Contractor shall comply with the following requirements:
a. Report to the Contracting Officer before initiating any work.
DOCUMENT 00 73 00 Page 7
b. Notify the Contracting Officer of proposed changes to locations and operations.
c. Not permit either its equipment or personnel to use any runway for purposes other than aircraft operation without permission of the Contracting Officer, unless the runway is:
1. Closed by order of the Contracting Officer, and
2. Marked as provided in paragraph LANDING AREAS, part (b) of this clause.
d. Keep all paved surfaces such as runways, taxiways, and hardstands clean at all times and, specifically free from small stones, which might damage aircraft propellers or jet aircraft.
e. Operate mobile equipment according to the safety provisions of this clause, while actually performing work on the airfield. At all other times, the Contractor shall remove all mobile equipment to locations

b. At a distance of at least 229 meters (750 feet) from the runway centerline, plus any additional distance; and
c. Necessary to ensure compliance with the other provisions of this clause.
f. Not open a trench unless material is on hand and ready for placing in the trench. As soon as practicable after material has been placed and work approved, the Contractor shall backfill and compact trenches as required by the Contract. Meanwhile, all hazardous conditions shall be marked and lighted in accordance with the other provisions of this clause.
1.10.3 Landing Areas
The Contractor shall:
a. Place nothing upon the landing areas without the authorization of the Contracting Officer.
b. Outline those landing areas hazardous to aircraft, using (unless otherwise authorized by the Contracting Officer) red flags by day, and electric, battery-operated low-intensity red flasher lights by night.
c. Obtain, at an airfield where flying is controlled, additional permission from the control tower operator every time before entering any landing area, unless the landing area is marked as hazardous in accordance with part (b) above.
d. Identify all vehicles it operates in landing areas by means of a flag on a staff attached to, and flying above, the vehicle. The flag shall be 0.9144 meters (3 feet) square, and consist of a checkered pattern of international orange and white squares of 0.3048 meters (1 foot) on each side (except that the flag may vary up to 10 percent from each of these dimensions).
e. Mark all other equipment and materials in the landing areas, using the
DOCUMENT 00 73 00 Page 8 same marking devices as in part (b) above and
f. Perform work so as to leave that portion of the landing area that is available to aircraft free from hazards, holes, piles of material, and projecting shoulders that might damage an airplane tire.
1.10.4 Safety Precaution Areas
The Contractor shall:
a. Place nothing upon the safety precaution areas without authorization of the Contracting Officer.
b. Mark all equipment and materials in safety precaution areas, using (unless otherwise authorized by the Contracting Officer) red flags by day, and electric, battery-operated, low-intensity red flasher lights by night; and
c. Provide all objects placed in safety precaution areas with a red light or red lantern at night, if the objects project above the approach-departure clearance surface or above the transitional surface.
1.11 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE (UAI 31.105-101)
a. This clause does not apply to terminations. See FAR 52.249-5000 BASIS FOR SETTLEMENT OF PROPOSALS and FAR Part 49.
b. Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a Contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region VIII (Oregon, Washington, and Idaho). Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
c. Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
d. When actual equipment costs are proposed and the total amount of the pricing action exceeds the small acquisition threshold (SAT), the Contracting Officer shall request the Contractor to submit either
DOCUMENT 00 73 00 Page 9 certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.
1.12 PAYMENT FOR MATERIALS DELIVERED OFF-SITE (UAI 5152.232-9000)
a. Pursuant to FAR 52.232-5, Payments Under Fixed Priced Construction Contracts, materials delivered to the Contractor at locations other than the site of the work may be taken into consideration in making payments if included in payment estimates and if all the conditions of the General Provisions are fulfilled. Payment for items delivered to locations other than the work site will be limited to:
1. Materials required by the technical provisions; or
2. Materials that have been fabricated to the point where they are identifiable to an item of work required under this Contract.
3. Items specifically listed below.
b. Payment for materials delivered off-site shall be made only after receipt of paid invoices with a canceled check showing the Prime Contractor's title to the items delivered off-site. Payment for materials delivered off-site shall be limited to the following items:
any construction material stored off-site may be considered in determining the amount of a progress payment.
1.13 FIELD OFFICE OVERHEAD
Notice to Offerors: You must declare below the accounting practice that you apply to Contracts to calculate field office overhead for all change orders, modifications, and requests for equitable adjustment. Pursuant to Federal Acquisition Regulation (FAR) Parts 31.105(d)(3) and 31.203(d)(1), an accounting practice that varies from modification to modification is not allowable. Select one of the following:
a. If you use Time Distribution Base for Per Diem Rate practice, see Special Contract Requirement SC-17 "Field Office Overhead - Per Diem Rate".
b. If you use Direct Cost Distribution Base for a Percentage Mark-up practice, see Special Contract Requirement SC-18 "Field Office Overhead
- Percentage Markup".
c. If you choose Other Accounting Practice That is Allowed Under the FAR and That Uses a Single Distribution Base, you must describe the accounting practice in sufficient detail below to allow the Contracting Officer to determine what accounting practice is being utilized by your company and that it complies with the criteria for acceptable accounting practices as set out in FAR Parts 31.105(d)(3) and 31.203(d)(1).
