NOTES:

-Contractor shall be aware that bid items "Chip Seal Aggregate" and "Flush Seal Aggregate" require the contractor to vacuum sweep and power broom as part of the application of the seal coat. Costs associated with vacuum sweeping and power brooming in accordance with application of a seal coat shall be included in these bid items. Bid items "Vacuum Sweep" and "Power Broom" are separate, standalone bid items.

-Mobilization/Demobilization bid prices will cover all costs associated with hauling, transporting, and moving any equipment and/or materials to and from the project site. The contractor is specifically cautioned that he will only receive one (1) mobilization/demobilization payment for similar bid items on the same task order. For example, if the contractor is directed to provide non-reflective pavement striping, reflective pavement striping, curb striping, and painted pavement symbols on the same task order, he will only be allowed to charge the Government for one (1) Mobilization/Demobilization fee. Similarly, if the Contractor is directed to place Government Furnished Borrow material in excess of 500 CY, he will only be allowed to charge the Government for one (1) Mobilization/Demobilization fee, instead of charging a fee for both the first 500 CY of Contractor Furnished Borrow Material and then a fee for the material in excess of 500 CY.

Notes:

1. Quantities for unit priced items are estimated only and the representative unit price will prevail in the event of an overrun or underrun subject to Contract Clauses (Section 00 72 00) Clause “Variation in Estimated Quantities.”

2. Bid prices must be entered for all items of the schedule. Total amount submitted without prices being entered on individual items will be rejected. Extensions will be subject to verification by the Government.

In case of variation between the unit price and the extension, the unit price will be considered the bid. In case of variation between the individual item prices and the total amount, the individual prices will

00 10 00 Page 27 be considered the Bid.

3. A modification to a Bid which provides for a single adjustment to the total amount should state the application of the adjustment to each respective unit price and lump sum price affected. If the modification is not so apportioned, the amount of the adjustment will be divided by the number of items in the Basic Year Bid Schedule, whichever one applies, and distributed equally among each Item.

4. * Refers to the number of the specification section for referencing technical and measurement and payment information for the various items.

5. Calendar duration is a four year period starting with the effective date of the contract award.

6. If a line item is used then the minimum quantity stated on the bid sheet is the smallest quantity that may be ordered. The Contractor has the right to turn down any task order if done in writing in accordance with (Section 00 73 00) within 7 days of the task order being issued.

In this case the government may open task order items for bid to other contractors.

7. Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

INSTRUCTIONS TO OFFERORS (IFB)

1/16

PART 1 GENERAL

1.1 (FAR 52.204-7) SYSTEM FOR AWARD MANAGEMENT (JUL 2013)

(a) Definitions. As used in this provision-

"Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.)

This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

"Registered in the System for Award Management database" means that-

(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide TIN validation to the Government as a part of the SAM registration process;

and

(4) The Government has marked the record "Active".

(b)(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
