The Ordering Officers will not be the Contracting Officer Representative for the contract. The Ordering Officers will have limited authority to order up to $150,000 per order for minor repairs for pre-priced items and up to $2500 for non-pre-priced items. Ordering Officers may not order construction requirements at any dollar amount under this contract. All labor and materials ordered by Ordering Officers will be ordered based on prices established in the current RS Means book for the year in which the order is placed. A coefficient will set on the base contract and will be applied to the price for the materials established in RS Means for the final price paid to the contractor. No negotiations will take place. Note: The RS Means co- efficient will not be used or applied. The OO will determine the line item in RS Means that is necessary and the quantity, apply the coefficient from the contract and issue the order for materials based on this process only. Therefore, all materials ordered under this contract are considered to be pre-priced as all will be based on pre-established pricing set forth in RS Means. These will be issued as "service calls”, which will be scoped and ordered by the Ordering Officers IAW AFARS 510l .602-2-92(b)(5). The Ordering Officers can order a necessary in-scope service call up to $150,000 after verifying that there is sufficient funding on the Task Order to fully fund the service call. Ordering Officers shall not order in excess of the total available funding currently on the task order; and the third type of TO will be issued for larger repairs that cannot be ordered under a service call for anything that is considered minor construction incidental to maintenance of facilities. These orders shall only be placed by a USACE Contracting Officer. These TO’s will be scoped by the 63D, reviewed, negotiated and awarded by the USACE Contracting Officer (KO).
COR: The Contracting Officer will appoint a COR for each task order. The COR is to provide surveillance in accordance with QASP to ensure timely performance. The COR will utilize the Quality Assurance Surveillance Plan (QASP) to survey the performance of the contractor. The COR shall be responsible for the coordination and monitoring performance for each Task Order. This monitoring process will enable the Government to anticipate and identify possible performance issues and take a proactive approach in providing an expeditious solution. The COR will inspect and accept each service call, and preventative maintenance delivery of the requirement. The contractor will then provide all invoices to the COR who will check for accuracy and completeness. The COR receive, sign and send the invoice to the Corps for payment.
Funding: The amount of funding placed on these task orders and made available for ordering officers is based on historical data of the type of work completed in a year in these facilities and is anticipated to fully fund 1 year of required service calls. As a minimum guarantee will apply to the base contract ($25,000) there is no fiscal requirement for a minimum guarantee on each task order. While the amount of funding placed on this task order will be based on historical needs the total funded amount will not be guaranteed to the contractor. The contractor will only be entitled to payment for orders placed and completed under this task order. As such, this funded amount may be increased or decreased based on mission requirements.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
A. BASIS OF AWARD
Award will be made on a best-value, trade-off process pursuant to FAR subpart 15.101-1. This process permits tradeoffs among cost or price and non-cost factors and allows the Government to accept other than the lowest priced proposal. The Government may consider award to other than the lowest priced Offeror or other than the highest technically rated Offeror when it is in the best interest of the Government. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factors (non-price evaluation factors).
The Government intends to award ONE (1) Indefinite Delivery Indefinite Quantity (IDIQ) contract to the responsible 8(a) small business Offeror whose proposal(s) is determined to be most advantageous to the Government in accordance with the following relationship between price and technical merit:
The technical evaluation factors, when combined, are more important than the cost or price.
FACTORS AND SUB-FACTORS TO BE EVALUATED
The Government will select the proposal that represents the best value to the Government by using the tradeoff process pursuant to FAR 15.101-1. This process permits tradeoffs among cost or price and non- price factors and allows the Government to accept other than the lowest priced proposal.
Once evaluation of all non-price proposals has received no less than an acceptable rating, the Contracting Officer will, in accordance with the provisions of this RFP and applicable acquisition regulations, evaluate price for fair and reasonableness. In the event discussions are determined necessary, the Contracting Officer will conduct discussions with Offeror’s determined to be within the competitive range. In determining the competitive range, the Government will include analysis of the non-price and price proposals of Offeror’s. Upon conclusion of discussions, the Contracting Officer will request final proposal revisions and may, upon receipt of final proposal revisions, proceed to award a contract without further discussions or notice.
RELATIVE WEIGHTING OF THE NON_PRICE TECHNICAL EVALUATION FACTORS
The purpose of the non-price factors is to assess whether the Offeror’s proposal will satisfy the Government’s minimum requirements. An unacceptable evaluation of any one of these factors will result in an overall unacceptable proposal.
