About this file
This document contains special conditions governing a contract with the State of Hawaii Judiciary for statewide drug confirmation testing services. The Judiciary seeks a contractor to provide drug confirmation testing for juvenile and adult client services, including specialty courts throughout Hawaii. The contractor will assume responsibility for all labor, tools, equipment, and related costs necessary to deliver these testing services. Proposals must be submitted in their entirety through the State of Hawaii Electronic Procurement System (HIePRO), including Section Five - Proposal Form, technical proposal, and priced proposal components, with detailed specifications referenced in the RFP J27135 documents.
The special conditions establish binding requirements for contract execution and performance. The Judiciary General Conditions Governing Contracts with the Judiciary, State of Hawai'i for Goods and Services (October 2023) are incorporated as controlling terms that supersede conflicting provisions in other contract documents. The contractor and its employees must comply with the Judiciary's Discrimination Harassment-Free Workplace Policy, with employees required to report incidents through specified procedures. All electronic information technology developed or provided under the contract must comply with Hawaii Electronic Information Technology Disability Access Standards. The executing representative warrants authority to bind the contractor to the agreement.
