1.4.4 Channel Traffic
The Contractor shall expect that the traffic will cause periodic delays and interruptions of his operations.
1.4.5 Responsibility
The Contractor shall hold and save harmless the United States, it's officers, and employees from all claims that may arise as a result of the Contractor's negligence in connection with the work performed under the contract, from noncompliance by the Contractor with the provisions of the contract drawings and specifications, or from the instruction of the Contracting Officer.
By signing box 20B of the Form 1442 (i.e., its bid), the bidder expressly acknowledges the insurance requirement provisions defined in the solicitation. The bidder further agrees to hold harmless the U.S.
Government for any liability arising from, during, or in connection with the performance of the contract, either to oyster reefs or to the contractor's plant and equipment, if it is awarded the contract.
1.4.6 Work Area Access
The contractor shall access work areas directly from the channel waterway.
The contractor is PROHIBITED from crossing private reef leases to gain access to the work areas. The contractor shall notify the Contracting Officer immediately and in writing, if a conflict in obtaining access to work areas is encountered.
1.4.7 Protection of Existing Oyster Reefs and Oyster Grounds
Reefs scheduled for construction, reefs to remain undisturbed, and leased and public reef grounds present in the project as depicted on the contract drawings must be protected for the duration of the work. In order to avoid damage to oyster reefs and oyster grounds, the Contractor shall exercise care in plant operations and restrict the movement and operation of all plant and equipment in the vicinity of oyster reefs and oyster grounds. Any traversing of oyster reefs and grounds with plant shall be accomplished on high tide to the maximum extent practical. All vessels associated with the construction project shall operate at "no wake/idle" speeds at all times while in the construction area and while in water depths where the draft of the vessel provides less than a four-foot clearance from the bottom. All vessels will preferentially follow deep-water routes (e.g., marked channels) whenever possible.
Oyster leases are considered "property of a third party" and oyster reefs are considered "existing improvements" as these terms are used in Clause 52.236-9. The Contractor shall protect from damage all existing oyster lease and oyster reef areas, the locations of which are made known to the Contractor, or which should be known to the Contractor.
The Plan drawings depict the location of known oyster leases in the vicinity of the work areas. In addition, the Contractor shall be responsible for consulting the Virginia Marine Resources Commission (VMRC) website (https://webapps.mrc.virginia.gov/mobile/oystergrounds.php) prior to construction to obtain current information on oyster leases. The contractor shall be responsible for monitoring this information through completion of construction.
