NOTES
1. System for Award Management (SAM): In accordance with FAR 4.1102, Offerors must be registered in the SAM database in order to be eligible for contract award. No award will be made to an Offeror not registered.

2. Annual Representations and Certifications: In accordance with FAR 4.1201, Offerors shall complete electronic annual representations and certifications within SAM as part of required registration. 3. Questions: Questions regarding this solicitation shall be submitted to the Contracting Officer, in writing, at least 7 calendar days prior to the closing date. 4. Award without Discussions: The Government intends to award without discussions; therefore Offerors should submit their best prices in their initial offer. If FAR Provision 52.212-2, Evaluation-Commercial Items, is included, Offerors must submit all information requested therein in order for the Government to determine technical acceptability.
5. Amendments: The Offeror shall submit to the Contracting Officer signed copies of all amendments issued to this solicitation. Failure to comply may cause your proposal to be rejected.
6. Payment: Payment for this action will be made by Electronic Funds Transfer (EFT) through the Defense Finance and Accounting Services (DFAS) utilizing Wide Area Work Flow (WAWF). See 252.232-7006 for more information.
7. Period for Acceptance of Offers. The Offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers.
8. Type of Contract: The type of contract resulting from this solicitation is specified in FAR Provision 52.216-1, Type of Contract. Requirements Contract. All quantities are estimated and individual task orders shall be issued citing specific quantities and delivery dates. Payment will be made on actual quantities contracted for.
9. Proposals: Proposals shall be signed by an authorized individual in accordance with FAR 4.102, Contractor’s Signature. Failure to comply may cause your proposal to be rejected. Offerors should mark each page of their proposal as "Proprietary Information" if they want it treated as Proprietary Information under the Procurement Integrity Act.
10. Set- Aside: The proposed contract is s unrestricted.

13. Instructions for Offeror’s, which is attached includes the evaluation criteria for Award. Offerors must review, adhere and submit their proposals compliant with the Instructions to Offeror/Basis for Award.
14.Insurance (Fixed Price): Pursuant to the requirements of FAR clause 52.228-5 Insurance-Work on a Government Installation, the contractor shall obtain and maintain at least the following kinds of insurance and minimum liability coverage during any period of contract performance:
a. Workmen's Compensation and occupational disease coverage as required by law except that, if this contract is to be performed in a state which does not require or permit private insurance, then compliance with the statutory or administrative requirements in any such state will be satisfactory. The required Workmen's Compensation Insurance shall extend to cover employers' liability for accidental bodily injury or death and for occupational disease with a minimum liability limit of $100,000.
b. Comprehensive General Liability Insurance in the minimum limit of $500,000 per occurrence for bodily injury liability.
c. Comprehensive Automotive Liability Insurance with minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury, and a minimum limit of $200,000 per occurrence for property damage.
15. AMC-Level Protest Program: Prior to submitting an agency protest, it is preferable that you first attempt to Resolve your concerns with the responsible contracting officer. However, you may also file a protest to the Headquarters (HQ), Army Materiel Command (AMC). The HQ AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the General Accountability Office (GAO), or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 35 calendar days from filing. To be timely, protests must be filed within the periods specified in Federal Acquisition Regulation 33.103. If you want to file a protest under the HQ AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below.

STATEMENT OF WORK
LEMC New Purchase Request Statement of Work
Cabinet X-Ray System
1. Requirement: Letterkenny Munitions Center has the requirement to purchase a turn-key, state-of-the-art, 7-axis, digital radiography computed tomography system. The system must be able to scan parts up to a 60” diameter and 60” in length. The system must be fully shielded and interlocked cabinet-style unit. It must comply with all applicable industry regulations and Food and Drug Administration (FDA) 21CRF1020.40.
The system must include a flat panel detector, 225Kv Microfocus Tube, 450 HP Tube, DR Image processing acquisition workstation and software, and a separate CT reconstruction workstation including software and meet Technical Requirements listed below.
1.1 Specifications:
1.1.1 System Capabilities:
1.1.1.1 Advanced 2D x ray inspection, 2D CT Slice reconstruction, CT volume reconstruction for 3D inspection, 3D internal and external surface scanning, and Measurement and Analysis tools.
1.1.2 System Specifics:
1.1.2.1 See Attached list of the specific salient characteristics.
1.1.3 Demonstration of Salient Characteristics: Failure to provide the following samples and/or demonstrations will prevent one from becoming technically acceptable.
