SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

BASIS OF AWARD(S)

Basis for Award / Task Order Process

Proposals will be evaluated in accordance with the criteria detailed in Federal Acquisition Regulation (FAR) Clause 52.212-2 Evaluation - Commercial Items.

The Government intends to award a Multiple Award Task Order Contract (MATOC), with award to up to three firms, under this solicitation. The Government will award contracts to the three lowest priced proposals meeting or exceeding the acceptability standards for non-cost factors, as outlined in FAR 52.212-2. However, the Government reserves the right to award less than three contracts if less than three offerors are determined acceptable for the non-cost factors. The price proposals submitted for the seed task order will be used for price evaluation. Price proposals must also be considered fair and reasonable to receive an award.

The seed task order included in this solicitation will be awarded to the MATOC awardee that submits the lowest evaluated price proposal meeting the acceptability standards for non-cost factors listed under FAR 52.212-2.

Firms awarded contracts, but not awarded the initial seed task order, will receive a minimum guarantee for the minimum amount to be ordered, pursuant to FAR 16.504 and detailed in this solicitation.

Future Task Orders will be issued in accordance with the process detailed below. While the Seed Task Order is illustrative of task orders under this MATOC, evaluation criteria may be adjusted on future orders to fit the technical requirements of the government.

Upon identification of future requirements within the scope of this MATOC, the Contracting Activity shall send a Request for Proposal (RFP) to each of the three contract holders. The task order will identify the scope of all activities to be performed under the task order, including any known timelines, and specific technical evaluation criteria. The RFP will define tasks to be priced as individual CLINs. Each contract holder shall respond to the RFP and provide a price for each CLIN.

The basis for award will be included in each RFP. Task Orders will be issued on a firm-fixed price basis and may be evaluated on price only or price and other factors in order to obtain the best value for the Government. In accordance with the Army Federal Acquisition Regulation Supplement (AFARS) 5116.505-91 Multiple award task order contracts, Contracting officers will document all critical task order decisions, such as exceptions to the fair opportunity process described at FAR 16.505(b)(2) or the selection of a higher priced proposal because of its greater technical merit, in sufficient detail to justify the decision.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award up to three contracts resulting from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government will award three contracts to the three lowest priced proposals meeting or exceeding acceptability standards for non-cost factors. The following factors shall be used to evaluate offers:

Factor 1: Experience

Submission Instructions:

The Offeror shall submit information regarding up to two projects that best demonstrates the Offeror’s experience performing work similar in size, scope, and complexity to the electrical/mechanical as-builting work described in the solicitation.

To be evaluated, each project must have been completed or must be substantially complete within five years of the date that proposals are due. Substantially complete is defined as being 75% complete by the date that proposals are due. If an Offeror submits a project that it represents is “substantially complete,” the Offeror must reasonably explain why the project is considered at least 75% complete. If an Offeror submits an ongoing project without providing an accompanying reasonable explanation that explains how the project is at least 75% complete, the Government reserves the right to reject the project. If an offeror intends to perform the work in partnership with another firm, a letter of commitment to perform on this contract shall be provided. Partner experience can then be used when addressing this factor.

Only two projects will be evaluated. If an Offeror disregards these instructions and submits more than two projects, only the first two projects provided will be evaluated for meeting the requirements. Offerors should describe each project with enough detail to ensure the Government can meaningfully assess whether the projects submitted meet the minimum evaluation criteria outlined below.

Experience submission information shall include the following information for each project:

‐ Customer name;

‐ Period of performance;

‐ Contract value, if applicable;

‐ Contract number, if available;

‐ General description of the scope of work;

‐ Indication if Offeror was the prime or subcontractor on a project. If the Offeror was the prime and utilized subcontractors, list subcontractors utilized;

‐ A Customer point of contact (name, phone, and email) that will allow for independent verification of the experience provided.

Evaluation Method:

The Government will evaluate Factor 1 – Experience on an “Acceptable” or “Unacceptable” basis:

Acceptable: To be determined “Acceptable,” the Offer’s proposal must cumulatively (combined experience of up to two projects) demonstrate that the Offer has performed the following experiences:

- Electrical wire checks at an industrial facility; and

- Creation of as-built drawings at an industrial facility.

Unacceptable: The Offeror’s experience fails to demonstrate the minimum acceptability criteria outlined above.

Factor 2: Past Performance

Submission Instructions:

Offerors are not required to submit information for this factor. The Government will review the Offeror’s past performance for the two projects submitted under Factor 1 – Experience. Sources that the Government may use to evaluate past performance includes past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS).

The Government may also conduct telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources. The Government may also review the Offeror’s past performance on recent and relevant projects other than those projects submitted by the Offeror under Factor 1 – Experience. A recent and relevant project is a project meeting the evaluation criteria outlined in Factor 1. An offerors safety record may also be considered under this factor using available information.

Evaluation Method:

The past performance evaluation results is an assessment of the offeror’s probability of successful performance of the RFP requirements. This assessment is based on the offeror’s record of recent and relevant past performance.

The Government will evaluate Factor 2 – Past Performance on an “Acceptable” or “Unacceptable” basis:

Acceptable: A proposal under Factor 2 will be found “Acceptable” if based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below.)

Unacceptable: A proposal under Factor 2 will be found “Unacceptable” if based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

Factor 3: License

Submission Instructions:

The Offeror shall submit a copy of current State licenses for those individuals that the Offeror proposes to perform, or supervise, electrical system work, as required by this solicitation, regardless of whether the electrical system will be energized or de-energized. The license shall be a State issued license for any State in the United States.

The Government will evaluate Factor 3 – License on an “Acceptable” or “Unacceptable” basis:

Acceptable: A proposal under Factor 3 will be found “Acceptable” if the Offeror demonstrates that the personnel it proposes to perform the electrical system work under this solicitation has a current State electrician license.

Unacceptable: A proposal under Factor 3 will be found “Unacceptable” if the Offeror does not demonstrate electrician licensure of key personnel who will perform electrical system work under this solicitation.

As part of determining acceptability or unacceptability, the Government reserves the right to independently verify that the electrician licenses for proposed personnel are current.

Factor 4: Price

Offeror shall submit one price for the entirety of the scope of the seed task order. The Offeror’s price proposal on the seed task order included in this solicitation will be evaluated to determine fairness and reasonableness, as well as to determine which offerors have submitted the lowest evaluated price proposals.

It is the Government’s intent to award contracts to the three lowest priced proposals meeting or exceeding the acceptability standards for non-cost factors. If an Offeror’s proposal receives an “Unacceptable” rating in Factor 1, Factor 2, or Factor 3, the proposal will be deemed unawardable.

(b) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror(s) within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
