ATTACHMENT B

QASP/SPECIAL PROVISIONS

(Ref. SOW Para. 3.2.12, 3.2.23)

1. ACCEPTABLE LEVEL OF PERFORMANCE.

a. Satisfactory Flight Rate. The ratio of target flights rated "Satisfactory" to the total number of rated target flights is the Satisfactory Flight Rate. In calculating the Satisfactory Flight Rate, target flights designated as "Not Rated" or "Cancelled" shall be excluded. Within any 90-day period, the minimum acceptable Satisfactory Flight Rate is established by target system as follows:

MQM-107: 90% BQM-34: 90%

RWT: 90% BMT: 90%

BATS: 98% MQM-178: 90%

MSAT: 90%

b. Operational Loss Rate. The ratio of target flights resulting in an "Operational Loss" to the total number of target flights flown is the Operational Loss Rate. In calculating the Operational Loss Rate, targets flights designated as "Cancelled" and "Not Rated" shall be excluded. Flights which result in an operational loss, but for which a "Satisfactory" rating is awarded, shall be excluded from the computation as an Operational Loss, but shall be included in the computation in total flights. Within any 90-day period, the maximum acceptable Operational Loss Rate is established by target system as follows:

MQM-107: 2% BQM/MQM-34: 3%

RWT: 2% MQM-178: 2%

BATS: N/A BMT: N/A

MSAT: 2%

c. Property Accountability. Periodic inspections, including random sampling inventories, may be scheduled by the DCMA assigned Property Administrator and/or the contract COR/TM.

The overall minimum acceptable ATOMS accuracy rate for GFM property accountability is 98%.

d. Backup Target Usage Rate. The ratio of target flights completed using the backup target to the total number of target flights flown is the Backup Target Usage Rate. A COR/TM directed target change-out is excluded in computing the Backup Target Usage Rate. Within any 90-day

Draft period, the maximum acceptable Backup Target Usage Rate is established by target system as follows:

MQM-107: 5% BQM/MQM-34: 5%

RWT: 5% MQM-178: 5%

BATS: N/A BMT: 5%

MSAT: 5%

e. Flight Report Accuracy. Periodic inspections, including random sampling, may be scheduled by the COR/TM. The overall minimum acceptable ATOMS flight reporting accuracy rate is 98%.

f. Target Flight Readiness. The acceptable level of readiness is established by returning all recovered targets to a flight ready condition within 21 days of mission completion. Periodic inspections, including random sampling, may be scheduled by the COR/TM.

2. MATERIAL BREACH.

Any of the following shall constitute a material breach of the contract. This list is non-exclusive.

a. The Satisfactory Flight Rate drops below that established in paragraph 1a, above.

b. Three consecutive flights of any target system are rated "Unsatisfactory".

c. The Operational Loss Rate of any given target system exceeds that established in paragraph 1b, above.

d. Two consecutive contractor-induced Operational Losses of any given target system occur.

e. Government Furnished Property (GFP) accountability accuracy falls below the acceptable level and an unsatisfactory rating is assigned for two consecutive inspections.

This provision does not limit the Government’s right to terminate the contract for default for reasons other than those stated above.

3. DUTY HOURS. The contractor shall exercise flexibility in scheduling personnel duty hours and duty days to meet all flight requirements.

a. Normal duty hours are eight hours per day, between 0730 hours and 1630 hours. Normal duty days are Monday through Friday, excluding Saturday, Sunday, and Holidays except when required to accommodate range schedules. Normal duty days will be substituted based on specific OCONUS deployment locations.

b. Target flights may be scheduled for launch at any hour of the day and any day of the week.

c. The contractor shall notify the COR/TM upon discovery of any condition which will result in projected overtime. The contractor shall not expend overtime hours without COR/TM approval. Approved overtime shall be reimbursed via equitable adjustment to the contract.

d. OCONUS or other salary differentials shall be paid in accordance with the policies and regulations applicable to US Army employees. Approved differentials shall be reimbursed via equitable adjustment to the contract.

4. HOLIDAYS.

a. The holidays applicable to this contract and the days of observance are set forth below:

b. In the event any of the above holidays occur on a Saturday or Sunday, then such holiday shall be observed by the contractor IAW the practice as observed by the assigned Government employees at the ranges.

5. MISSION CALENDAR.

a. The Government will make every effort to identify and schedule mission support requirements as far in advance as possible. Normally, mission calendar updates will be provided to the contractor 10 calendar days prior to scheduled events.

b. On occasion, mission support requirements will occur with less than 10 calendar days prior notification. The contractor shall meet these requirements.