1.1.3.1 Provide a sample part that is up to 25” in length and under 6” in width, that the seller must demonstrate the ability to use one continuous helical motion in which the sample is CT Scanned using a single automated spiral acquisition. This shall not be separate CT scans stitched together. This will demonstrate the spiral acquisition capabilities.
1.1.3.2 Provide a sample part that is up to 20” in length and under 20” in width, which will demonstrate the ability to seamlessly stitch together the 2D images from multiple projection angles, and reconstruct a single CT volume of the entire part. This will demonstrate the image stitching capabilities.
1.1.3.3 Provide a sample which demonstrates the ability to automatically move the detector a sub pixel distance both horizontally and vertically, capturing 4 images within each pixel for each CT projection. The system shall be capable of performing sub-pixel resolutions scans in both step-scan and continuous-scan modes.
The result shall produce a CT voxel size equal to half that of a standard cone beam CT scan. This will demonstrate the sub-pixel resolution capabilities.
1.1.3.4 Provide a sample which demonstrates the ability of the system shall be capable of performing automated line scan imaging with a digital flat-panel detector for 2D scanning of elongated objects where parallax in one direction can cause image distortion. The 2D line scan (Simulated LDA scan) shall provide for the product to be scanned between the tube and detector with the option of using either a cone beam or collimated fan beam. The object length is to only be limited by the system scanning area. This 2D scanning method reduces or eliminates the cone angle artifacts caused by flat, planar features common in 2D DR imaging techniques. The detector shall be configurable to provide for faster frame rates/line rates through a reduced detector active area. This will demonstrate the DDA Line Scan (simulated LDA scan) capabilities.
1.1.3.5 Provide x ray simulation software that is representative of the actual system configuration including the Manipulator, x ray tube, detector, and scan envelope geometry. The simulation software must provide a polychromatic x ray beam representing the kV and current range of the actual system. It shall also provide for controls of the detector and motion system and complete image acquisition parameters for both 2D DR imaging a CT scanning.
The software shall be capable of inserting a representative part file into the simulator for imaging and providing acquisition of full motion programs. The software shall provide for material alloy selection of the product sample as well as allow for inserting assemblies and fixtures of varying materials and x ray beam filters.
The simulation software controls shall be representative of the actual system software controls. The sample must demonstrate within the simulation software, the creation of a CT data acquisition and a reconstruction data set of a representative part as well as a multi position DR motion control program which records all imaging technique and geometry parameters to a file. This simulation generation demonstration shall be performed on a different system than the actual system. This sample must also demonstrate the placement of the simulation file onto the actual x ray system along with the insertion of the actual part into the actual system to generate DR images from the simulation recorded motion control program and a CT Data set of the actual part. This will demonstrate the x ray system CT simulation and offline programming capabilities.
1.1.4 Documentation: All manufacturer’s operation manuals and instructions will be provided in English. The following documents are mandatory and the contractor shall meet all applicable requirements at the time of contract award.
1.1.4.1 Government Documents: U.S. Department of Labor: General Industry, OSHA Safety Health Standards (21 CFR Subpart J), CFR Title 29, Chapter XVII, Part 1910 – Occupational Safety and Health Regulations, CFR Title 21 Food and Drugs, Part 1020, Performance Standards for Ionizing Radiation Emitting Products.
1.1.4.2 ASTM DOCUMENTS: ASTM E2339 ‐ Standard Practice for
Digital Imaging and Communications in Nondestructive Evaluation (DICONDE), ASTM E2698 – Standard Practice for Radiological Examination using Digital Detector Arrays, ASTM E 1742 Standard Practice for Radiographic Examination, and SMPTE RP 133 – Specifications for Medical Diagnostic Imaging Test Pattern
2 Installation: Turn Table Riser & System Installation
2.1 Installation of this equipment will be located in building 5250 of LEMC. Installation shall include shipment of the equipment from the manufacturer to LEMC. Then offloading the equipment at LEMC and placing the equipment inside of 5250, and removal of all shipping materials.
Installation shall include all movement and handling of each of the parts, components, power supplies, hardware, mounting brackets, cabinets, external assemblies, tubes, controls, anything else required to make the equipment operational, shall be handled, moved and controlled by the contractor.
2.2 All technicians involved in technical service or PM, or installation must be able to successfully pass a background security check in order to access LEMC.
2.3 All technicians that will attend any portion of the on-site activities at LEMC must abide by the Federal COVID 19 reporting and vaccination status guidelines.
