About this file
This is a Hawaii Bidder/Offeror Preference Certification Form (SPO-081) associated with RFP J27135 for statewide drug confirmation testing services to be provided to the Judiciary's Juvenile and Adult Client Services Branch, including specialty courts. The certification form establishes the eligibility requirements that bidders must meet to qualify for Hawaii's local business preference in the procurement process. Contractors responding to this solicitation must demonstrate they maintain a valid commercial place of business located in Hawaii that has been staffed for at least two consecutive years prior to bid submission, submit their proposal under their authorized business name in the state, and commit to performing at least 51 percent of total direct labor hours required for contract performance within Hawaii. For joint ventures, all parties must independently meet these same requirements.
Bidders certifying eligibility for the Hawaii preference must acknowledge that they will maintain these qualifications throughout contract performance and report any changes in eligibility status to the contract administrator or purchasing agency contact. The form requires certification under penalty of perjury, and failure to maintain the stated qualifications will result in a price adjustment equal to the value of the preference applied and may constitute grounds for debarment under HRS 103D-702. The contractor shall be responsible for all costs associated with labor, tools, equipment, and other resources necessary to deliver the drug confirmation testing services in accordance with the RFP specifications and conditions. Proposals must be submitted in their entirety through Hawaii's electronic procurement system (HIePRO).
