SECTION L

Instructions, Conditions and Notices to Bidders

1. INSTRUCTIONS FOR BID

1.1 These instructions provide guidance to bidders in the preparation of bids. To aid in the evaluation, all bids shall follow the same general format. The Government defines a complete bid as one consisting of five (5) separate parts, see paragraph 2, Bid Preparation Instructions, below. The bid shall include all of the information requested. Failure to provide all the information may adversely affect the evaluation. Bidders shall submit two separate and complete bids each consisting of the five (5) separate parts as defined in paragraph 2 below and identify any information that is proprietary.

1.2 The Government intends to award a single Fixed-Price (FP) Requirements Contract.

1.3 To be considered for an award, the bid shall conform to all terms and conditions contained in the Invitation for Bid (IFB). The Government will reject any bid that fails to conform to the essential requirements of the IFB.

1.4 The bidder must be registered in the System for Award Management (SAM) system. The Government will not enter into a contract with an unregistered contractor. Internet access allows bidders to register by completing an electronic on-line registration application at www.sam.gov. Ensure the applicable NAICS code 561730, Landscaping Services, is included in the CCR profile prior to submission of the bid for consideration.

1.5 The computer program used to generate the Standard Form 1449 document does not allow completion of Item 8, SF 1449, with the appropriate local time. The bidder shall read Item 9 as if completed with the following: 10:00:00 AM (PDT) 12 July 2017.

1.6 Due to electronic processing, the number of pages identified on the first two pages of the solicitation may not be accurate.

1.7 The Contract Specialist is the point of contact for this acquisition. Address any questions or concerns to Ms.

Nikki Cortes at (253) 966-3497, e-mail: nikkita.cortes.civ@mail.mil and a courtesy copy (cc:) to Angela Chaplinski at angela.k.chaplinski.civ@mail.mil.

2. BID PREPARATION INSTRUCTIONS

A complete bid consists of five (5) separate parts. The bidder shall submit typed bids. Bids must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

NOTE: The Government neither needs nor wants additional information which is not otherwise specifically required to be submitted as part of the bid, such as federal or state licenses or certifications, descriptive literature or documentation required to be submitted by the contractor after award of the contract. The Government will review any such unsolicited material to determine if it qualifies the bid. If it does qualify the bid, the Government may reject the bid. The Government will not consider such additional information to be part of the bid unless it does qualify the bid; however, the Government may release such unsolicited material pursuant to a Freedom of Information Act request. All bids shall be legible and prepared in the following general format:

Part 1 - Standard Form 1449, Solicitation. Complete Blocks 12, 17a (Block 17a must include a Dun and Bradstreet number), 17b, 30a, 30b, and 30c, of the SF 1449, as applicable.

Standard Form 30, Amendment of Solicitation. Acknowledge receipt of all Amendments (SF 30) issued since the original solicitation (SF 1449) issue date, if any. The bidder shall make acknowledgement by completing Blocks 8, 15A, 15B, and 15C.

Part 2 - Completed bid schedule on the attached Contract Line Item Number (CLIN) Schedule (begins on page 3 of the solicitation). Bidders should note that each contract will be subject to the Service Contract Act. See FAR 52.212-5(c) and the Wage Determination included in the solicitation. The bidder shall submit a Unit Price, Estimated Amount, and Estimated Total Amount for each line item, sub line items, and Estimated Totals for each period using the estimated quantity as contained in the CLIN schedule. The bidder shall represent the unit price in two decimal positions only. Example: $0.27, not $0.27458.

Government administrative determinations may be made as described in FAR 14.407-3 in connection with mistakes in bids alleged after opening of bids and before award. The authority to permit correction of bids is limited to bids that, as submitted, are responsive to the invitation and may not be used to permit correction of bids to make them responsive.

FAR Provision 52.212-3 ALT I (Offeror Representations and Certifications—Commercial Items) – The offeror shall ensure that FAR Provision 52.212-3 ALT I is submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely. If FAR provision 52.212-3 Alt I annual representations certifications have been completed electronically at the SAM website, bidders shall complete and submit only paragraph (b) of the FAR provision 52.212-3 with a statement to the effect that the FAR SAM has been completed.

4. PRE-BID CONFERENCE

4.1 Pre-Bid Conference. The Government will not be conducting a pre-bid conference due to the nature of the entitled requirement. However, if industry dictates that a pre-bid conference is needed to adequately assess the requirement at hand, then bidders have 5 business days from solicitation release on FBO to request a pre-bid conference be conducted. If a pre-bid conference is to be conducted, all questions incorporated from the pre-bid conference are to be submitted in writing no later than one business day following the site visit. Answers and clarification of contract requirements will be incorporated into an amendment to the solicitation and posted to FBO for viewing by all potential offerors. Industry questions and answers may or may not have a bearing on the substantive content of the solicitation or the contract requirements, and it should not be assumed that the date set for receipt of proposals will be extended.

5. SITE VISIT INFORMATION

5.1 The solicitation provision, FAR 52.237-1 “Site Visit” is incorporated. The site visit/survey is to eliminate any possible misunderstandings of the terms of the solicitation and for prospective vendors to familiarize themselves with the installation and types of grounds that will require grounds maintenance. If an amendment is issued prior to the date and time set for closing, any questions must be received by the 2nd working day of the effective date of the amendment;

any questions received after this period may not be answered.

52.216-21 Requirements. (OCT 1995) -- ALTERNATE I (APR 1984)

(a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Delivery-Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(c) The estimated quantities are not the total requirements of the Government activity specified in the Schedule, but are estimates of requirements in excess of the quantities that the activity may itself furnish within its own capabilities. Except as this contract otherwise provides, the Government shall order from the Contractor all of that activity's requirements for supplies and services specified in the Schedule that exceed the quantities that the activity may itself furnish within its own capabilities.

(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.

(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.

(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after:

If the First Option is exercised: 31 March 2019 If the Second Option is exercised: 31 March 2020