The following Technical Evaluation Factors are listed in descending order of importance:
Factor 1 – Corporate Relative Experience is equally weighted with Factor 2, but higher than Factor 3.
Factor 2 – Understanding of Work is weighted equal with Factor 1, but higher than Factor 3.
Factor 3 – Past Performance is weighted less than both Factors 1 and 2.
B. EVALUATION APPROACH
All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB).
NON PRICE FACTORS: Data provided in response to the non-price factors described below shall be included in Volume I, Technical Proposal. If the Offeror is a joint venture, the Offeror must provide evidence of a binding teaming agreement or other contractual agreement, which creates legal responsibility on the part of all contractors in the joint venture and submit evidence or confirm that the contractor submitted its paperwork to its local Small Business Administration Office for this specific requirement. If the Offeror proposes to utilize a “key subcontractor” as described in FAR 9.6, it is Government policy to recognize the integrity and validity of contractor team arrangements. For a teaming arrangement to be recognized for purposes of source selection evaluation and the application of non-price factors, there must be full disclosure of the teaming arrangement and company relationships in the team’s proposal. The proposal must include a narrative that explains the major or critical aspects of the work to be performed by each team member. The proposal must also include an agreement that has been or will be executed prior to award between/among all team members. The proposal and agreement must be consistent;
substantive inconsistencies between the proposal and agreement may be construed against the Offeror. In the case of prime-sub teams, the prime contractor remains fully responsible for contract performance, regardless of any team arrangement between the prime contractor and its subcontractors. However, consistent with FAR 9.104, the Government may consider the responsibility of subcontractor team members when it may adversely affect the prospective prime contractor’s responsibility or when it is in the Government’s interest to do so.
The team agreement submitted with the proposal will govern the performance of the work by the team.
The agreement must address the following items: identification of team members, a full delineation of roles and responsibilities of team members, and the duration of the agreement. In the case of Joint
Ventures or other partnerships seeking award to the team as a prime contractor, the agreement must indicate the percentages of the participants, in particular the percent of the controlling party. In the case of a prime-sub team, the agreement must reflect that the prime contractor is vested with control and responsibility for the daily management of the work, and that it remains responsible for contract performance, including those items allocated to a subcontractor on the team. Contractor teams should not submit an agreement in their proposal that is subject to substantive revision because the agreement will be part of the evaluation process. The timely submission of the executed teaming agreement prior to award shall be a precondition to a finding of responsibility. In the case of prime-sub teams, any resulting subcontract(s) may not deviate from the substantive provisions of the teaming agreement.
Regardless of any provision to the contrary in a team or subcontract agreement, all members of a recognized team arrangement are bound to perform any resulting contract and options by means of the same team. There can be no substitution of subcontractor team members except that, in the case of a prime-sub team arrangement, the Government may (in its sole discretion and without any obligation whatsoever), at the request of the prime, permit the substitution of a subcontractor with equivalent or greater capability for a subcontractor on the identified team. The failure of the Offeror to perform with one or more subcontractors on a recognized team may be grounds for termination for default. Note: Only a Contracting Officer can approve such a change after contract award.
For evaluation purposes, the definition of a relevant contract is as follows: A recent (within the past two years) contract awarded to the Offeror ( or in the case of an Offeror which is a Joint Venture (JV), a contract awarded to either member of the JV) as the prime contractor. The contract should be substantially complete or completed projects within the last five years that are similar in terms of cost, complexity, design or features that have been perform by the Offeror to be used for reference and evaluation purposes.
Factor 1, Corporate Relevant Experience: Offers shall submit a minimum of three (3) relevant contracts, but no more than four (4). If there is a teaming arrangement, a minimum of 3 relevant contracts are required from the prime. Offeror’s shall complete and provide a Corporate Relevant Experience Data Sheet for each relevant contract; refer to Attachment 1. The Corporate Relevant Experience Data Sheet shall not exceed 2 pages per contract. The Government’s evaluation of corporate relevant experience will include an assessment of whether the Offeror demonstrates the ability to accomplish the work specified under the RFP. This assessment will be based on consideration of all relevant facts and circumstances. Evaluators will assess experience on each relevant contract as defined above. For Factor 1, Offerors will be rated utilizing the chart provided below:
