FAR Clause 52.219-4 "Notice of Price Evaluation Preference for HUBZone Small Business Concerns" is currently missing from the section titled "Clauses Incorporated By Reference" on Page 13 of 65 within Section 00 21 00 – Instructions of the solicitation. FAR Clause 19.1307(a) "Price evaluation preference for HUBZone small business concerns" states that "The price evaluation preference for HUBZone small business concerns shall be used in acquisitions conducted using full and open competition." Since this solicitation is being conducted using full and open competition, please confirm our understanding that FAR Clauses 19.1307 and 52.219-4 will be used by the Government for this solicitation.
On: Mar 16 2021.
Government Response. . All federal contracts solicited using full and open competition are required to include the clause 52.219-4, Notice of Price Evaluation Preference for HUBZone Small Business Concerns. Subpart 3.2 Disposal of Excavated Material with Section 35 73 24.00 23 of the specifications provides specific requirements for disposal of excavated material associated with bankline excavation. Please confirm our interpretation of the specifications and drawings that the Contractor will not be required to temporarily or permanently seed and/or sod (and/or provide any other temporary or permanent erosion and sediment control stabilization measures for) the areas where the excavated materials are disposed of (i.e., placed and rough graded into spoils piles) and/or at other miscellaneous areas where minor excavating and/or grading of the bank (or upper bank) is required for this project. If our interpretation is not correct, please clarify specifically what additional work the Contractor is required to perform.

Unlike CLIN(s) 0001, 0002 Option, 0003 Option, and 0004 Option, the description of CLIN 0005 Option on Page 7 of 65 within Section 00 10 00 of the solicitation does not indicate when the Government intends to award CLIN 0005 Option. (For example, CLIN 0004 Option states, "Option will be exercised at least 180 days before the contract expires.") Please clarify the deadline as to when the Government intends to award CLIN 0005 Option.
Additionally, please confirm that the work associated with CLIN 0005 Option must be completed within the additional 180 calendar days associated with the Government's exercising of CLIN 0004 Option (for a total period of performance of 780 calendar days).
On: Mar 22 2021.
Government Response. . CLIN 0005 may only be exercised if CLIN 0004 is exercised within 180 days before the contract expires.
CLIN 0005 work must be completed within 780 calendar days after NTP. On: Apr 02 2021

Comment Classification: Unclassified\\For Official Use Only (U\\FOUO)
Clause 52.217-9(a) Option to Extend the Term of the Contract within Section 00 72 00 of the solicitation states, "The Government may extend the term of this contract by written notice to the Contractor within 120 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 180 calendar days before the contract expires."
Please clarify what the Government means by the statement, "within 120 calendar days." In other words, "within 120 calendar days" of what?
Additionally, the reference to "within 120 calendar days" appears to contradict the description of CLIN 0004 Option on Page 6
2 of 8 4/2/2021, 9:06 AM of 65 within Section 00 10 00 of the solicitation, which states, "Option will be exercised at least 180 days before the contract expires." Please clarify this contradiction.
Further, Clause 52.217-9(c) Option to Extend the Term of the Contract within Section 00 72 00 of the solicitation states, "The total duration of this contract, including the exercise of any options under this clause, shall not exceed 960 calendar days."
However, the duration of "960 calendar days" contradicts the "780 dys. ANP" listed in the section titled "Delivery Information" on Page 7 of 65 within Section 00 10 00 of the solicitation. Please clarify this contradiction.
On: Mar 22 2021.
Government Response. . Clause 52.217-9 will be amended in Solicitation Amendment 0002 to include the following statement, "(a) The Government may extend the term of this contract by written notice to the Contractor within 180 calendar days prior to the contract expiring; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 200 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension... (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 780 calendar days." On: Apr 01 2021

Please clarify if the Government has already obtained all required environmental and jurisdictional permits from all applicable Federal, State, and/or localities/jurisdictions as it relates to the performance of this project. If not, please clarify what permits the Contractor will be required to obtain, and/or fees the Contractor will be required to pay, in order to work within the Missouri River during performance of this project.
On: Mar 22 2021.
Government Response. . USACE has verified that the work described in the Contract is in compliance with requirements under Section 404 of the Clean Water Act (CWA) and therefore a separate Section 404 CWA permit is not required. In addition, USACE will provide Contractors with the associated Section 401 Water Quality Certifications for the work. USACE is not aware of any other specific permits that would be required for the work but should they exist they are the responsibility of the Contractor. On: Apr 01 2021

Subpart 1.7 Order of Work of Section 35 01 00.00 23 of the specifications states, "Placement of the stone shall be made in the downstream most structure and progress upstream. A written order of work shall be submitted for the Contracting Officer's approval prior to commencement of work. The order of work will define the sequence of river reaches in which work will be performed and the progression of construction within each reach, such as from downstream to upstream." However, the second paragraph of the same subpart states, "The Contracting Officer, in the interest of the Government, reserves the right to assign a priority of construction for any or all repairs or construction."
The specifications are clear that the it is the Contractor's responsibility to order and progress the work, starting in the downstream most structure and progressing upstream. However, the statement in the specifications that states, "The Contracting Officer, in the interest of the Government, reserves the right to assign a priority of construction for any or all repairs or construction" contradicts the Contractor's responsibility of planning and progressing the work.
The solicitation is advertised as an Invitation For Bid (IFB), which will result in a Firm-Fixed-Price (FFP) contract to the low bidder; therefore, please clarify what the Government intends by the statement that gives the Contracting Officer the right to assign a priority of construction. Once the Contractor plans and/or is progressing the work (starting in the downstream most structure and progressing upstream), if the Government assigns a different priority of construction for any or all repairs or construction, and if those actions result in an increased cost for the Contractor, will the Government issue a modification for the impacts resulting from the Government's assigning of a different priority of construction?
Since this is a low bid IFB, it is important, in order to be able to submit competitive pricing, that the bidders understand whether or not the Contractor will be able to competitively plan and progress the work, without having to potentially incur additional costs and risks as the result of the Government's right to assign a priority of construction for any or all repairs or construction.
On: Mar 22 2021.
Government Response. . The only time a Contracting Officer will require assigned priorities is if an urgent need arises within the scope of work that will require immediate attention. Since this will most likely require the Contractor to perform outside of their submitted written order of work that was previously approved by the Contracting Officer, 3 of 8 4/2/2021, 9:06 AM the Contractor will be able to submit a Request for Equitable Adjustment (REA) on the change for incurred costs.

Subpart 1.7 Order of Work of Section 35 01 00.00 23 of the specifications states, "Placement of the stone shall be made in the downstream most structure and progress upstream. A written order of work shall be submitted for the Contracting Officer's approval prior to commencement of work. The order of work will define the sequence of river reaches in which work will be performed and the progression of construction within each reach, such as from downstream to upstream."
The "RM start to Finish" for Items 1 to 14 of CLIN 0001 are distributed along the entire 280-mile length of the project. It is observed that the "RM start to Finish" for Items 15 to 28 of CLIN 0002 Option, Items 29 to 42 of CLIN 0003 Option, Items 43 to 56 of CLIN 0004 Option, and Items 57 to 70 of CLIN 0005 Option are also each distributed along the entire 280-mile length of the project.
Within the descriptions of the CLINs contained on Page 6 of 65 of Section 00 10 00 – Solicitation, CLIN 0004 Option and CLIN 0005 Option are the only CLINs that are contemplated to be exercised after award of the project.
Is it the intent of the Government that the Contractor will have to backtrack (from upstream to downstream) to perform the work associated with CLIN 0004 Option and CLIN 0005 Option, once these options are exercised, and perform work along "RM start to Finish" areas where work was already previously completed for CLIN 0001, and potentially, CLIN 0002 Option and CLIN 0003 Option?
Please clarify this requirement so that the bidders understand whether or not these inefficiency and remobilization costs need to be factored into the bid amounts.
On: Mar 22 2021.
Government Response. . It is not the intent of the Government that the Contractor backtrack at the time additional CLIN options are exercised if at a time after the base award. Contractor should plan to work all CLINs awarded at time of base award from downstream to up. If additional CLINs are awarded after work has begun, the contractor can coordinate with the contracting officer to determine the best way and timing to revisit any areas where rock has already been placed if needed. Under specification section 35 01 00.00 23 – 3 paragraph 1.7 it is stated that "The Contracting Officer further reserves the right, as the need arises, to direct the Contractor to perform emergency repairs on any structure within the mile limits of the contract. The cost of all plant, labor, and materials required to perform such emergency repairs as directed y the Contracting Officer shall be at the applicable contract price, per ton, plus a negotiated price for mobilization and demobilization." For contracting purposes all the CLINs are denominated in the 1 Job unit pricing; while the supplemental bid schedule provides insight into the pricing, as stated in amendment 0001 the supplemental bid schedule is "not contractually binding". Will a CLIN item be added to address emergency unit price work? Please clarify how this could be accomplished as per this paragraph.
On: Mar 26 2021.
5 of 8 4/2/2021, 9:06 AM
Government Response. . When a supplemental bid schedule is used for the purposes of breaking out pricings for a 1 job unit of measure, and if one pricing in the supplemental bid unit is miscalculated, the final CLIN price specified on the actual bid schedule will be contractually binding, not the supplemental bid schedules' pricing.
If an emergency arises, and the applicable contract price per ton is not reasonable, the Contractor can submit an REA for the incurred costs associated with the emergency repairs. A new CLIN will be added for the emergency repairs. On: Apr 01 2021