3 Training: Turn Table Riser & System Installation
3.1 DR / CT System Training: 7 Days On-Site DR/CT system operation training. This shall be provided as 4 Days On-Site training for system operators covering: digital radiography, computed tomography, and operation/maintenance/safety of the delivered CT system operation. This training shall be provided as part of the system delivery and acceptance.
3.2 6 Seats to Digital Radiography & Intro to CT Training (40 hour course): 40-hour ASTM/ASNT Certified DR/CT training course, held at vendors site. This course follows the recommended curriculum of FWG-IDR, MAI, ASTM and ASME in a format for compliance with NAS 410 Qualification/Certification program.
3.3 3 Seats to Advanced CT Training: The Advanced CT Training is a 40-hour class at vendors’ site that dives into the advanced capabilities of the Industrial CT technology. The course shall include CT Technique Development training and CT Reconstruction, The class shall focus on the advanced capabilities of the delivered system and Industrial CT technology. The course shall include CT Technique Development training and CT Reconstruction.
4 Warranty: A standard/extended commercial warranty shall be furnished with the unit.
4.1 First Year extended warranty will include all repairs and the necessary parts in order to keep the machine operational under normal operations.
4.2 Second Year extended warranty will include all repairs and the necessary parts in order to keep the machine operational under normal operations.
4.3 Third Year extended warranty will include all repairs and the necessary parts in order to keep the machine operational under normal operations.
5 Maintenance: 12 Month Hardware/Software PM -- Software and system must be made by same company:
5.1 First Year DR & CT Software Maintenance/Updates, and a single PM visit. All PMs must be conducted at LEMC. The PM visit will include all applicable parts that will require replacement during the PM.
5.2 Second Year DR & CT Software Maintenance/Updates, and a single PM visit. All PMs must be conducted at LEMC. The PM visit will include all applicable parts that will require replacement during the PM.
5.3 Third Year DR & CT Software Maintenance/Updates, and a single PM visit. All PMs must be conducted at LEMC. The PM visit will include all applicable parts that will require replacement during the PM.
6 Preservation, Packaging and Delivery: The contractor shall utilize standard commercial methods for preservation and packaging appropriate for the cabinet x ray system. As a minimum, all areas susceptible to damage from exposure to the elements shall be preserved and/or packed to prevent damage. The contractor shall be responsible for ensuring the equipment is delivered to Letterkenny Munitions Center, Building 5250 in good condition. All deliveries shall be made between the hours of 7:00 AM and 3:00 PM, Monday through Thursday with the exclusive of Federal Holidays.
7 Security, Safety, and Fire Prevention: The contractor shall comply with LEAD P 385-4, Requirements for Security, Safety, and Fire Prevention for Contractors Performing work on Letterkenny Army Depot.
8 Special Information:
8.1 Payment Phases
8.1.1 Equipment:
8.1.1.1 Phase 1: 25% of the total equipment cost shall be invoiced when a progress report is sent to COR stating that more than 75% of the equipment has been built.
8.1.1.2 Phase 2: 50% of the total equipment cost shall be invoiced when a progress report is sent to COR stating that 100% of the equipment has been built, and the machine has arrived at LEMC.
8.1.1.3 Phase 3: 25% total equipment cost shall be invoiced when a progress report is sent to COR stating that the equipment has been installed and is 100% fully functional and operational.
8.1.2 Installation: 100% of the cost shall be invoiced on after the installation is completed and the COR has signed off the installation as 100% completed, according to section 2 in this SOW.
8.1.3 Training: 100% of the cost shall be invoiced on after all the training is completed and the COR has signed off the training as 100% completed, according to section 2 in this SOW.
8.1.4 Maintenance:
8.1.4.1 Base Year: This shall begin on a designated date after the equipment has been successfully installed and operation training is completed. This shall include at least 1 PM and the extended warranty parts and labor for services. This shall also include any software and/or hardware updates according to OEM.
8.1.4.2 Option Year 1: This shall begin on a designated date exactly one calendar year after 7.1.5.2 begins and then will continue for one calendar year after this date. This shall include at least 1 PM and the extended warranty parts and labor for services. This shall also include any software and/or hardware updates according to OEM.
8.1.4.3 Option Year 2: This shall begin on a designated date exactly two calendar years after 7.1.5.2 begins and then will continue for one calendar year after this date. This shall include at least 1 PM and the extended warranty parts and labor for services. This shall also include any software and/or hardware updates according to OEM.
9 Final Acceptance: Final acceptance shall be contingent upon successful completion of all requirements of this purchase description.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (AUG 2020)
(a) Definitions. As used in this provision--
Commercial and Government Entity (CAGE) code means—
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-
Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