1.13.1 Field Office Overhead - Per Diem Rate
The Contracting Officer shall make an equitable adjustment and modify the Contract in writing for any change to the Contract, issued pursuant to the Changes clause or otherwise, for which the Government is responsible, and which causes either an increase or decrease in the Contractor's costs as to time or performance under the Contract. Under such an equitable
DOCUMENT 00 73 00 Page 10 adjustment, the Contractor's field office overhead shall be an allowable cost, in accordance with the Contractor's accounting practice as identified by the Contractor in its Bid Schedule.
The Contractor shall declare which standard form of accounting practice it applies to field overhead costs: if a Contractor indicates that it follows a per diem basis, no overhead percentage markup rate for office overhead costs shall be allowed.
Under such an equitable adjustment, the Contractor shall be reimbursed for field office overhead on a per diem basis when the completion of the Contract is extended by reason of the change issued under any clause, except the Default clause, subject to the Contractor substantiating the variable expense by providing a detailed breakdown of its proposed increase or decrease of costs as required by the Contract Clause DFARS 252.236-7000 MODIFICATION OF PROPOSALS - PRICE BREAKDOWN. No payment of field office overhead on a per diem basis shall be allowed for any change when the completion of the Contract is not extended by reason of the change.
1.13.2 Field Office Overhead - Percentage Markup
The Contracting Officer shall make an equitable adjustment and modify the Contract in writing for any change to the Contract, issued pursuant to the Changes clause or otherwise, for which the Government is responsible, and which causes either an increase or decrease in the Contractor's costs as to time or performance under the Contract. Under such an equitable adjustment, the Contractor's field office overhead shall be an allowable cost, in accordance with the Contractor's accounting practice as identified by the Contractor in its Bid Schedule.
The Contractor shall declare which standard form of accounting practice it applies to field overhead costs: if a Contractor indicates that it follows a percentage basis, no per diem rate for office overhead costs shall be allowed.
Under such an equitable adjustment, payment of office overhead costs shall be allowed for any change on a percentage markup basis regardless of whether the completion of the Contract is, or, is not, extended by reason of the change, except for modifications issued pursuant to the Default Clause. The Contractor shall provide a detailed breakdown of its proposed increase or decrease of costs as required by Contract Clause DFARS
252.236-7000 MODIFICATION OF PROPOSALS - PRICE BREAKDOWN.
1.14 CONTRACT DRAWINGS AND SPECIFICATIONS (DOD FAR SUPP 252.236-7001)
a. The Government will provide to the Contractor, without charge, one set of Contract drawings and specifications, except publications incorporated into the technical provisions by reference, in electronic or paper media as chosen by the Contracting Officer.
b. The Contractor shall:
1. Check all drawings furnished immediately upon receipt;
2. Compare all drawings and verify the figures before laying out the work;

DOCUMENT 00 73 00 Page 11
4. Be responsible for any errors which might have been avoided by complying with this paragraph (b); and
5. Reproduce and print Contract drawings and specifications as needed.
c. In general:
1. Large scale drawings shall govern small scale drawings; and
2. The Contractor shall follow figures marked on drawings in preference to scale measurements.
d. Omissions from the drawings or specifications or the misdescription of details of work which are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work. The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.
e. The work shall conform to the specifications and the Contract drawings identified in the index of drawings attached at the end of this section.
1.15 EPA ENERGY STAR
The Government requires that certain equipment be Energy Star compliant.
Initially, the sole Energy Star requirement shall be the self-certification by the bidder that the specified equipment is Energy Star compliant.
Within 3 months of the availability of an EPA sanctioned test for Energy Star compliance, the Contractor shall submit all equipment upgrades and additions for testing and provide proof of compliance to the Government upon completion of testing. Testing shall be at the Contractor's expense.

All items specified on a brand name basis are to indicate the general type desired based on level of quality, and are not intended to restrict selection to products of any particular manufacturer.
