About this file
This document is a Conformance Statements and Exceptions Request form for Request for Proposal Solicitation No. BPM006272, issued by the Arizona Department of Administration State Procurement Office for a Statewide Facilities and Building Supplies contract. The document is designed for potential vendors to indicate their compliance or exceptions to the solicitation's instructions, scope of work, specifications, and contract terms and conditions.
The solicitation appears to be for a statewide contract covering facilities and building supplies, with an initial contract price period of one year. The vendor (Voss) has submitted an exception related to pricing, specifically requesting flexibility for potential price adjustments in the event of unexpected tariffs or significant cost increases, particularly for imported products. The exception notes potential tariff impacts that could cause product cost increases ranging from 30-50%. The contract seems to be structured as an indefinite delivery vehicle, allowing for potential price stability during the initial contract term while maintaining a mechanism for adjustment under extraordinary circumstances.

| 4.4.1 | Initial Contract prices shall be honored for one year after award of Contract. | Initial Contract prices shall be honored for one year after award of Contract unless unpredictable price increases happen in that time, at which time a price increase can be requested. | We have received notification that before or during the first contract year that there might be tariffs put in place on imported products. If those tariff were to be put into place, they would certainly impact some of the items in our products lines. See article at the follow web address. -- https://www.whitehouse.gov/briefing-room/statements-releases/2024/05/14/fact-sheet-president-biden-takes-action-to-protect-american-workers-and-businesses-from-chinas-unfair-trade-practices/#:~:text=The%20tariff%20rate%20on%20semiconductors,investment%20by%20market%2Ddriven%20firms -- We don't know if these tariffs will actually get put into place, and we don't know which and by how much they would actually affect our costs, but if they do we need to be able to protect ourselves finacially. We have had similar tariffs that have cause our costs on select products to increase by 30-50% and in some cases multiple increases of that size on the same products. If no such increases happen (or other increases) we would honor prices for the first contract term. |