1.17 PERFORMANCE EVALUATIONS
In accordance with the provisions of Subpart 36.201 (Evaluation of Contractor Performance) of the Federal Acquisition Regulation (FAR), construction Contractor's performance shall be evaluated throughout the performance of the Contract. The United States Army Corps of Engineers (USACE) follows the procedures outlined in Engineering Regulation 415-1-17 to fulfill this FAR requirement. For construction Contracts awarded at or above $100,000.00, the USACE will evaluate Contractor's performance and prepare a performance report using the Contractor Performance Assessment Reporting System (CPARS), which is now a web-based system. After an evaluation (interim or final) is written up by the USACE, the Contractor will have the ability to access, review and comment on the evaluation for a period of 30 days. Accessing and using CPARS requires specific software, called PKI certification, which is installed on the user's computer. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. The certification software could cost approximately $110 - $125 per certificate per year and is purchased from an External Certificate Authorities (ECA) vendor. Current information about the PKI certification process and for Contacting vendors
DOCUMENT 00 73 00 Page 12 can be found on the web site: http://www.cpars.gov/. If the Contractor wishes to participate in the performance evaluation process, access to CPARS and PKI certification is the sole responsibility of the Contractor.

SECTION 01 14 10 Page 2
1.6 COMMERCIAL VEHICLE ACCESS TO JOINT BASE LEWIS-MCCHORD - REGISTERED AND
PREVIOUSLY ID'D (RAPID) GATE PROGRAM
Procedures for commercial vehicle access to Joint Base Lewis-McChord are subject to change without prior notice. The following requirements apply.
a. Unless the Contractor voluntarily participates in the RAPID Gate Program, commercial vehicle access to Joint Base Lewis-McChord will be allowed only at the Logistics Center Gate (Exit 123 from I-5) and through the D Street Commercial Vehicle Inspection Point on JBLM-North. Both gates are open Monday through Friday, excluding federal holidays. These gates will be open for inbound commercial vehicle access and inspection between 0530 hours and 2100 hours. These gates are closed on weekends (Saturdays and Sundays) and federal holidays. On Saturdays, Sundays and federal holidays, commercial vehicles must use the Main Gate (Exit 120 from I-5). Main Gate is open 24 hours per day everyday. A visitor pass must be obtained. All commercial vehicles will be searched. The Contractor should anticipate delays in getting commercial vehicles on post. The Contractor must also allow additional time for commercial vehicles to reach their destination by driving through Joint Base Lewis-McChord.
1. If the commercial vehicle is carrying a load of cement concrete or hot asphalt concrete for delivery, the driver shall notify the gate guard as soon as possible and request that the vehicle be given priority for being searched; however, the Government does not guarantee that the vehicle will be given priority.
2. On weekends large vehicles (needing greater than 12'-5" clearance) will require a time-stamped "searched" label to gain access to JBLM-North. "Searched" labels will be issued at the Main Gate, as appropriate. Drivers needing access to JBLM-North must inform the gate guard that their vehicle is over 12'-5" in height and that they will require access to JBLM-North. The driver will receive a briefing on proper procedures and a "searched" label. Ensure that drivers, including drivers of Subcontractors at any tier, comply with the procedures as explained to them for access to JBLM-North.
b. If the Contractor participates in the RAPID Gate Program, Contractor vehicles may enter the installation through any RAPID gate lane except at Force Protection Level Charlie or Delta. During Force Protection Level Charlie or Delta, all Contractor vehicles must enter through the Logistics Center gate or, if the Logistics Center Gate is closed, through the Main Gate. All passengers in the Contractor vehicle must have a RAPID identification card; otherwise, the Contractor vehicle must enter through the Logistics Center Gate or the Main Gate, as appropriate and obtain visitor passes. Once the RAPID Gate Program is fully implemented, RAPID gate lanes will be at the Main (Liberty) Gate, the East Gate, the DuPont Gate, the D Street Gate, the Logistics Center Gate, the Madigan Army Medical Center Gate, and the JBLM-North Gate.
Use only those lanes specifically marked as RAPID lanes.
1.7 IDENTIFICATION OF EMPLOYEES AND MILITARY REGULATIONS
1.7.1 Compliance with Regulations
The Contractor shall be responsible for compliance with all regulations and orders of the Commanding Officer of the Military Installation, respecting
SECTION 01 14 10 Page 3 identification of employees, movements on installation, parking, truck entry, and all other military regulations which may affect the work.
1.7.2 Specific Requirement for Vehicle Registration
The Commanding Officer of Joint Base Lewis-McChord, Washington, has initiated the following specific requirement regarding vehicle registration for this contract:
a. Contractors performing work on Joint Base Lewis-McChord shall, after award, register all vehicles to be used on the installation with the Vehicle Registration Section of the Law Enforcement Command.
Contractor employees entering the installation in privately owned vehicles (POVs) shall also register their vehicles. A copy of contract award, proof of liability insurance, current driver's license and state vehicle registration shall be required to register Contractor, Subcontractor, and employee vehicles.
b. Upon completion of the contract, it shall be the prime Contractor's responsibility to collect all vehicle decals issued under the contract including those issued to employees and Subcontractors. Decals are to be carefully removed from the vehicle, placed in an envelope and attached to the original documentation (i.e., post vehicle registration document) received with the decal. Decals, with documentation, must be returned to Vehicle Registration, Building 2140. Proof of decal clearance for all vehicles registered under this contract will be issued to the prime Contractor and shall be returned to the Contracting Officer prior to final payment.
c. In the event of contract extension, it shall be the prime Contractor's responsibility to report time extension to Vehicle Registration, with evidence of same. For further information, contact Vehicle Registration at Waller Hall, Building 2140, Telephone: (253) 967-5065, Joint Base Lewis-McChord, Washington 98433-9500.
1.7.3 Employee Access and Identification
a. Each employee who requires access to Joint Base Lewis-McChord to perform work under any contract, at any tier, must obtain either a RAPID identification badge or a visitor's pass to obtain access to Joint Base Lewis-McChord. A RAPID identification badge will only be issued to an employee, at any tier, if the employee requires access to Joint Base Lewis-McChord more than twice per week. Contractor employees, at any tier, who require access to Joint Base Lewis-McChord twice per week or less often or who do not participate in the RAPID Gate Program shall obtain a visitor's pass at the Main (Liberty) Gate, the Logistics Center Gate or the D Street Gate. The visitor's pass will be issued for a maximum of 30 days at a time. A RAPID identification badge will only be issued to Contractor employees if the Contractor participates in the RAPID Gate Program. The RAPID Gate Program is a voluntary program. The production of RAPID badges has been contracted out and the cost of the identification card shall be borne by the Contractor. Current established costs are: $99 for company start-up and $99 per individual.
b. If an employee no longer needs an identification badge for any reason (e.g., quits his/her job or no longer performs work under the contract), return the identification badge to Eid within two calendar days of such change. If the identification badge cannot be returned
SECTION 01 14 10 Page 4 within the required time frame for any reason, immediately notify both Eid and the Contracting Officer verbally, followed up in writing the next work day. An employee's inability to obtain entrance to a Government installation because he/she does not have the required identification badge or visitor's pass shall not excuse timely performance of the requirements of this contract. Eid or the Government may change the location at which identification badges are issued or returned, with or without advance notice to the Contractor.
Any such changes shall not be a basis for adjusting the contract price under any clause of this contract.
c. RAPID identification badges shall not be reproduced or copied by the Contractor, its Subcontractors, or their employees. If an employee's identification badge is lost, stolen, or reproduced, verbally report the loss, theft, or reproduction to both Eid and the Contracting Officer on the day such loss, theft, or reproduction is discovered, followed by a written report of the circumstances to both Eid and the Contracting Officer within one calendar day after the loss, theft, or reproduction is discovered.
d. Each Contractor employee shall wear the RAPID identification badge while performing work under the contract. The identification badge shall be worn on the upper front of the outer garment unless precluded by OSHA regulation(s). The identification badge shall not be used for access to any Government installation except for performance of work under the contract for which it was issued.
e. Upon expiration or termination of the contract, collect all identification badges and turn them in to Eid. The final invoice will not be considered proper for purposes of the Prompt Payment Act (FAR 52.232-25 or FAR 52.212-4(i)) until all identification badges have been accounted for.
1.7.3.1 Issuance of RAPID Identification Badge
Provide information as required by Eid Passport, Inc. (Eid), to enable Eid to conduct a criminal history background check (CHBC) on Contractor employees who are to have access to Joint Base Lewis-McChord. The Contractor is responsible for paying Eid the fee per employee for conducting the CHBC and issuing the RAPID identification card. If the CHBC is not adverse, a RAPID identification badge will be issued by Eid to the Contractor employee. If the CHBC is adverse, Eid is prohibited from issuing a RAPID identification badge to the Contractor employee. If a RAPID identification badge is denied for any reason, the Contractor employee may only enter the installation by obtaining a visitor’s pass;
however, if the Contractor employee does not meet the criteria for being issued a RAPID identification badge, the Government may, in its sole discretion, decide not to issue a visitor’s pass to the Contractor employee.
1.7.4 Compliance with Rules, Regulations, and Statutes
All Contractor employees shall observe and comply with all applicable local, State, and Federal rules, regulations, and statutes including those concerning fire, safety, sanitation, security, vehicle safety, and hazardous material handling.
1.7.5 Work Hours
Work hours in the construction area shall be restricted to 7:30 a.m. to
SECTION 01 14 10 Page 5
4:30 p.m. daily, Monday through Friday, excluding Federal holidays. Work hours other than as specified above shall be coordinated with and approved by the Contracting Officer.
1.7.6 Firearms
Contractor personnel while performing work under this contract shall not carry any firearms.
1.7.7 Entrance Denial by Military Police
Contractor employees may be denied entry to the Installation by Military Police if it is determined that such entry may be contrary to good order, discipline, or the security of the Installation.
1.8 Base Design Standards
